Hereinafter referred to as the ‘PURCHASERS’ (which expression shall


unless it be repugnant to the context or meaning thereof, mean and
include their legal heirs, successors, executors, administrators and
assigns etc.) of the SECOND PART.

WHEREAS Survey No. 33/3+4, having N.A. Plots No. 1 to 5, 7 to 16 &


Survey No. 33/3+4/2 having N.A. Plots No. 66 to 68 total
admeasuring area 7711.00 sq. mtrs. of village Dasak and more
particularly described in the SCHEDULE 'A' hereunder written
referred to as “Said Property” was owned and possessed by “HARI
VIHAR ABCD Apartment” in Form “A”.

AND WHEREAS Builders/Promoters/Developers had prepared and


approved a building plan Nashik Municipal Corporation, Nashik vide
their letter No. LND/BP/197/2007, Dt.24/01/2007, thereafter the
Builder/Promoters/Developers has revised the said building plan &
the same building plan was sanctioned by the Executive Engineer of
Town Planning Department, Office of the Nashik Municipal
Corporation, Nashik wide commencement Certificate No.
LND/BP/NKRD/C-4/098/2008, Dt.27/08/2008. And as per sectioned
building plan, completed the construction of building project namely
“HARI VIHAR ABCD Apartment” and obtained Completion Certificate
vide letter No. Jawak No./ “Nagar Rachna”/03199, Dated: - 12/11/2009,
from Nashik Municipal Corporation, Nashik.

AND WHEREAS firstly Builder/Promoters/Developers entered into an


Agreement for Sale for the said Flat No. A-704 in the project known
as “HARI VIHAR ABCD Apartment” (Hereinafter referred to as “Said
Premises” for the sake of brevity) to the “Vendors” and which is duly
executed, authenticated & Registered at the office of the Joint Sub-
Registrar, Class II, Nashik 2, at the Serial No. 00955/2008, Dated
25/01/2008. Thereafter Registered DEED OF APARTMENT (SALE
DEED) at the office of the Joint Sub-Registrar, Class II, Nashik 6, at the
Serial No. 9424/2013, Dated 27/09/2013.

And whereas the said premises is situated in “HARI VIHAR ABCD


Apartment” & the respective premises as well as, open spaces, and
the project has been declared under the provisions of Maharashtra
Apartment Ownership Act & no that effect a Deed of Declaration is
executed and registered at the office of the joint Sub-Registrar, Class-
II, Nashik 2 at serial No. vide document No. 04994/2010, Dated
10/05/2010.

The Purchasers agreed and accepted all the terms and conditions of
Apartment Declaration; accordingly, their name have been mutated

in the records of Apartment as well as Municipal Records. Also, the


taxes, viz. Electricity Bill & House Tax of Nashik Municipal
Corporation, Nashik are assessed in their separate name. So, having
rights to use, occupy, possess and alienate the said premises in any
manner as per their wish & whims.

1) That the Purchaser has paid to vendors a sum of Rs. 35,00,000/- (Rs.
Thirty Five Lakhs Only) being the full & final payment of the said flat from time to
time by way of cheques / transfer/ RTGS or NEFT to the vendors against the said
flat. Payment schedule as follows:-

amount from LIC Housing. out of which the

has been paid towards Vendor home loan,
Loan account No. ____________, for
repayment of the entire loan of Vendor from
the previous State Bank of India, as a part of
internal adjustment for closure of Vendor Home
Loan. Henceforth, the said loan account of
Vendors has been closed & closed in all
respect.

2) That the vendors has handed over the actual possession of the said
residential Flat / apartment / Tenement to the purchaser’s after having
measured the said flat as per the sale deed and that the purchasers after having
measured the flat as per the sale deed and that the purchaser’s have got
themselves satisfied with respect to the construction quality of the work
together with all the amenities schedule mentioned in the Broucher given to
the purchaser at the time of Booking of the said flat & actual measurement and
got themselves satisfied & then took the possession of the said flat before
execution of this Sale Deed / Conveyance Deed.

3) That the Purchaser hereby undertakes, agrees, promises, to perform


observe, regulations, bye-laws, resolutions that where existing in force or that
may be made, formed, resolved, hereinafter by the association of apartment
owners and as per the declaration of association.

4) That the Purchasers or any person claiming through him or under him
or ordered him or deriving any right in the said apartment (Flat) to pay toward
common M.S.E.D.C.L. Bill, Water Charges Bill, Cleaning, Watchman & yearly
N.A. Tax in addition to this he is liable to contribute towards majors repairs &
maintenance in the said apartment. As and when necessary and called for by
the Association of Apartment owner’s body.

5) That the purchasers have borne all the expenses with respect
to stamp duty, Registration Fee, Documents Charges, Legal Fees, etc.
apart from the above consideration of the said flat.

6) That this deed of apartment is being executed pursuant to and


for the purpose of Maharashtra Apartment Ownership Act-1970.

7) That the terrace adjoining to the particular flat owners shall be


used and utilized by the respective flat purchasers only.

Sq.Ft. i.e. 103.864 Sq. Mtrs. built up in the “A” Building which is
