• Payment terms: Siemens will submit Advance Retention Bank Guarantee to avoid any retention in running bill and
same will be converted to Performance Bank Guarantee to avoid any cash retention.

• Liquidated Damages: 0.5% of the contract value/PO value of the delayed part of supplies per completed week and
shall be limited to 5% of the contract value/PO value.

• Limitation of Liability:
The overall and aggregate liability of Siemens under this contract or Purchase order for any reasons whatsoever shall not
exceed and be limited to 100% of the contract or Purchase Order Price.
Neither party shall be liable and responsible for any loss of profit/revenue, loss of production, loss of use, interruption of
operations, loss of information and data, loss of capital/interest, damages based on customer's contracts with their customers,
regardless of whether and how the applicable law qualifies those damages also consequential, incidental, direct, or indirect.
