This agreement to sell is executed between (1) Mr AA Siddiqui (Adhar No.6607


7470 4733) S/o Late Mohd Nasir Ali (2) Mrs Nuzhat Siddiqui (Adhar No.2042
3215 4473) W/o Mr AA Siddiqui both presently R/o 20/43, Lodhi Colony New
Delhi–110003 and permanent R/o 162/140 Shahganj, Allahabad(UP)–211003
(hereinafter called the sellers which expression shall mean and include his/her
heirs successors, administrators and assigns) AND Mr Akhilesh Saran Srivastav
(Adhar No. ) S/o Late Shri Ishwar Saran Srivastava R/o B1-1101, Akash
Enclave, Sector 6A, Vrindavan Yojna, Lucknow (UP)- 226029 (hereinafter called
the purchaser which expression shall mean and include his/her heirs successors,
administrators and assigns).
Whereas the Seller has purchased the House No.B-118 measuring land area of
187.95 Sq. Mtr. Situated at – Southcity, Ratnakar Khand, Kanpur Road, Sharda
Nagar Scheme, Lucknow.
And whereas the Seller wanted to sell the said House and the purchaser being
interested in purchasing the same has offered a sum of Rs.70,00000(Rupees
Seventy Lacs only) which the seller has accepted.
NOW THIS AGREEMENT TO SELL WITNESSETH AS UNDER :
1. That the Seller shall sell the house No. B-118 measuring land area of
187.95 Sq. Mtr. situated at – Southcity, Ratnakar Khand, Kanpur Road,
Sharda Nagar Scheme, Lucknow(UP) in favour of the purchaser for a total
of sale consideration of Rs.70,00,000/- (Rupees seventy lacs only) out of
which the purchaser has paid Rs. /- (Rupees only)
by Cheque/DD No. dated 02/2022 State Bank of India DBB
Cantt. Sadar Branch Lucknow sum of Rs. (Rupees only)
as advance the receipt whereof the seller here by acknowledge.
2. That the seller assures that the house agreed to be transferred under this
agreement is free from all sorts of transfers and encumbrances and the
Seller has every right and title to transfer the same in favour of the
purchaser.
3. That all the taxes and any other dues of whatsoever nature payable on the
aforesaid House till the date of execution of the sale deed shall be borne
and paid by the Seller and thereafter by the purchaser.
4. That all the expenses for the execution and registration of this agreement
to sell and sale deed such as stamp duty registration charges and misc.
expenses etc. shall be borne by the purchaser.
5. That the purchaser shall get the sale deed executed in his favour on or
before 3 months from the date of this Agreement after paying the balance
sale consideration to the Seller.
6. That in case of default on the part of the purchaser in getting the sale deed
executed in the favour within the time stipulated above the seller is entitled
to forfeit the earnest money and cancel the agreement forthwith. In case of
default on the part of the Seller the purchaser shall have the right to get the
sale deed executed in his favour through court of Law by seeking specific
performance of this Agreement.
7. That the actual vacant physical possession of the House has not been
delivered to the purchaser by the Seller under this agreement and the same
shall be delivered at the time of execution of the sale deed. Hence the stamp
duty of Rs. 100/- (Rupees one hundred only) has been paid.
8. That the buyer will submit the request for the housing loan over the
property under consideration and in case of loan application will reject due
to not eligibility of buyer and buyer is not able to complete the transaction
due to this, the Seller shall have the right to forfeit the earnest money
deposited to him and the buyer shall have no objection over it.
9. That in case loan proposal is rejected by the bank due to adverse report on
non - encumbrance certificate or due to insufficient valuation, the buyer
shall be entitled to recover the earnest money deposited by him and the
Seller shall have no objection to it and fully support to refund the amount
within one month of receiving such communication from the buyer.
10. That the first party hereby assured the second party that the said house
hereby agreed to be sold is free from all encumbrances, liens, and charges
etc. and the same is not subject to matter of any litigation or decree and the
first party have subsisting title to sell the same.
