Whereas it has been functioning throughout the country according to democratic principles and its activities have increased and are ever increasing. Whereas it is considered expedient to a written constitution for the parishad for its all India working and to get it registered under Societies Registraation Act of 1860. This constitution is approved by the National Executive held in Delhi on 21-22 nd April 2001. Memorandum of Association Name: The name of the Society shall be Akhil Bharatiya Adhivakta Parishad. Office: 2A, Ram Kishore Road, Civil Lines, Delhi 110054. **************************************************************** Aims and Objects: The aims and objects of the Adhivakta Parishad are :(a) to inculcate and promote professional ethics among the Advocates, (b) to take necessary steps to reform and improve the legal and judicial systems in accordance with the requirements of the people and in confirmity with Bharatiya values; (c) to improve the quality of Advocacy; (d) to take steps necessary to improve the quality of legal education; (e) to hold,seminars,symposiums meetings to create public opinion in right direction on various problems of national interest. (f) to provide periodical training and continuing education to the Advocates; (g) to establish educational institution to impart legal education; (h) to inculcate patriotism and sense of service among the Advocates;

(i) to protect and preserve National values of life in legal fraternity and Administration of Justice; (j) to provide legal Aid and assistance to deserving persons who are involved in litigation of social and national cause; (k) to motivate the Advocates to engage themselves in national reconstrauction and service; (l) to take such steps or to organise such other programmes which are considered necessary in National interest and local issues. 5. For and in connection with the furtherance of its objects or any of them the Sangam shall have powers: (a) To establish, acquire,take over, carry on and maintain in affiliation or otherwise, Law Colleges, Law Classes and teaching or training institutions. (b) To issue appeals and applications for funds and to accept gifts, subscriptions and donations in the form of cash or securities and for porperty moveable or immoveable and to borrow or otherwise raise money with or without security. (c) To purchase, take on lease or otherwise acquire and to sell, give on lease, exchange or otherwise transfer or dispose of all or any moveable or immoveable properties of Sangam. (d) To construct, maintain, alter, improve and develop any buildings or works. (e) To offer prizes and to grant scholarships to deserving Law students and research scholar in legal studies. (f) Todo all such lawful things as may be conducive or incidental to the attainment of the objects of the sangam. (g) All the income, earnings,moveable, immovable and lease properties of the Sangam the promotion of its aims and objects only as set forth in the Memorandum of Association and no profit on there of shall be paid or transferred, or in any manner whatsoever to the present or past Members of the Sangam or to any person claiming through any one or more of the present or past members. No member of the Sangam shall have any personal claim on any moveable or immoveable properties of the Sangam or make any profit, whatsoever, by virtue of his membership. Rules and Regulations Akhila Bharatha Vazhakarignarkal Sangam 1.Membership

a) Founder Members: Members of the First State Executive shall be Founder Member of the Sangam. b) Members: Any Practicing Advocates in the State of Tamilnadu and Puducherry can became a member on paying the prescribed membership fee alongwith the application. 2. Termination of Membership: The membership may be terminated:(a) If a member dies. (b) If a resignation is submitted by a member in writing to the Secretary and accepted by the Executive Committee. (c) If a member does such activities as are harmful to the interests of the Sangam, a decision in this regard will be taken by Executive Committee. State Council There shall be a State Executive Council of the Sangam which shall be the highest policy and decisions making body in all matter pertaining to constitution, Organisation,finance and other activities of Sangam. 3. Composition of State Council: (a) The State Executive Council will normally hold Two meeting in a year and may hold special meeting on a requisition by at least 15 members or when the State Executive deems it necessary. (b) The annual meeting of the State Executive Council shall be called by the President, Secretary for transacting the following business:(i) To elect the President, Secretary and Treasurer for the next term. (ii) To approve the annual report and the audited accounts. (iii) To approve the budget of the Sangam passed by the State Executive. (iv) To approve the appointment of the auditors for the next year/term by the State Executive Committee. (v) To consider such other matters as may be brought forward with the permission of the President. 5. Management State Executive Committee. (a) The number of the members of the State Executive shall not be more than 21. The first members of the State Executive are specified in the Memorandum of the Association and shall hold office for three years from the date of registration of the Sangam under Act 27 of 1975. Before the expiry of the said period a new State Executive shall be constituted by State Council.

(b) The term of the office of the State Executive shall commence from the date of expiry of the term of office of the first State Executive. Thereafter at every third annual State Council shall be constituted as bellow: (c) Two term of the office of the State Executive shall commence from the date of expiry of the term of office of the first State Executive. Thereafter at every third annual State Council shall be constituted as bellow: (d) The State Executive may invite the eminent Lawyers to the meeting from time to time for seeking guidance. 6. Composition and Method of Constituting State Executive of the Sangam 21 Members of State Executive shall consist of:i) President ii) Vice President (2) iii) State Secretary iv) Joint Secretaries (2) v) Treasurer vi) Office Secretary vii) Members not more than 13 b) The President, the Secretary and the Treasurer shall be elected by the State Council. c) The President shall nominate other office bearers and members of the State executive. d) Provided the State executive shall continue in office all the immediate next meeting of the State Council. 7) Power to Issue Guidenlines and Remove Difficulties: All matters of Organaisation, Administration and all activities of the Sangam shall be carried on in accordance with guidelines issued by the State Executive from time to time. 8) Powers and Functions of the State Executive All properties of the Sangam moveable and immoveable shall remain vested in the State Executive and the Management of the Sangam shall be conducted, controlled and supervised by the State Executive who shall gave full powers to do all that may be necessary or desirable to give effect to the objects of the Sangam. In addition to and without

restricting the generality of the powers provided in the Memorandum of Association it shall have the powers:(a) To decide applications for membership. (b) To establish, affiliate and maintain District Level Advocates Association. (c) To make or sanction bye-laws laying down its own procedure of work and for the guidance of any of the Committees and Sub-committees of the Sangam and to add, rescind or alter any such bye-laws District Advocates Association. (d) To guide and assist District Advocate Association (e) To receive, to have custody of and to expand the funds of the Sangam for the attainment of the objects of the Sangam. (f) To open an account or accounts in any Scheduled Bank, which shall be operated by not less than two authorised office bearers of the Sangam. (g) To appoint committees and sub-committees for disposal of any business of the Sangam and advice of any matter pertaining to the Sangam. 9. The State Executive shall function notwithstanding any vacancy therein and notwithstanding any defect in its constitution and no act or proceedings of the State Executive shall be invalidated merely by reason of the existence of a vacancy or vacancies in the Executive or of any defect in its constitution. 10. Powers and Duties of Office Bearers A. President i) To preside over meetings. ii) To nominate Patrons and Honorary Member. iii) To nominate the office bearers members of the State Executive. iv) To give a casting vote if the votes are in equal numbers. V) To call meeting in emergency vi) The President may delegate his powers to the Vice-President. B.Vice-President To preside over the meetings in the absence of the President and to officiate for the President when so authorised. C) Secretary i) To call meeting of the State Executive /Council at least twice in a year ii) To issue notice of any meeting of the State Executive/Council at least 30 days before the meeting. Emergency meeting may however be called at the notice of seven days.

iii) To look after income and expenditures of the Sangam and the institutions under it and to pass regular payments. iv) To pass any incident or unexpected expenditure up to Rs.3,000/- at one time. v) To shoulder responsibility on behalf of the State Executive in respect of Executive of day to day working of the institutions run by the Sangam. vi) To shoulder responsibility on behalf of the State Executive regarding correspondence and all legal proceedings. vii) To sanction leave to paid employees. viii) To place before the State Executive /Council for their approval, the income and expenditure account of the preceding year after getting it audited and with the report of the Auditors. ix) To borrow loan on behalf of the Sangam with the approval of State Executive and if so authorised. x) To appoint, fix the remuneration of, promote, suspend and dismiss its employess in anticipation of confirmation by the State Executive. xi) The State Secretary may delegate all or any of his powers to the Joint Secretaries. (D) Joint Secretaries To help the State Secretary in Execution to carryout the affairs of the Sangam and to shoulder responsibility of the Secretary in his absence, if so authorised. (E) Treasurer i) Tokeep maximum Rs.5,000/- at one time with him. The amount in excess of this sum shall be deposited in the account of Sangam with the Bank. ii) To receive funds, membership subscriptions, donations or help of any other kind and to keep the complete account of income and expenditure. 11. Reserve Fund. A minimum of Rs.5,000/- (Rupees five thousand only) will be kept as reserve fund at all times for emergency purposes. The amount shall be deposited with a Bank according to the decision of the State Executive. 12. Income & Property:(a) The income of the Sangam shall only be utilised by way of expenses in its working, construction of building, maintenance of building and on works of its development.

(b) Where the gains of property shall be utilised acquiring properties as may be approved by the State Executive. (c) The purchase, sale or transfer of any movable and immovable property of Sangam shall only be effected by a special resolution of State Executive and under the joint signature of the President and State Secretary. 13. Notice for Meetings Notice for the State Council meeting will be sent one month before the meeting. Any accidental omission to send any notice or non-receipt of any notice by any member shall not invalidate the preceedings of any meeting. 14.Quorum The quorum for the State Council meeting will be 1/5, of the total membership and for State Executive meeting it will be minimum 4 members. 15. Financial Yer The financial year will be from 1st April to 31st March 16. Audit of Account The State Council will appoint the Charted Account auditing the account of the Sangam. 17. Annual List of State Executive: a) Any amendment in the Memorandum of Association or Rules will be carried out in accordance with procedure laid down under Section 12 of Tamilnadu Society Act 1975. 18. Dissolution and Adjustment of Affairs:If the Sangam need to be dissolved, it shall be dissolved as per the provisisions laid down under Section 41 and of the Tamilnadu Socities Act 1975 as applicable to the State. 19. Application of the Act:All the provisions under all the sections of the Societies Registration Act,1975 as applicable to the State of Tamilnadu. 20. Essential Certificate:Certified that this is the correct copy of the Rules and Regulations of the Akhila Bharatha Vazhakarignarkal Sangam.

Funds to criminals under lens The Crime Branch has launched a probe into the role of an evangelist group in raising funds for Govindachamy, who has been found guilty in the Soumya murder case. Govindachamy is reportedly a member of Akasha Paravakal, an evangelist group, and had converted to Christianity taking the name of Charley Thomas. When he was arrested, Govindachamy initially identified himself as Charley. The Salem native raped Soumya, a mall employee travelling in the Shornur Express, after pushing her out of the running train in February this year. She died five days later. The Thrissur fast-track court termed him guilty this week. Investigators had found that Govindachamy, who used to beg for alms in trains, had lakhs of rupees in his bank account. The CB team is also probing whether Govinda- chamy had links with the beggar mafia of South India. The CB initated a probe after Govindachamys counsel, Mr Aloor, revealed that he was paid `10 lakh for appearing in the case. Sentence in Soumya case is unlikely to be pronounced on Friday as the prosecution proposes to produce two fingerprint experts from Tamil Nadu police to prove that the accused is a habitual offender. The Thrissur fast-track court had found him guilty.

The judge also slapped a fine of Rs 100,000 to Charly. The man from Tamil Nadu was found guilty of rape and murder of Soumya, a 23-year-old woman, who he pushed out of a running train in February this year. The case was that Charly Thomas had assaulted her in the ladies compartment of Kochi-Shornur passenger train on February 1 and pushed her out immediately after it left Vallathol Nagar railway station. She was on way to her home near Shornur after attending office at Ernakulam. Charly Thomas was arrested on February 3 from Palakaad. Soumya succumbed to her injuries at Thrissur Medical College Hospital on February 6. Soumya murder case: Accused gets death sentence A fast track court in Thrissur, Kerala on Friday awarded death sentence to a man from Tamil Nadu for raping and murdering a 23-year-old woman, whom he pushed out of a running train in February. Pronouncing the sentence, Judge Raveendra Babu said 30-year-old Govindachamy had committed the offences in a "diabolic manner" and did not deserve any leniency. The victim was raped in a "brutal" and "cruel" manner, the judge said while awarding the death sentence and imposing Rs one lakh fine on him, besides sentencing the accused to varying terms of rigorous imprisonment under different sections of the IPC. On October 31, the court had found Govindachamy guilty of offences under IPC sections 302 (murder), 376 (rape), 394 (person voluntarily causing hurt in committing or attempting to commit robbery), 397 (robbery or dacoity, with attempt to cause death or grievous hurt) and 447 (criminal trespass). According to the prosecution, Govindachamy had assaulted the Soumya in a deserted ladies compartment and pushed her out of the train,

immediately after it left Vallathol Nagar station on February 1. He then carried her to a deserted spot on the rail tracks and raped her "cruelly and brutally". The accused had also injured her seriously resulting in her death on February 6. Pressing for maximum punishment, prosecution had submitted that the accused was a "habitual offender" and produced documentary evidence to show that he had been convicted in eight cases in Tamil Nadu from 2004 to 2008. Welcoming the verdict, Kerala Chief Minister Oomen Chandy told rediff.com: "It is a good verdict. I have announced special awards to the advocates and the dedicated police officials who worked on the case." State Scheduled Caste and Scheduled Tribes Minister P K Jayalakshmi said: "The fast track court has given the verdict the Govindachamy, the accused, deserves. Kerala society should be aware of such persons, who had shown no mercy to a hapless woman." Reacting to the fast-track court's verdict, Soumya's mother Sumathy and her brother Santhosh thanked the advocates and the policemen and hoped that such an incident should never happen to any girl in the state again.
