RESOLUTION NO. 3 – S - 2024

“A RESOLUTION REQUESTING THE BUREAU OF INTERNAL REVENEU (B.I.R)
DISTRICT OFFICE MASBATE HAVING JURISDICTION OVER THE LOCATION OF
THE BARANGAY MAHAYAG, PLACER, MASBATE TO REGISTER AND ISSUE A TAX
IDENTIFICATION NUMBER (TIN) OF THE SANGGUNIANG KABATAAN OF
MAHAYAG.”

WHEREAS, Pursuant to Section 20(b) of the Implementing Rules and Regulations of Republic
Act (RA) No. 10742, the SK shall have financial independence in its operations, disbursement
and encashment of their funds, income, and expenditures., xxx;

WHEREAS, Pursuant to Section 4.2.11 of Revenue Regulation, (RR) no. 7-2012, a person who,
although exempt from the imposition of the taxes imposed under code, as amended, is
nevertheless required to withhold taxes on account of income payments made to taxable
individuals or entities, are required to, or may secure TIN;

WHEREAS, National Youth Commission (NYC) Executive Director and COO sent a letter to
the Bureau of Internal Revenue (B.I.R) dated May 20, 2019 inquiring if the issuance of the
Taxpayer Identification Number (TIN) of the Sangguniang Kabataan (SK) be a separate entity
of their Barangay-Local Government Unit (BLGU);

WHEREAS, as per the reply letter of Bureau of Internal Revenue (BIR) Assistant
Commissioner to the National Youth Commission (NYC) executive director and COO dated
September 30, 2019, SK should register with the Revenue District Office (RDO) having
jurisdiction over the location of the Barangay, since SK shall become a withholding agent on
purchases made to taxable individuals or entities;

NOW, THEREFORE, be it resolved and it is hereby resolved to request the Bureau of Internal
Revenue (BIR) Revenue District Office (RDO) Masbate having jurisdiction over the location of
Barangay Mahayag, Placer, Masbate to register and issue a Tax Identification Number (TIN) of
the Sangguniang Kabataan of Mahayag, Placer, Masbate;

RESOLVED FURTHER, that copy of this resolution be given to Revenue District Office (RDO)
Masbate for their file, copy furnished the DILG Municipal Local Government Operations
Office and the Local Youth Development Office of Placer, Masbate, for their information and
record.
