A RESOLUTION ENACTING AN ORDINANCE ESTABLISHING THE GUIDELINES FOR THE ESTABLISHMENT OF


THE BARANGAY SENIOR CITIZENS ASSOCIATION (BSCA), THE FEDERATION OF THE SENIOR CITIZENS
ASSOCIATION (FSCA) AND PROVIDING FUNDS THEREFOR.

WHEREAS, pursuant to Article XV Sec. 4 of the Constitution it is the duty of the family to take care of its
elderly members while the State may design programs of social security for them;

WHEREAS, it is a declared policy of the State under Rule 2, IRR of RA 11350 “to make sure that the
Senior Citizens are cared for, empowered, protected, tapped and consulted”. Therefore, there is a need
to ensure the establishment of a strong and empowered organization of Senior Citizens;

WHEREAS, there is a need to organize the Senior Citizens and provide them a systematic guide in the
organization and operation of their organization to avoid disorder and chaos which will result in
confusion;

THEREFORE, on motion of ____________, seconded by ____________________ be it resolved as it is


hereby resolved to enact the following ordinance;

AN ORDINANCE ESTABLISHING THE GUIDELINES FOR THE ESTABLISHMENT OF THE BARANGAY SENIOR
CITIZENS ASSOCIATION (BSCA) AND THE FEDERATION OF THE SENIOR CITIZENS ASSOCIATION (FSCA)
AND PROVIDING FUNDS THEREFOR.

Be it enacted by the City Council duly assembled and in session, to wit;

SECTION 1. This ordinance shall be known as the SENIOR CITIZEN EMPOWERMENT AND GOVERNANCE
Ordinance.

SECTION 2. Definition of Terms

a. National Commission of Senior Citizens (NCSC) – referred to as the Commission per RA


11350 mandated to ensure the full implementation of laws, policies and programs of the
government on senior citizens, review and conduct related studies, and recommend policy
to Congress and the President;
b. Barangay Senior Citizens Association (BSCA) – referred to as the Association with general
membership composed of individual senior citizen;
c. Federation of Senior Citizens Associations (FSCA) – referred to as the Association with
general membership composed of BSCA represented by its Presidents;
d. Senior Citizens – all Filipino citizens who are at least 60 years old;
e. Regular Member – a Senior Citizen who is a registered voter of the Barangay he/she is
residing.
f. Associate Member – a Senior Citizen who is a resident but is not registered voter of the
Barangay he/she is residing;
g. General Membership – composed of all the Regular Members of the BSCA or FSCA where
applicable.
h. By-laws – the document that details the major policies and guidelines upon which the
operation of the Association is based upon.
i. Board of Directors – referred to as Board is the governing body of the Association composed
of (odd number) from seven (7) to fifteen (15) members elected by the General
Membership.
j. Officers of the Association – are the elected Board of Directors, the elected Members of the
various standing Committees, the appointed Secretary and Treasurer.

Section 3. Scope. This Ordinance shall govern the organizations of Barangay Senior Citizens Association
and the Federation of Senior Citizen Associations of Tanjay City.

Section 4. Creation and purpose of BSCA and FSCA.

There shall be created and organized in every Barangay a BSCA and only one FSCA in Tanjay City.
These Associations shall:

a. serve as a mechanism for program collaboration, and coordination in the implementation of


various programs, projects and activities by government and non-government agencies and
organizations;
b. spearhead in the formulation of policy initiatives for the development and welfare of the
senior citizens.
c. Advocate for the protection and respect for the full enjoyment of the rights of the Senior
Citizens;
d. Develop and implement programs and services that will advance the interests and benefits
of the Senior Citizens;

However, the Association should not engage in any programs that are insurance and insurance-
like in nature.

Section 5. Powers and Functions of the FSCA and BSCA.

a. Coordinate and harmonize the implementation of various plans, programs and projects of
the government;
b. Assist the Commission in the broad-based monitoring and coordination of the
implementation of the Plans;
c. Prepare the annual plan through a participatory process for the utilization of the fund
regularly allocated by the LGU;
d. Prepare reports on the state of the senior citizens and the status of its programs, projects
and activities;
e. Represent the Senior Citizens in any functions, fora, assembly, consultations and the like;
f. Perform other functions that are deemed beneficial to the senior citizens.

Section 6. Membership. All Filipino citizens who are at least sixty (60) years old are automatically
considered members of a Barangay Senior Citizens Association (BSCA). No policy should be instituted by
a BSCA or FSCA to curtail or deprive a Senior Citizen to enjoy this inherent right and benefits due a
Senior Citizen.

Section 7. Officers of the BSCA and FSCA.

Generally, the Officers of the Association are those who are elected by the General
Membership. They are the members of the Board of Directors and elected members of the Committee.
However, the appointed Secretary and Treasurer who must come from outside the Board of Directors
shall also be considered as Officer. The appointed Officers must not be closely related to the
Chairperson or the Vice-Chairperson by affinity or sanguinity. The By-laws of the Association must
provide provisions to ensure this is adhered to.

The Board of Directors. The Board is generally responsible for the formulation of policies that
will guide the Executive Committee in the performance of their job. It sets the direction of the
Association. It renders report on the affairs of the Association during General Membership meetings.
And performs other functions deemed necessary. The board shall meet regularly once a month. Special
meetings maybe called for by the Chairperson anytime when necessary.

The Committees. The functions of the Committees are as follows:

a. Executive Committee. This Committee is composed of at least five (5) members. It shall
perform the day-to-day operations of the Association. This is headed by the Chairperson
of the Board. The members are the Secretary, Treasurer who are appointed by the
Board, and other members determined and appointed by the Chairperson. The
appointees may come from outside the General Membership and must be able to
perform administrative functions and assume responsibilities required for the efficient
operation of the Association. This Committee shall regularly render report to the Board.
b. Election Committee. This Committee is composed of three (3) members elected by the
General Membership. It shall formulate the election guidelines to be approved by the
General Membership. It shall preside on all elections of the Association and resolve
within reasonable time any protests related to said election.
c. Audit Committee. This committee is composed of three (3) members elected by the
General Membership. It shall perform a regular audit on all financial transactions of the
Association. Specifically, it inspects, examines, and audits all transactions, financial or
otherwise, made by the Chairperson, other officers, and or the Association itself. It shall
Submit reports to the Association at least once a year, or as required by the Association,
the Commission and other regulatory authorities.
d. Other Committees. The Board may create such committees that will study and or carry
out specific undertakings, make coordination more effective, aid in making decisions
and settling conflicts and disputes. Their term of office shall be co-terminus with the
appointing officers or after the mandate or purpose for which it is created has been
fulfilled or accomplished.

Section 8. Honorary Chairperson. The Local Chief Executive (LCE) of the City and the Punong Barangay
(PB) shall be Honorary Chairpersons of the FSCA and the BSCA respectively. The Honorary Chairperson
may participate in all meetings of the FSCA or the BSCA Board and the General Membership. He or she is
authorized to call and preside any meetings of the Association. However, only in cases where the
Officers fail to convene and meet the Board or the General Membership as required.

Section 9. Duties and Responsibilities of Officers. The Board and the Committees shall elect from
among themselves the Chairperson and Vice-Chairperson. They shall have the following duties and
responsibilities:

a. Chairperson
1.) Presides in all the meetings;
2.) Exercises general supervision and control over the operation and internal administration
of the Association;
3.) Signs all papers, agreements and other documents for and on behalf of the Association,
subject to its existing policies and guidelines;
4.) Calls special meetings of the Association, when necessary;
5.) Ensures that the Association maintains records of all its proceedings and operations;
6.) Represents the Association in any fora, assembly, consultative meetings and the like
called by the Commission, LGU and other bodies; and
7.) Performs such other duties and responsibilities as may be necessary.
b. Vice-Chairperson
1.) Acts as Chairperson in case of the absence of the Chairperson; and
2.) Performs such other duties and responsibilities as may be delegated to him or her by
the Chairperson.
c. Secretary
1.) In consultation with the Chairperson of the Association, prepares the agenda of
meetings and records the attendance and proceedings of all meetings of the
Association;
2.) Serves notices of meetings to all members of the organization;
3.) Prepares and signs the Minutes of all Meetings;

4.) Furnishes the officers and members certified copies of minutes of the meeting;
5.) Keeps a register of the names, addresses and contact details of all the members;
6.) keeps a complete file of the laws, ordinances, resolutions and executive orders relevant
to the operation of the Association;
7.) Custodian of the corporate records of the Association;
8.) Performs all the duties inherent to the functions of the Secretary and those that may be
assigned by the Chairperson.
d. Treasurer
1.) Maintains and updates regularly the financial books of accounts;
2.) Have custody, control and accountability of the funds, properties and accountable forms
of the Association;
3.) Disburses all expenditures of the Association in accordance with policies, plans and
budgets;
4.) Renders financial reports during meetings or when required;
5.) Prepares a fiscal year-end report of all financial transactions;
6.) Ensures annual financial audit is conducted; and
7.) Performs other duties as maybe assigned by the Chairperson.

The Chairperson and Vice-Chairperson of the Committees shall perform functions inherent to
their positions as provided for in their By-laws.

Section 10. Removal of Officers. Officers of the Association maybe removed by at least two-thirds (2/3)
votes of all the members of the Board or the General Membership for cause. Loss of confidence should
not be a ground of removal.

Section 11. Election. All elections shall be done through secret balloting. It shall be presided or
administered by the Election Committee.

The election of officers should be held not later than 90 days from the beginning of the year. The
first regular election under this ordinance shall be in year 2023 and every year thereafter.

Section 12. Term of Office. The term of office of the elected officers shall be two (2) years and shall
commence at noon on the day following their election. No officer shall serve for more than three (3)
consecutive terms. However, there shall be no limit as to the number of terms an Officer may serve. The
term of an Officer shall end after a new set of Officers are elected.

On the first regular election under this Ordinance, the first half of the Board and the first two of
the Committees who garner the highest number of votes shall serve for two-year term, while the second
half shall serve for only one-year term. Thereafter, all the elected members of the Board and
Committees shall serve for a term of two years.

Section 13. Vacancy. Any vacancy in the officers of the Association may be filled by a majority vote of
the members of the Board. The appointed replacement officer shall serve only the unexpired term of his
or her predecessor.

Section 14. Meetings. The Association may set in their By-laws the schedule and frequency of their
meetings. The Board should meet at least once every month and the General Membership at least once
a year. And when necessary, special meetings maybe held to tackle specific agenda.

All BSCA shall hold their Annual General Membership meeting not later than the end of the first
quarter of the year. While the FSCA shall hold its Annual General Membership meeting not later than
the end of April of the same year. The date of the Annual General Membership meeting must be set in
the by-laws.

Special meetings of the General Membership may be called anytime as the need arises by a
resolution of the majority of the members of the Board of the Association or Federation or by a petition

signed by at least ten (10) percent of the general membership. The agenda of the special membership
meeting shall only be that which is contained in the Notice of Meeting.

Section 15. Notice of Meeting. A notice of meeting containing the date, place, time and agenda shall be
sent to every member at least three (3) days before the scheduled meeting, either by email, personal
delivery, short messaging (text messaging), facsimile transmittal or any means provided in the By-laws.
Notice may not be necessary if a regular meeting schedule has been set.

Section 16. Quorum. The quorum required for any meeting of the Association shall be at least 25% of
the general membership. However, for purposes of meeting, the presence of five members and or
officers shall be considered in quorum provided the Chairperson of the Association is present. A quorum
based on the General Membership must be present when deliberating major concerns.

With presence of quorum, all decisions must at least garner simple majority vote of the
members present to be valid except in cases of major decisions where more votes shall be required as
provided for in the by-laws.

Section 17. Order of Business. As far as practicable, the order of business of the meeting of the
Association shall be as follows:

a. Call to Order
b. Roll Call
c. Determination of quorum
d. Proof of due notice
e. Approval of the Agenda
f. Reading, correcting and approval of the Minutes of the previous meeting
g. Matters arising from the minutes of previous meeting
h. Officer’s/Committee’s Report
i. Unfinished business
j. Business of the day
k. Other matters
l. Announcements
m. Adjournment

Section 18. Manual of Operations. The organization shall develop and adopt its own manual of
operations which shall govern their operation. It shall include financial management systems.

All financial transactions shall be in accord with applicable policies and guidelines set by the
Board of Directors. Disbursements shall be signed by at least two (2) authorized signatories. Signatories
shall be any responsible Officer authorized by the Board of Directors. All disbursements shall use a
checking account opened at any reputable banking institutions. Cash on hands must be controlled and
limits to Petty Cash Fund should be set. All cash receipts should be deposited in the bank intact the next
banking day.

Section 19. Funding. The Association and FSCA shall receive annually the authorized allocation from the
total cash receipts of the LGU concerned for the year as fund allocation for the programs, projects and
activities of the Senior Citizens and PWDs. The Association together with the PWD association if any shall
prepare its annual plan and budget and submit to the LGU for consideration of the respective local
Sanggunians.

Section 20. Honorarium. All officers and members of the FSCA should receive honoraria from the LGU
approved by the local Sanggunian. Officers of the BSCA may receive honoraria from their BSCA
depending on availability of their funds.

Section 21. Fiscal Year. The Fiscal Year of the Association shall be January to December.

Section 22. Annual Report. The Local Chief Executive Officer through the OSCA Officer in coordination
with the FSCA shall render a report annually to the Sangguniang Panglunsod on the state of affairs of the
Senior Citizens.

Section 23. Amendments. All amendments to the by-laws must be studied and reviewed by the Board of
Directors. Consultations with the members maybe conducted for the purpose. The by-laws maybe
amended at any regular or special meeting of the General Membership of the Association. Provided
notice be given at least seven (7) days prior to the meeting where the amendment is to be voted or
acted upon. The By-laws shall be amended by a vote of fifty percent plus one of the General
Membership. The adoption and approval of an amendment to any provision of the By-laws shall become
effective immediately upon approval.

Section 24. Separability Clause. In any instance that certain provisions of this Ordinance are declared
unconstitutional, unlawful and invalid by any competent authority, the remaining provisions not
affected shall be considered in full force and effect.

Section 25. Repealing Clause. All ordinances, executive orders and the like which are found inconsistent
to the provisions of this Ordinance are hereby repealed, modified or amended accordingly.

Section 26. Effectivity. This Ordinance shall take effect immediately upon its approval.
