LEASE DEED

THIS LEASE DEED IS MADE AND EXECUTED ON THIS 28th DAY


OF MARCH, 2022 (28/03/2022) AT BANGALORE, BY AND BETWEEN:

(1) Mrs. REHANA KHAN, W/o.K.G.Ayub Khan, aged about
46years (2) K.G.AYUB KHAN, S/o.Gaiban Kha, aged about
57 years, both are residing at No.157-B, Third Floor, 37 th Cross,
2nd Block, Rajajinagar, Bangalore-10., Hereinafter called the
LESSORS of the First Part. AND

Mrs. LAILA.M, W/o.Mohammed Ismail, aged about 64years,


residing at No.157-B, Ground Floor, 37 th Cross, 2nd Block,
Rajajinagar, Bangalore-10., Hereinafter called the LESSEE of the
Second Part

(The term both the LESSORS and the LESSEE shall mean and
includes their respective heirs' executors administrators, legal
representatives and assigns, etc.,)

LEASE OF PREMISES:
The LESSORS are the Absolute Owners of the Residential
house building bearing No.157-B, situated at 37 th Cross, 2nd Block,
Rajajinagar, Bangalore-10., out of which the LESSORS needs funds
for their family beneficial purposes is Leasing out Ground Floor
portion house which is more fully described in the schedule
hereunder and hereinafter referred to as the “SCHEDULE OF THE
HOUSE PREMISES” for the Residential purposes.

Whereas, The LESSORS had handed over the Schedule House


Premises on dated:1-03-2022, without the execution of LEASE
DEED to the LESSEE., whereas today, the LESSEE has bought this
stamp paper for the execution of the LEASE DEED. Thus, the
LESSORS hereby executing this LEASE DEED in favor of the LESSEE
with the terms and conditions witnessed as follows:-

COMMENCEMENT AND PERIOD:

The duration of the LEASE is Two (02) YEAR from


commencing from 01/03/2022 to 01/03/2024.

USE OF PREMISES
The LESSEE shall use the Schedule House premises only for
his RESIDENTIAL PURPOSES only and shall not carry any other
business or trade which are prohibited under law.

LEASE AMOUNT :
The Lease amount for the House premises is fixed at
Rs.15,00,000/-(Rupees Fifteen Lakhs Only) out of which:

a) Whereas the LESSEE had paid a sum of Rs.13,30,000/-


only (Thirteen Lakh Thirty Thousand only) to the
previous owner/ LESSOR (Mrs.NUZHATH SHEREEN) as
mentioned in the RENEWAL LEASE DEED dated:01/01/2020.
Later, Mrs.NUZHATH SHEREEN had conveyed/
sold Residential entire building bearing No.157-B, situated
at 37th Cross, 2nd Block, Rajajinagar, Bangalore-10., on

“as is where is” basis and also attorn the LEASE AMOUNT as
mentioned in the RENEWAL LEASE DEED dated:01/01/2020 in
favour of the Mrs. REHANA KHAN and AYUB KHAN (the
LESSORS herein).
Thus the LESSORS through this LEASE DEED, hereby
agreed and acknowledges the receipt and adjusted the Lease
amount Rs.13,30,000/- only payable by the LESSEE to this
LEASE DEED

b) The LESSEE paid the remaining amount of Rs.1,70,000/-


(Rupees One Lakh Seventy Thousand Only) by way of
Cheque bearing No.000001, date:26/03/2022, drawn on
BANK OF BARODA, Dr.Rajkumar Road, Rajajinagar Branch,
Bangalore in favour of Mrs. REHANA KHAN (the LESSOR No.1)

c) The LESSORS through this LEASE DEED acknowledges the


receipt of LEASE AMOUNT Rs.15,00,000/- only received
before the under-mentioned witnesses and delivered the
vacant possession of the Schedule House premises to the
LESSEE and the LESSORS also undertake the liability to
repay/refund the LEASE AMOUNT Rs.15,00,000/- only
(Rupees Fifteen Lakhs Only) to the LESSEE on vacating the
House premises without any delay after deducting any arrears
of electricity, water charges, and damages if any.

d) The LESSORS are need not to pay any type of interest for the
Lease amount to the LESSEE. As well the LESSEE is need not
to pay any type of rent for the Schedule House premises to
the LESSORS.

INSPECTION/ ENTRY:

The LESSOR or his agents shall be entitled to enter upon the


Schedule premises to inspect the same to satisfy themselves that
the premises being used in accordance with the terms of the
agreement.

TAX & CESSES:

The LESSOR shall bear and pay the Property taxes, rates, and
cesses payable to the BBMP or to any authority regarding Schedule
house premises.

ELECTRICITY CHARGES & WATER CHARGES:

The LESSEE shall pay the separate Electric charges to the


concerned Authorities without fail.
For the Tap water charges and for the Over Head Tank facilities
(motor pumping fixed to the separate Tap water meter) the LESSEE
shall share the charges with other co-tenants without fail.

COVENANTS OF THE PARTIES:


1) The LESSEE shall not sublet or under-let the premises or shall
not make any damages or alteration and shall keep the House

2) premises in good and tenantable condition with usual wear and


tear. If the LESSEE commits any type of damages to the house
premises or to the fixtures and fittings, he shall make them good
at her own cost and risk.

3) The LESSEE need to Whitewash and Colour wash the Schedule


House Premises and at the time to vacate the Schedule house
Premises.

4) The LESSORS shall provide one Two Wheeler parking to the


LESSEE.

5) The maintenance charges i.e., water sump cleaning, cellar


cleaning, staircase cleaning, Terrace cleaning, motor repair if
any, etc., repairs the LESSEE agreed to pay Rs.500/- per month
for maintenance purposes proportionately to the LESSOR without
fail.

6) The LESSORS had handed over the LEASE house Premises with
the good and tidy condition to the LESSEE and at the time of
vacating the Schedule premises the LESSEE shall vacate and
hand over the same in vacant and good conditions to the
LESSORS only.

7) The LESSOR and the LESSEE shall intimate each other well in
before three (3) months to terminate this LEASE deed or to
evict/vacate the Schedule house premises.

8) In case, any problems were to arise to the Leased premises, in


such case the LESSORS have to set right the same on their
personal accord.

9) If the LESSORS fails to pay the Lease amount after the


completion of 02 (two) years then, the LESSEE has the right to
continue his occupation in the Schedule house premises until the
repayment of the LEASE amount by the LESSOR.

All that piece and parcel of Residential house premises No.157-


B, situated at 37th Cross, 2nd Block, Rajajinagar, Bangalore-10., out
of which GROUND FLOOR PORTION HOUSE consisting of Two Room,
One Hall, One store room, One Kitchen, One Dining Hall, Bathroom,
lavatory, Separate Electric meter and common Tap water facilities
and with common Over Head Tank water facilities with RCC Roofing
facilities.

IN WITNESSES WHEREOF BOTH THE LESSOR AND THE LESSEE


HAVE PUT THEIR SIGNATURES TO THIS LEASE DEED, BEFORE THE
