THIS CONVEYANCE DEED is made and executed at S.R.O,

BETWEEN
Allahabad Bank, a Government of India Undertaking is a
statutory body of corporate constituted under the Banking
Companies (Acquisition and Transfer of Undertakings) Act,
1970, having it’s Registered and Head Office at 2, Netaji
Subash Road, Kolkata-1,West Bengal, and having one of its
Zonal Office at 3/1B, IRC Village, Nayapalli, Bhubaneswar
and Inter alia carrying on business by its branch office
amongst other places namely KIIT Branch, Koel Campus,
PS-Chandrasekharpur, Bhubaneswar-751024, Dist- Khurda,
Odisha, represented through its Chief Manager Mr. Sukanta
Kumar Sahu, aged about 49 years, S/o-Late Basanta Kumar
Sahu, herein after referred to as “ The Bank” (which
expression shall unless repugnant to the context of meaning
thereof shall mean and include its successors, assigns and
representatives) of the First Part.

Upendra Kumar Behera, aged about 42 years, S/o- Surendra Behera, by
caste-Niari, by profession: service, resident of Vill-Gandhina, PO/ G.P-
Bahanaga, P.S.-Khantapada, Dist-Balasore, PIN-756042,Odisha,
hereinafter referred to as “ Purchaser” (which expression shall unless
repugnant to the context of meaning thereof shall mean and include its
successors, assigns and representatives) of the Second Part.

NATURE OF DEED: Sale/ Conveyance Deed

Valuation Amount : Rs 28,62,340/-

Consideration Amount: Rs 17,67,000/-

WHEREAS , the bank has financed a housing loan to Mr.


Saktiprasad Sahoo, S/o- Alekha Sahoo resident of Plot No. 1857 (P),
Flat No.202, Saiomm Apartment, Samantarapur, Bhubaneswar-2, Dist-
Khurda, Odisha, hereinafter referred to as the “ Borrower” the said
facilities were secure inter-alia by way of mortgage of Immovable
property described in the schedule below under Mouza-Kantilo, Tahasil-
Jatni.

And whereas Mr. Saktiprasad Sahoo, S/o- Alekha Sahoo had


mortgaged the schedule of property to the Bank by way of equitable
mortgage by deposit of original title deeds bearing Registered Sale Deed
Document No.11121503509 dated 15.09.2015 purchased from Sri
Gourahari Ranasingh, S/o-Sri Basudev Ranasingh and Smt. Smitanjali
Mohapatra, W/o-Sri Soumendra Mohapatra as security for dues
repayment of loan availed by Mr. Saktiprasad Sahoo, S/o- Alekha
Sahoo mortgagor, have thus created the security interest in favour of

the Bank in the said immovable property, hereinafter called as “ Secured
Asset” as defined under Securitization and Reconstructions of Financial
Assets and Enforcement of Security Interest Act, 2002 hereinafter
referred to SARFAESI Act.2002.

AND WHEREAS , the above said borrower committed default in


repayment of the loan granted in the above credit facilities and as such
the account of borrower was classified as NPA. Consequent upon
default in repayment of loan, the Bank as “Secured Creditor” initiated
recovery proceedings i.e. enforcement of “ Security Interest” by invoking
the provisions of “ SARFAESI Act.2002” But the borrower having failed
to repay the notice/ demand amount with interest within stipulated
period the Bank as “Secured Creditor” through its Authorized Officer
took measure U/s 13 (4) of the said Act. and had taken over actual and
physical possession of all the “Secured Assets” and eventually as per
the procedures contemplated under SARFAESI Act, 2002 read with
Security Interest (Enforcement) Rules 2002, the said mortgaged property
were put to public auction sale after giving due proclamation in daily
News Paper “OrissaPOST” on 16.01.2019 and Prameya on 16.01.2019
“As is where as Basis”. The purchaser was the successful bidder in the
said auction sale in respect of schedule below mentioned properties and
said bid was accepted by the “Secured Creditor” i.e. Bank. The
purchaser’s offer/ bid of Rs.17,67,000/- (Rupees Seventeen Lakhs Sixty
Seven Thousand) only being the highest bid was accepted by the
Authorized Officer vide letter Ref:ZO/BBSR/LAW/ Recovery/590 dated
30.01.2019, after obtaining confirmation from the “ Secured Creditor” as
provide under SARFAESI Act.2002.

In consideration of the said deed the purchaser has paid the entire
amount/ sale price of Rs.17,67,000/- (Rupees Seventeen Lakhs Sixty
Seven Thousand) only on the following manner.

Upon receipt of the entre offer amount for the schedule property, the
Bank as Secured Creditor confirmed sale and issued Sale Certificate on
01.01.2020 vide letter BR/KIIT/SALE/258 dated 01.01.2020 in favour of
the purchaser. Simultaneously the possession of the Security Assets
more fully described hereunder was also handed over to the Purchaser
on 01.01.2020 on the basis of said Sale Certificate was issued as per
Security Interest (Enforcement) Rules, 2002. The original title deeds
pertaining to the schedule property which was in the custody of the Bank

have also been handed over to the Purchaser and the Purchaser admits
and acknowledges the receipt thereof.

AND WHEREAS, the Purchaser has now requested to the Bank herein
to execute deed of Conveyance in his favour in respect of said schedule
property morefully described in the schedule hereunder in accordance
with the Sale Certificate issued on 01.01.2020 and the Authorized
Officer of the Bank has agreed to do in the manner hereinafter
appearing.

NOW THIS INDENTURE WITNESSETH AND IT HAS BEEN AGREED


AND IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES AS
FOLLOWS:-

1. That, in pursuance of the above and in consideration of a sum of


Rs.17,67,000/- (Rupees Seventeen Lakhs Sixty Seven Thousand)
only paid to the Bank and on receipt where of, the Bank through the
said Authorized Officer, in exercise of power conferred upon it under
the SARFAESI Act,2002 doth hereby grant, assign, convey, transfer
on to the Purchaser the said immovable property free from all
encumbrances situated at Mouza-Kantilo under Tahasil-Jatni of
District-Khurda which is more fully described in the schedule
hereunder written, now at or any time hereto AND ALL THE
ESTATE, right, interest, possession, benefit, claim and demand
whatsoever , both at law and equity of the said mortgagor and of the
Bank to and intend that the Purchaser will be entitled to said
schedule property as owner and subject to the payment of all rents,
taxes which may be chargeable at present or hereafter be assessed

and chargeable upon the same or become payable in respect of
hereto State of Odisha or any other local bodies. Now onwards the
Purchaser will be the absolute owner of the property.

Further the purchaser agrees and admits that the time of bidding
for the schedule property, when the Authorized Officer of the Bank
had conducted auction, the Bank had disclosed all known
encumbrances on the said Secured Assets pursuant to the Rules
2002 that the property (Secured Assets) is free from all
encumbrances and the Purchaser after enquiring about the property
free from all encumbrances purchased the same.

CERTIFICATE

The above named executants / Vendor is my client and this Sale


Certificate/ Conveyance Deed has been drafted by me in my office as
per the instruction and direction of the Executants and its contents are
read over and explained to both the parties in Odiya and Hindi and they
understand it and they have signed this deed in my presence after
satisfied about its contents fully well to their best of knowledge on the
above mentioned date.
