2. These communities prioritize the well-being of everyone over individual
interests. Their values focus on the overall prosperity and harmony of the
entire community, rather than just individual desires. This highlights a
communal mindset that encourages cooperation, mutual support, and
shared responsibility for everyone's welfare. This approach contrasts with
the individualistic tendencies often seen in modern legal systems. Instead
of prioritizing personal gains, these communities value creating unity,
solidarity, and interconnectedness among their members.

their complexity through four key characteristics: religious, communal,
concrete, and cash. The communal aspect is especially noteworthy, as it

showcasing community support and teamwork. In this tradition,
community members voluntarily join forces to work on a shared task or
project without expecting payment. Gotong royong is all about people
working together, cooperating, and feeling a shared responsibility for the
well-being of the entire community. This practice builds a strong sense of
unity and interdependence among community members. It reflects deeply
held Indonesian cultural values that highlight the significance of

clearly acknowledges and recognizes customary law communities and
their communal features. This provision explicitly acknowledges the
concept of "Hak Ulayat," which refers to the traditional land rights of these
communities. The constitution and related laws highlight the significance
of recognizing and respecting the distinct land rights and communal
aspects important to these communities. This legal recognition is crucial
for protecting the rights and interests of customary law communities,
particularly concerning land use and ownership.
2. Although the law acknowledges and recognizes the rights of customary
law communities, there are difficulties in making sure these rights are
effectively put into action and protected. To be simply put, it's a challenge
to turn these legal principles into practical realities. To overcome these
challenges, it's not enough to just have legal recognition. We need well-
thought-out plans that fix inconsistencies, improve enforcement, and raise
awareness in society. This way, the rights that exist on paper are truly
protected in everyday life.
In customary law, focusing on communal interests means putting the community's
well-being before individual goals. This promotes a group mindset where the
community's welfare is the main concern, encouraging sustainable environmental
practices. Customary law communities recognize that their well-being is
connected to the health of the ecosystems they live in. This acknowledgment
makes sustainable environmental practices a crucial part of their overall
community values. Prioritizing communal interests creates a system where taking
care of the environment is a shared duty. It shows a broader understanding that
preserving the environment is not just an individual task but a joint effort. This
collective commitment helps both the community and the surrounding ecosystems
stay strong and healthy.
