16 RESTRUCTURING AND STRENGTHENING THE PHILIPPINE NATIONAL POLICE,
17 AND CREATING ADDITIONAL POLICE OFFICES, AMENDING SECTIONS 25, 26,
18 29, 31, AND 35 OF REPUBLIC ACT NO. 6975, OR THE “DEPARTMENT OF THE
19 INTERIOR AND LOCAL GOVERNMENT ACT OF 1990",
20 APPROPRIATING FUNDS THEREFOR, AND FOR OTHER PURPOSES”

22 Be it enacted by the Senate and the House of Representatives of the
23 Philippines in Congress assembled:

25 SECTION 1. Section 25 of Republic Act No. 6975 is hereby amended to read
26 as follows:

28 “Section 25. Organization. – The PNP COMMAND GROUP
29 shall be COMPOSED OF THE (headed by a) Chief PNP(who shall be
30 assisted by two (2) deputy chiefs, one (1) for administration and one
31 (1) for operations), DEPUTY CHIEF PNP FOR ADMINISTRATION,
32 DEPUTY CHIEF PNP FOR OPERATIONS, AND CHIEF OF THE
33 DIRECTORIAL STAFF. (both of whom) PROVIDED, THAT THE
34 MEMBERS OF THE PNP COMMAND GROUP, EXCEPT FOR THE
35 CPNP, shall be appointed by the President upon recommendation of
36 the Commission from among the most senior and qualified officers in
37 the service.[Provided, however, That in no case shall any officer who
38 has retired or is retirable within six (6) months from his compulsory
39 retirement age be appointed as Chief of the PNP.]
40 The PNP shall be composed of a national office, AREA POLICE
41 COMMANDS, regional offices, provincial offices, district offices, CITY
42 OFFICES, [and] city or municipal stations, AND POLICE
43 COMMUNITY PRECINTS.

45 At the national level, the PNP shall maintain its office in
46 Metropolitan Manila which shall house the directorial staff, [service
47 staff]NATIONAL ADMINISTRATIVE AND OPERATIONAL SUPPORT
48 UNITS, and special [support units]POLICE OFFICES.

50 IN CLUSTERED POLICE REGIONAL, PROVINCIAL, OR CITY


51 OFFICES OR IN CONTIGUOUS AREAS, THE PNP SHALL HAVE
52 AREA POLICE COMMANDS.

54 At the regional level, the PNP shall have POLICE regional
55 offices, including that of the National Capital Region POLICE OFFICE,
56 which may be divided into two (2) separate regions, without prejudice
57 to the pertinent provisions of the Organic Act for the Autonomous
58 Regions of the Cordilleras and Muslim Mindanao relative to the
59 creation of a [regional] [p]Police REGIONAL [force]OFFICE in the
60 area of autonomy. [Each of these regional offices]POLICE REGIONAL
61 OFFICES shall be headed by [a][r]Regional [d]DirectorS[for peace
62 and order].

64 AT THE METROPOLITAN LEVEL, THERE SHALL BE A
65 DISTRICT OFFICE, EACH HEADED BY A DISTRICT DIRECTOR.

67 At the provincial level, there shall be a [PNP]POLICE
68 PROVINCIAL office, each headed by a [p]Provincial [d]Director. In the
69 case of large provinces, police districts may be established by the
70 Commission to be headed by a PROVINCIAL[d]District [d]Director.

72 AT THE HIGHLY URBANIZED AND INDEPENDENT
73 COMPONENT CITY LEVEL, THERE SHALL BE A CITY POLICE
74 OFFICE, EACH HEADED BY A CITY DIRECTOR.

76 At the city or municipal level, there shall be a PNP station, each
77 headed by a chief of police.

79 UNDER EACH POLICE STATION, POLICE COMMUNITY
80 PRECINCTS SHALL BE ESTABLISHED IN EVERY BARANGAY OR
81 CLUSTERED BARANGAYS TO SERVE AS THE PRIMARY
82 PROVIDERS OF POLICE SERVICES IN THE COMMUNITY.

84 The Chief of the PNP shall, within sixty (60) days from the
85 effectivity of this Act and in accordance with the broad guidelines set
86 forth herein, recommend the organizational structure and staffing
87 pattern of the PNP to the Commission.

89 SECTION 2. A new Section 25-A is hereby inserted in Republic Act No. 6975,
90 to read as follows:

92 “SEC. 25-A. CREATION OF AREA POLICE COMMANDS. -
93 IN ORDER TO ENHANCE THE SPAN OF CONTROL OF THE
94 CHIEF, PNP, THERE SHALL BE ESTABLISHED AREA POLICE
95 COMMANDS IN CLUSTERED POLICE REGIONAL, PROVINCIAL,
96 OR CITY OFFICES OR IN CONTIGUOUS AREAS. THE AREA
97 POLICE COMMANDS SHALL ORCHESTRATE, SUPERVISE AND
98 CONTROL THE CONDUCT OF INTER-REGIONAL OPERATIONS
99 AGAINST CRIMINALITY, INSURGENCY, TERRORISM, AND

100 TRANSNATIONAL CRIMES WHICH TRANSCEND REGIONAL


101 BOUNDARIES. IT SHALL LIKEWISE CONDUCT RESCUE AND
102 RELIEF OPERATIONS IN TIMES OF CALAMITIES AND OTHER
103 EMERGENCY SITUATIONS WITHIN THEIR RESPECTIVE AREAS

187 COMMITTED ALONG NATIONAL HIGHWAYS AND AIRPORTS IN
188 THE COUNTRY; (III) DETERRING OFFENSIVE AND TERRORISTIC
189 ACTS THAT THREATEN CIVIL AVIATION; AND (IV) PREVENTING
190 AND CONTROLLING TRANSNATIONAL CRIMES AND OTHER
191 CRIMES THAT HAVE SIGNIFICANCE.

197 PROTECTION GROUP (PSPG), THE CIVIL SECURITY GROUP

1126 SECTION 10. Section 36 of Republic Act No. 6975 as amended by Section 36
1127 of Republic Act No. 8551 is further amended to read as follows:

1128 “SEC. 36. Status of Members of the Philippine National Police. – The
1129 uniformed members of the PNP INCLUDING POLICE CADETS shall
1130 be considered employees of the National Government and shall draw
1131 their salaries therefrom. They shall have the same salary grade level
1132 as that of public school teachers: Provided, That PNP members
1133 assigned in Metropolitan Manila, chartered cities and first class
1134 municipalities may be paid financial incentive by the local government
1135 unit concerned subject to the availability of funds.”

1136 SECTION 11. Section 13 of Republic Act No. 8551 is hereby amended to
1137 read as follows:

1138 “Section 13. Authority of the Commission to Reorganize the


1139 PNP. – Notwithstanding the provisions of Republic Act No. 6975 on the
1140 organizational structure and rank classification of the PNP, the
1141 Commission shall conduct a management audit, and prepare and
1142 submit to [Congress]THE PRESIDENT a proposed reorganization plan
1143 of the PNP [not later than December 31, 1998]WITHIN NINETY (90)
1144 DAYS FROM THE EFFECTIVITY OF THIS ACT, subject to the
1145 limitations provided under this Act and based on the following criteria:
1146 a) increased police visibility through dispersal of personnel from the
1147 headquarters to the field offices and by the appointment and
1148 assignment of non-uniformed personnel to positions which are purely
1149 administrative, technical, clerical or menial in nature and other
1150 positions which are not actually and directly related to police operation;
1151 and b) efficient and optimized delivery of police services to the
1152 communities.

1153 The PNP reorganization program shall be approved by [Congress


1154 through a joint resolution]THE PRESIDENT.”

1155 SECTION 12. The amount necessary to cover the initial implementation of
1156 this Act shall be charged against the current year’s appropriations of the Philippine
1157 National Police. Thereafter, the amount necessary for its continued implementation
1158 shall be included in the annual General Appropriations Act of the PNP.

1160 SECTION 10. Separability Clause. – If any provision of this Act or the
1161 application of such provision is declared unconstitutional or invalid, the provisions not
1162 affected thereby shall remain in full force and effect.

1164 SECTION 11. Repealing Clause. – All other provisions of Republic Act No.
1165 6975, as amended by Republic Act No. 8551, otherwise known as the ‘Philippine
1166 National Police Reform and Reorganization Act of 1998’, that have reference to the
1167 foregoing police offices and support units, the heads thereof and their corresponding
1168 ranks, and all other laws, executive orders, rules and regulations, inconsistent with
1169 the provisions of this Act shall be deemed modified or repealed accordingly.

1171 SECTION 12. Effectivity. – This Act shall take effect after fifteen (15) days
1172 from its publication in at least two (2) newspapers of national circulation.
