LEASE AGREEMENT

THIS AGREEMENT OF LEASE IS MADE AND EXECUTED ON THE 3 TH DAY OF


JANUARY, 2024 AT BANGALORE BY AND BETWEEN:

MR SHAFI YASEEN MOHAMMED, Son of Mr.Yaseen Mohammed Hameed, aged about


47 years, PAN: A B B P Y 8 2 6 1 D , residing at P054 P Block, DLF New Town
Heights, near CSEZ, Seaport Airport Road, Kakkanad,Ernakulam, Kerala 682030.
(Hereinafter referred to as LESSOR which expression shall mean and include their
heirs, successors, assignees, nominees, agents etc.,)

AND

1. Ms. SHARON WILSON, Daughter of Mr. Wilson Francis, aged about 35 years,
PAN: ABUPW6163D

2. Ms. ALISHA GRACE, Daughter of Mr. Wilson Francis, aged about 32 years, PAN
No: AWPPA4184J

both residing at, Door No 26,3rd Floor,2nd cross, Byrathi Ramanna Layout ,Kothanur
Village, Bangalore-560077. (Hereinafter referred to as LESSEES which expression shall
mean and include his heirs, successors, assignees, nominees, agents etc.,)

Whereas the LESSOR herein is the absolute Owner of the schedule below mentioned
property. Whereas the LESSEE here in has approached the LESSOR and offered to take
the Flat on Rent of the schedule Premises, i.e. Flat No. G2, measuring 1045 sq.ft., on
the Ground Floor along with a covered car park in basement 2, JS Estate
Apartment, 6th Main, Hoysala Nagar, T.C Palya main road, Ramamurthy Nagar
Bangalore -560016 and the LESSOR accepted the said offer and agreed to Lease the
same to the LESSEE and in pursuance thereof the parties herein entered into this
agreement as hereunder.
AND WHEREAS at the request of the Lessee, the Lessor has agreed to let the said
premises to the tenant for a term of 36 months (03years) commencing from
03.01.2024 to 03.01.2027 in the manner hereinafter appearing.

NOW THIS DEED WITNESSETH AS FOLLOWS:

1. SECURITY DEPOSIT:

The LESSEE has agreed to pay an interest free security deposit a sum of
Rs.11,000,00/- (Rupees Eleven Lakh Rupees only) as refundable security
deposit, in the following manner: -

a) Rs.1,00,000/-(Rupees One lakh only) vide online transfer bearing


reference No: 332418339737 , Dated 20.11.2023.

b) Rs.10,00,000/- (Rupees Ten Lakh Only) vide cheque dated 03.01.2024, drawn
on HDFC Bank, J.P Nagar, 2nd Phase Branch, Bangalore.

The security deposit is deposited to account of Mr Shafi Yaseen Mohammed,


bearing account No.:5167332554, Citi Bank, IFSC code CITI0000006, Begumpet
branch , Hyderabad 500016.

The above said interest free security deposit shall be refunded at the time of
termination of the agreement and delivery of the scheduled premise in vacant
possession by the LESSEE to LESSORS after deduction of any damages if any.

2. TERMINATION AND RENEWAL OF LEASE:

The Lease is terminated after the completion of the mandatory 3-year period;
however, it is extendable at the mutual agreement of both LESSOR and LESSEES.
LESSEE shall have the option to terminate this lease, by giving written notice of that
intention and identifying the early termination date to LESSOR at least 90 (3
Months) days prior.
Lease Deed Renewal: The Renewal of Lease Deed will be on mutual understanding
and acceptance after expiry of the 3-year period.

3. CHARGES OF ELECTRICITY& MAINTENANCE:

The LESSEE shall pay the actual electricity bearing RR No. 7EEH16286 and
Maintenance a sum of Rs. 2,500 (Rupees Two Thousand Five Hundred only) charges
directly to the concerned department BESCOM and to the maintenance association
of JS Estate Apartment regularly every month on or before due date and mail the
payment receipt to the mail ID of LESSOR.
4. BAR ON SUB LETTING:
The LESSEE shall not sublet, Re-let or part with the possession of the schedule
premises or any part or any portion thereof to/or in favour of any other person/s on
any terms or conditions.

5. ADDITIONS AND ALTERATIONS:


The LESSEE shall keep the schedule premises in good and Tenantable condition and
shall not carry out or make any alterations, modifications, or repair in respect of the
schedule premises without prior approval or consent of the LESSORS. The LESSEE
shall not put-up or install any permanent structure in the schedule premises.

6. USE OF PREMISES:
The LESSEE shall use and enjoy the premises for residence only with utmost care
and caution without breaking or damaging any of the amenities, furnishings,
accessories etc. And the LESSORS shall be entitled to deduct such amounts, to make
good the loss from and out of the advance deposit with the LESSORS and or shall or
also be entitled to recover the same from the LESSEE in this behalf.

7. REPAIR AND MAINTAINENCE:


The LESSEE shall keep the schedule premises in good condition subject to normal
wear and tear and shall not cause or suffer any damages to the fixtures and fittings
in the premises, which shall be used by the LESSEE during the in-Lease period. In
case of any such damages occurred the same shall be reimbursed by the LESSEE or
the same they shall be deducted by the LESSORS out of the security deposit paid by
the LESSEE.

8. DELIVERY OF POSSESSION:
The LESSEE shall handover the possession of the schedule premises at the
termination of the lease in the same condition as given to the LESSEE, the LESSOR
shall deduct 2% or equivalent amount of Deposit amount towards painting and
repair charges for who receipt shall be furnished to the LESSEE, subject to the
change caused by natural wear and tear. The LESEE shall not remove any of the
fittings or fixtures or replace their positions. The LESSEES shall have the flat painted
and clean condition before handed over back to the LESSOR as it is at the time of
start of Lease period.

9. PROPERTY TAX:
That the Lessor shall be responsible for the payment of all taxes and levies
pertaining to the said premises including but not limited to House Tax, Property Tax
other cesses, if any, and any other statutory taxes, levied by the Government or
Governmental Departments. During the term of this Agreement, the Lessor shall
comply with all rules, regulations and requirements of any statutory authority, local,
state and central government and governmental departments in relation to the said
premises.

10. INSPECTION:
In case of any inspection the LESSORS will have access to the premises only through
prior appointment from the LESSEE by giving a 24 hour's notice and consent of the
LESSEE.

11. REGISTRATION:
The Lease Deed shall be executed and registered before the respective Sub-Registrar
office. The expenses and costs including the stamp duty shall be borne by the lessee.
The lessor and lessee have agreed that original lease deed will remain with the
lessee and a true certified copy will be with lessor.

12. OWNER COVENANT:


The Lesser hereby covenants that the Lessee observing /performing the terms and
conditions hereof shall be entitled to quiet possession and peaceful enjoyment of the
premises without any interruption and disturbance by the Lesser or any person
under them. In the event any other person claims the property the Lesser
undertakes to refund the deposit and bear the financial losses if the Lessee is forced
to vacate the premises during the period of the Rent.

13. DISPUTE:
That any dispute arising between the lessor and lessee with regards to the terms
and conditions hereof or their interpretation shall have the jurisdiction of the courts
of Bangalore Only, if the same remain unresolved in the Arbitration proceedings to
be conducted in accordance with the provisions of Arbitration proceedings to be
conducted in accordance with the provisions of Arbitration and Conciliation Act,
1996 and any amendments made thereto.

14. FIXTURES/ FITTING


The LESSEE at the time of vacation of the premises shall handover all Fixtures/
fitting / Electrical Fittings i.e. fans, lights, Chimney and Geysers in working condition
and if any repair/ replacements are to be borne by the LESSEE only. The LESSORS
have handed over to the LESSEE the following Articles/Items in the Scheduled
Property.
FIXTURES AND FITTINGS:

1. GEYSERS : 2 Nos.

2. FANS : 4 Nos.

3. TUBE LIGHTS : 5 Nos.

4. CURTAIN RODS : SINGLE ROD – 3 No.

5. Light Fittings with Bulb : 5 Nos

SCHEDULE

Flat No. G2, measuring 1045 sq.ft., on the Ground Floor along with a covered car park in
Basement in the JS Estate Apartment, situated at No 20, 21 6 th main Hoysalanagar ,TC
Palya Main Road Ramamurthy Nagar, Bangalore 560016 consisting of 2 Bedrooms, 2
Bathrooms, Hall, Kitchen, one balcony, one Car Parking slot in the basement.
