Simple Mortgage Deed

Without Possession

THIS DEED OF SIMPLE MORTGAGE IS EXECUTED ON THIS 01st


DAY OF SEPTEMBER, 2023 AT WARANGAL:

PATAN BADE SAB, S/o Patan Lathip Sab, age: 51 years,


occupation: Business, R/o H.No.4-39, Chennaram Village,
Wardhannapet Mandal, City and District Warangal. (Aadhar Card
No.9011 5176 3044).
(HEREIN AFTER CALLED THE "MORTGAGOR")
IN FAVOUR OF
MOHAMMAD ABID, S/o Mohammed Abdul Habeeb, age: 42 years,
Occupation: Private Employee, R/o H.No.11-23-2241/A, L.B. Nagar,
City and District Warangal. (Aadhar Card No.4458 4837 5926)
(HEREIN AFTER CALLED THE "MORTGAGEE")
The term and expression the mortgagor and mortgagee shall mean and Include
wherever they said context may so require all their legal heirs, executors,
administrators, agents, representatives, successors in-interest and assignees etc.
WHEREAS the mortgagor is the absolute owner in possession and
enjoyment of the open plot No.19, to an extent of 202.61 Sq. Yards or
169.40 Sq. Meters, in Survey No.463/A/4 of Bollikunta Village, Sangem
Mandal, Warangal District, better particulars are shown in the schedule
below and herein after be called the “SCHEDULE PROPERTY “.

WHEREAS the Mortgagor has purchased the schedule property from

Venaganti Yadagiri, S/o Late Venaganti Laxmaiah, R/o Warangal through

Registered Sale Deed vide Document No.17408/20 16, dated 24-12-2016

of Sub Registrar, Warangal (Fort).

WHEREAS the said mortgagor desires to borrow a sum of Rs:8,00,000.

(Rupees Eight Lakhs Only) from the mortgagee by mortgaging the

schedule property to the mortgagee and the mortgagee is willing to

advance the said sum to the mortgagor.

WHEREAS the mortgagee has agreed to pay the loan amount of Rs:8,00,000.

(Rupees Eight Lakhs Only) to the mortgagor and the mortgagor has offered

the scheduled mentioned property as security for the repayment of the said

loan amount of Rs:8,00,000• /-Rupees Eight Lakhs Only) thereon and the

mortgagee has agreed to accept the said property as security for the

repayment of the said loan amount of Rs:8,00,000/- (Rupees Eight Lakhs

Only) thereon on the following terms and conditions.

NOW THES DEED OF MORTGAGE WITNESSETH AS FOLLOWS:

1. The said mortgagor is the owner in possessor and enjoyment of the


open plot NO.19, to an extent of 202.61 Sq. Yards or 169.40 Sq.
meters, in Survey No.463/A/4 of Bollikunta Village, Sangem Mandal,
Warangal District and desires to mortgage the same to the mortgagee
for a sum of RS:8,00,000/- (Rupees Eight Lakhs Only) the mortgagee
making payment of amount through Cheque No.723623 of
Rs:8,00,000/- {Rupees Eight Lakhs Only), dated 01-09-2023, of
CANARA BANK, Warangal Main Branch , Warangal, and the
mortgagee is willing to advance the said sum to the mortgagor.

2. That in consideration of a sum of Rs:8,00,000/- (Rupees Eight Lakhs


Only} advanced by the said mortgagee by way of loan to the said
mortgagor and the mortgagor acknowledge the receipt of the amount
herein and execute this document and the mortgagor, mortgage by way
of mortgage the schedule property.

3. The mortgagor promised to the mortgagee that the above said loan
amount Rs.8,00,000/- (Rupees Eight Lakhs Only) shall be returned to
the mortgagee within TWELVE {12) MONTHS, without fail, in case of
any need of mortgagee the mortgagor will pay of Rs.5,00,000/- (Rupees
Five Lakhs Only) after the execution of this mortgage deed, and the
mortgagor will pay the dividend accordingly after the deduction from the
principle Amount (Rs:8,00,000). The mortgagor or Mortgagee will extent the
stipulated time for returning of the loan amount can renew fresh deed.

4. In case not willing to extent or renew these deed, either parties should
inform 30 days prior to the termination of these deed.

5. If in any case the mortgagor failed to repay the loan amount to the
mortgagee within the period, then he shall file civil and criminal cases
according to law along with interest and damages and mortgagor is liable
to be vacated from schedule property and deliver possession to
the mortgagee.

6. The mortgagor will make dividend payment of Rs: 15,500/- P.M (Rupees
Fifteen Thousand Five Hundred Only) per month to the mortgagee
towards the dividend payment of every succeeding month, before 03rd of
every month without fail.

7. The mortgagor is handing over the original registered Sale Deed vide
Document No.17408/2016, dated 24-12-2016 of Sub Registrar, Warangal
(Fort) and post phoned dated cheque No.476628 of Rs.8,00,000/- (Rupees
Eight Lakhs Only), State Bank of India, Rangashaipet Branch, Khammam
Road, to the mortgagee as security toward of the loan amount.

SCHEDULE OF PROPERTY

Open plot No.19, to an extent of 202.61 Sq. Yards or 169.40 Sq. meters, in
Survey No.463/A/4 of Bollikunta Village, Sangem Mandal Warangal District
within the jurisdiction of Greater Warangal Municipal Corporation, Warangal
and Sub- Registrar, Warangal (Fort) surrounded by the following boundaries:

EAST : 20 FEET WIDE ROAD.


WEST : AGRICULTURE LAND OF S. SAMMAIAH &
AGRICULTURE LAND OF DONTHI VEMA REDDY.

NORTH : AGRICULTURE LAND OF BOJJAKUMARASWAMY

SOUTH : OPEN PLOT NO.18.

IN WITNESS THEREOF THE SAID MORTGAGOR AND MORTGAGEE


HAVE SIGNED THIS DEED IN TOKEN OF THE ACCEPTANCE OF THE
TERMS AND CONDITIONS MENTIONED ABOVE WITH PLEASURE AND
CONSENT ON THE ABOVE DATE AND PLACE IN THE PRESENCE OF THE
WITNESSE S AT WARANGAL.
