16 RESTRUCTURING AND STRENGTHENING THE PHILIPPINE NATIONAL POLICE,
17 AND CREATING ADDITIONAL POLICE OFFICES, AMENDING SECTIONS 25, 26,
18 29, 31, AND 35 OF REPUBLIC ACT NO. 6975, OR THE “DEPARTMENT OF THE
19 INTERIOR AND LOCAL GOVERNMENT ACT OF 1990",
20 APPROPRIATING FUNDS THEREFOR, AND FOR OTHER PURPOSES”

22 Be it enacted by the Senate and the House of Representatives of the
23 Philippines in Congress assembled:

25 SECTION 1. Section 25 of Republic Act No. 6975 is hereby amended to read
26 as follows:

28 “Section 25. Organization. – The PNP COMMAND GROUP
29 shall be COMPOSED OF THE (headed by a) Chief PNP(who shall be
30 assisted by two (2) deputy chiefs, one (1) for administration and one
31 (1) for operations), DEPUTY CHIEF PNP FOR ADMINISTRATION,
32 DEPUTY CHIEF PNP FOR OPERATIONS, AND CHIEF OF THE
33 DIRECTORIAL STAFF. (both of whom) PROVIDED, THAT THE
34 MEMBERS OF THE PNP COMMAND GROUP, EXCEPT FOR THE
35 CPNP, shall be appointed by the President upon recommendation of
36 the Commission from among the most senior and qualified officers in
37 the service.[Provided, however, That in no case shall any officer who
38 has retired or is retirable within six (6) months from his compulsory
39 retirement age be appointed as Chief of the PNP.]
40 The PNP shall be composed of a national office, AREA POLICE
41 COMMANDS, regional offices, provincial offices, district offices, CITY
42 OFFICES, [and] city or municipal stations, AND POLICE
43 COMMUNITY PRECINTS.

45 At the national level, the PNP shall maintain its office in
46 Metropolitan Manila which shall house the directorial staff, [service
47 staff]NATIONAL ADMINISTRATIVE AND OPERATIONAL SUPPORT
48 UNITS, and special [support units]POLICE OFFICES.

509 CHANGES IN THE NUMBER AND DISTRIBUTION OF RANKS, TO
510 INCLUDE UPGRADING THEREOF, SHALL BE RECOMMENDED BY
511 THE CHIEF OF THE PNP FOR APPROVAL OF THE NAPOLCOM,
512 EXCEPT FOR THE RANKS OF POLICE BRIGADIER GENERAL,
513 POLICE MAJOR GENERAL, AND POLICE LIEUTENANT
514 GENERAL, WHICH SHALL BE SUBJECT TO THE
515 RECOMMENDATION OF THE NAPOLCOM AND APPROVAL OF
516 THE PRESIDENT.”

518 SECTION 6. Section 28. of Republic Act No. 6975 as amended by Republic Act No.
519 11200 is further amended to read as follows:

564 rank of POLICE LIEUTENANT GENERAL [deputy director
565 general]shall be known as Chief of the Directorial Staff of the PNP
566 AND SHALL BE ASSISTED BY THE SECRETARY TO THE
567 DIRECTORIAL STAFF WHO SHALL HAVE THE RANK OF POLICE
568 BRIGADIER GENERAL.

570 THE HEADS OF AREA POLICE COMMANDS WITH THE
571 RANK OF POLICE LIEUTENANT GENERAL SHALL ASSUME THE
572 POSITION TITLE COMMANDER AND SHALL BE ASSISTED BY A
573 DEPUTY COMMANDER AND CHIEF OF STAFF WITH THE RANK
574 OF POLICE MAJOR GENERAL AND POLICE BRIGADIER
575 GENERAL, RESPECTIVELY.

577 The heads of the various [staff divisions in the] directorial staff
578 shall have the rank of POLICE MAJOR GENERAL [director] with the
579 position title of Director of [the] THEIR RESPECTIVE Directorial Staff.

700 THE NATIONAL ADMINISTRATIVE AND OPERATIONAL
701 SUPPORT UNITS SHALL INITIALLY CONSIST OF THE
702 FOLLOWING:

704 (a) NATIONAL Administrative Support Units. – [(1) Crime
705 Laboratory. There shall be established a central Crime Laboratory to
706 be headed by a Director with the rank of chief superintendent, which
707 shall provide scientific and technical investigative aid and support to
708 the PNP and other government investigative agencies.

710 It shall also provide crime laboratory examination, evaluation,
711 and identification of physical evidence involved in crimes with primary
712 emphasis on their medical, chemical, biological and physical nature.

714 There shall likewise be established regional and city crime
715 laboratories as may be necessary in all regions and cities of the
716 country.](1) PHILIPPINE NATIONAL POLICE ACADEMY. – HEADED
717 BY A DIRECTOR WITH THE RANK OF POLICE MAJOR GENERAL,
718 THE PHILIPPINE NATIONAL POLICE ACADEMY SHALL SERVE
719 AS THE PREMIER INSTITUTION FOR POLICE EDUCATION, AND
720 THE PRIMARY SOURCE FOR COMMISSIONSHIP OF POLICE
721 LIEUTENANTS. THE DIRECTOR SHALL BE ASSISTED BY A
722 DEPUTY DIRECTOR AND A CHIEF OF STAFF, BOTH WITH THE
723 RANK OF POLICE BRIGADIER GENERAL. THE DIRECTOR, PNPA
724 SHALL SUPERVISE THE ACADEMICS GROUP AND TACTICS
725 GROUP WHICH SHALL BOTH BE HEADED BY A DEAN ON
726 ACADEMICS AND COMMANDANT OF CADETS, RESPECTIVELY,
727 BOTH WITH A RANK OF POLICE BRIGADIER GENERAL.

729 [(2) Logistic Unit. – Headed by a Director with the rank of chief
730 superintendent, the Logistics Unit shall be responsible for the
731 procurement, distributions and management of all the logistical
732 requirements of the PNP including firearms and ammunition.](2)
733 NATIONAL POLICE TRAINING INSTITUTE. – HEADED BY A
734 DIRECTOR WITH THE RANK OF POLICE MAJOR GENERAL, THE
735 NATIONAL POLICE TRAINING INSTITUTE SHALL BE
736 RESPONSIBLE FOR THE MANDATORY AND LEADERSHIP
737 TRAININGS OF ALL POLICE NON-COMMISSIONED OFFICERS.
738 THE DIRECTOR SHALL BE ASSISTED BY A DEPUTY DIRECTOR
739 WITH A RANK OF POLICE BRIGADIER GENERAL.

741 [(3) Communications Unit. – Headed by a Director with the rank
742 of chief superintendent, the Communications Unit shall be responsible
743 for establishing an effective police communications network.]

992 [(6) Narcotics Unit. – Headed by a Director with the rank of chief
993 superintendent, the Narcotics Unit shall enforce all laws relative to the
994 protection of the citizenry against dangerous and other prohibited
995 drugs and substances.](6) POLICE SECURITY AND PROTECTION
996 GROUP. – HEADED BY A DIRECTOR WITH THE RANK OF POLICE
997 BRIGADIER GENERAL, THE POLICE SECURITY AND
998 PROTECTION GROUP SHALL PROVIDE SECURITY FOR
999 GOVERNMENT OFFICIALS, VISITING DIGNITARIES AND PRIVATE
1000 INDIVIDUALS AUTHORIZED TO BE GIVEN PROTECTION. THE
1001 DIRECTOR FOR POLICE SECURITY AND PROTECTION GROUP
1002 SHALL BE ASSISTED BY A DEPUTY DIRECTOR WITH THE RANK
1003 OF POLICE COLONEL.

1005 [(7) Aviation Security Unit. – Headed by a Director with the rank
1006 of chief superintendent, the Aviation Security Unit, in coordination with
1007 airport authorities, shall secure all the country's airports against
1008 offensive and terroristic acts that threaten civil aviation, exercise
1009 operational control and supervision over all agencies involved in airport
1010 security operation, and enforce all laws and regulations relative to air
1011 travel protection and safety.](7) PNP DRUG ENFORCEMENT
1012 GROUP. – HEADED BY A DIRECTOR WITH THE RANK OF POLICE
1013 BRIGADIER GENERAL, THE DRUG ENFORCEMENT GROUP
1014 SHALL ENFORCE ALL LAWS RELATIVE TO THE PROTECTION
1015 OF THE CITIZENRY AGAINST DANGEROUS AND OTHER
1016 PROHIBITED DRUGS AND SUBSTANCE. THE DIRECTOR FOR
1017 DRUG ENFORCEMENT GROUP SHALL BE ASSISTED BY A
1018 DEPUTY DIRECTOR WITH THE RANK OF POLICE COLONEL.

1020 [(8) Traffic Management Unit. – Headed by a Director with the
1021 rank of chief superintendent, the Traffic Management Unit shall enforce
1022 traffic laws and regulations.](8) AVIATION SECURITY GROUP. –
1023 HEADED BY A DIRECTOR WITH THE RANK OF POLICE
1024 BRIGADIER GENERAL, THE AVIATION SECURITY GROUP, IN
1025 COORDINATION WITH AIRPORT AUTHORITIES, SHALL SECURE
1026 ALL THE COUNTRY'S AIRPORTS AGAINST OFFENSIVE AND
1027 TERRORISTIC ACTS THAT THREATEN CIVIL AVIATION,
1028 EXERCISE OPERATIONAL CONTROL AND SUPERVISION OVER
1029 ALL AGENCIES INVOLVED IN AIRPORT SECURITY OPERATION,
1030 AND ENFORCE ALL LAWS AND REGULATIONS RELATIVE TO
1031 AIR TRAVEL PROTECTION AND SAFETY. THE DIRECTOR FOR
1032 AVIATION SECURITY GROUP SHALL BE ASSISTED BY A
1033 DEPUTY DIRECTOR WITH THE RANK OF POLICE COLONEL.

1035 [(9) Medical and Dental Centers. – Headed by a Director with
1036 the rank of chief superintendent, the Medical and Dental Centers shall
1037 be responsible for providing medical and dental services for the PNP.]
1038 (9) HIGHWAY PATROL GROUP. – HEADED BY A DIRECTOR WITH
1039 THE RANK OF POLICE BRIGADIER GENERAL, THE HIGHWAY
1040 PATROL GROUP SHALL ENFORCE TRAFFIC LAWS AND
1041 REGULATIONS. THE DIRECTOR FOR HIGHWAY PATROL GROUP

1126 SECTION 10. Section 36 of Republic Act No. 6975 as amended by Section 36
1127 of Republic Act No. 8551 is further amended to read as follows:
1128 “SEC. 36. Status of Members of the Philippine National Police. – The
1129 uniformed members of the PNP INCLUDING POLICE CADETS shall
1130 be considered employees of the National Government and shall draw
1131 their salaries therefrom. They shall have the same salary grade level
1132 as that of public school teachers: Provided, That PNP members
1133 assigned in Metropolitan Manila, chartered cities and first class
1134 municipalities may be paid financial incentive by the local government
1135 unit concerned subject to the availability of funds.”
1136 SECTION 11. Section 13 of Republic Act No. 8551 is hereby amended to
1137 read as follows:

1155 SECTION 12. The amount necessary to cover the initial implementation of
1156 this Act shall be charged against the current year’s appropriations of the Philippine
1157 National Police. Thereafter, the amount necessary for its continued implementation
1158 shall be included in the annual General Appropriations Act of the PNP.

1160 SECTION 10. Separability Clause. – If any provision of this Act or the
1161 application of such provision is declared unconstitutional or invalid, the provisions not
1162 affected thereby shall remain in full force and effect.

1164 SECTION 11. Repealing Clause. – All other provisions of Republic Act No.
1165 6975, as amended by Republic Act No. 8551, otherwise known as the ‘Philippine
1166 National Police Reform and Reorganization Act of 1998’, that have reference to the
1167 foregoing police offices and support units, the heads thereof and their corresponding
1168 ranks, and all other laws, executive orders, rules and regulations, inconsistent with
1169 the provisions of this Act shall be deemed modified or repealed accordingly.

1171 SECTION 12. Effectivity. – This Act shall take effect after fifteen (15) days
1172 from its publication in at least two (2) newspapers of national circulation.
