Subject: Amendments in the Minimum Wages for Unskilled Workers

Your kind attention is drawn to ensure compliance with the section 10 of EOB Act 1976 wherein the
establishments are required to submit returns and details of the insured persons along with payment of
contribution through EOBI’s Facilitation System for the smooth disbursement of benefits to the workforce as
available under Employees’ Old-Age Benefits Act, 1976. To achieve this objective, the establishments have
been provided the facility to upload the data along with payment of contribution as per prescribed rate.
Whereas Section 23 of the Punjab Minimum Wages Act, 2019 (Act XXVII of 2019) had repealed the
Minimum Wages for Unskilled Workers Ordinance, 1961 (XXXIX of 1961) and the West Pakistan
Minimum Wages for Unskilled Workers Ordinance, 1969 (XX of 1969); however, it further enacted under
clause (b) of Sub-section 2 of Section 23 of the Act ibid that notwithstanding the repeal of the
aforementioned Act and Ordinance, any reference to the repealed Act and Ordinance shall be construed as
reference to the corresponding provisions of the Act, 2019. Therefore, the rates of wages in terms of clause p
of Section 2 of the EOB Act, 1976 shall be such as declared under the Act, 2019.

Moreover, under Section 6 of the General Clauses Act, 1897, the repeal of aforesaid statutes shall not
affect the vested rights of the Institution to collect the contribution towards EOB Fund. Accordingly, the rate
of contribution is to be determined which is also protected by Clause (7) of Article 270AA of the
Constitution of the Islamic Republic of Pakistan 1973.

Whereas, the Governor of the Punjab in exercise of the powers conferred under section 6 of the
Punjab Minimum Wages Act, 2019 (Act XXVII of 2019), on the recommendations of Minimum Wages
Board specified the minimum rates of wages for unskilled workers amounting to Rs. 25,000 Per Month
w.e.f. Jul 1st, 2022 vide notification No. SO/D-II)MW/2011(Vol-VI) dated 22nd June, 2022, published in the
Punjab Gazette dated 24th June, 2022. Thus, the contribution under the provisions of EOB Act, 1976 shall be
payable as per given schedule:
Employer’s Share @ 5% of Minimum Wages Rs. 1,250 (25000 x 5%)
Employees’ Share @ 1% of Minimum Wages Rs. 250 (25000 x 1%)
Total Per Employee Contribution Per Month Rs. 1,500 (1250 + 250)

Now, therefore, you are requested to generate EOBI monthly contribution payment voucher through
Facilitation System, in order to safeguard the interest of insured persons, by using EOBI web portal
available on official website of EOBI (www.eobi.gov.pk).
