Sub: Request for modifying the directions issues vide Memo No. PERS-ASRB0PAY/170/2019-
3ASR, dated 31/3/2023 regarding reimbursement of balances dues against Special Pay Advance and
expenditure incurred on Trekking, Village visit during the Foundational Course and IAS Profes-
sional Course Phase-1 conducted by LBSNAA, Mussoorie.

Your kind attention is invited to above referenced letter to the Deputy Commissioner, Barnala ( with
a copy to the undersigned) wherein it has been directed that a sum of Rs. 55000/- be deducted from
the salary of the undersigned and deposited by draft towards Administrative Officer (Accounts),
LBSNAA, on account of Special Pay Advance and Expenditure incurred towards Village Visit,
Trekking, DA Winter Study Tour(WST) and Transfer Advance for joining place of Posting.

To the knowledge of the undersigned, the issue of remittance of this advance towards the LBSNAA
arises out of a Letter (attached herewith) dated 08.11.2021 from the LBSNAA Administration to the
Chief Secretary, Govt of Punjab with a request to remit the expenditure towards above-mentioned
heads, towards the Academy by the Govt of Punjab. In the letter, a reference is made to the para (2)
of the letter No. 25/84/775-Trg. II dated 8th Sept, 1976 of the GOI which reads as follows:

“Until a trainee has started getting his personal entitlements from the allottee State Govt.,
the personal entitlement of the trainee may be disbursed by the Academy and debited to a
suitable suspense head, in the Public Account of India, followed by effective action to re-
cover the payment from the allottee State Government”

The letter further reads

“the reimbursement of the expenditure as mentioned above is to be made directly and in-
directly through the concerned probationers to the Academy by the state government as
the case may be. If any amount has already been paid to the concerned Probationers by
the State Governments/cadre concerned, they may be advised to remit the amount to the
Academy without any delay. “

It is submitted that the concerned amount to the tune of Rs. 55,000/- as Expenditure incurred to -
wards Village Visit, Trekking, WST and Transfer Advance, was allowed to the undersigned by LB-
SNAA, as administrative institution designated for training, after proper verification in due course
including after submission of related documentation. It is also merits mention that all the above ac-
tivities including Village Visit, Trekking and WST are not optional modules but necessary part of
the curriculum, and marked towards the final academic merit. They are paid by the Academy to the
Officer Trainees (OTs) as per the duration of these training engagements, and include such ex-
penses as Travel Allowance etc., after submission of concerned documentation by the OTs and veri-
fied by the Course Administrators, but reclaimed from the concerned State Govts, as per the rules,
as has been done in the present case.

Thus, it wasn’t in proper course for the undersigned to file separate/additional claims for them with
Govt of Punjab, which have been claimed from the Academy, and are to be settled with the con-
cerned State Govt. by the Academy as per rules. It merits mention that the letter of the dept dated
25.02.2022 (attached) asking for documentation regarding the expenditure concerned, was improp-
erly directed towards the undersigned, as the requisite documentation is maintained regarding these
course activities by the Academy, and is neither maintained by the OTs nor is required to be sepa-
rately submitted to the State Government.

In light of the above, it is humbly requested that a modification of the letter dated 31.03.2023 , may
kindly be issued in light of the facts and rules, and the direction for deduction of said amount of Rs.
55,000/- from the salary of the undersigned may be withdrawn, as the amount has been paid duly to
him by LBSNAA, as per the rules and regulations of the GOI. It is further requested that under-
signed may be dispensed from filing a re-claim for the expenses with the Govt of Punjab as the nec-
essary claims were authorised only after due process by LBSNAA, after submission of original doc-
uments, and settlement of dues as is the case at present is entirely a matter inter se between the
Academy and the Govt of Punjab.
