RENTAL AGREEMENT

This RENTAL AGREEMENT is made and executed on this 23 rd day of


February 2019 (23.02.2019) at Bangalore.

HEREINAFTER CALLED the “OWNER/LESSOR” which term shall mean
and include all his heirs, legal representatives administrators, executors
and assigns) of the ONE PART.

HEREINAFTER CALLED the “TENANT / LESSEE” (which term shall mean


and include all his heirs, legal representatives’ administrators, executors
and assigns) on the other part.

WHEREAS, the LESSOR is the Absolute OWNER and well possessed of the
immovable premises namely commercial premises bearing BUILDING NO.
83, KHATA NO. 574/83, DASARAHALLI MAIN ROAD, NEAR UNION BANK,
BHUVANESHWARI NAGAR, K.R. PURAM HOBLI, BANGALORE SOUTH
TALUK, BENGALURU, with the amenities, fittings and accessories
described hereunder in the schedule and which property be hereinafter
called referred to as the “SCHEDULE PREMISES”.

WHEREAS the LESSEE herein approached the LESSOR and offered to take
on RENT the SCHEDULE PREMISES and the LESSOR, accepted the said
offer and agree to Rent out the same to the LESSEE and in pursuance
thereof the parties herein entered into this agreement as hereunder;

NOW THIS INDENTURE WITNESSETH:

That, the LESSOR has rent out and the LESSEE has taken on Rent on this
day the immovable property namely commercial premises bearing SHOP
NOS. 3 AND 4, BUILDING NO. 83, KHATA NO. 574/ 83, DASARAHALLI
MAIN ROAD, NEAR UNION BANK, BHUVANESHWARI NAGAR, K.R.
PURAM HOBLI, BANGALORE SOUTH TALUK, BENGALURU, which is
more specifically described hereunder as the schedule of the premises, and
hereinafter be called and referred to as the schedule premises, on the
following terms and conditions.

1. DURATION: - The tenancy shall be for a period of Eleven (11) months


only commencing from 29.02.2019 the same may be renewed after 11
months subject to terms and conditions as mutually agreed upon
between the LESSOR and the LESSEE.

2. RENT:- The LESSEE shall pay a sum of Rs.48,000/- (Rupees Forty


Eight Thousand Only) per month as rent for the premises to the owner.
The rent for each English calendar month shall be paid on or before 5 th

day of the following month. After 11 months the rent will be increased by
10% and every eleven months thereafter.

3. DEPOSIT:-The LESSEE has paid an amount of Rs.2,00,000/- (Rupees


Two Lakhs Only) by way of cheque No.204118 dated 01/03/2019,
drawn on 04/03/2019 to the lessor as an Interest free security deposit
for due performance of obligations as LESSEE. The LESSOR shall hold
the security deposit free of interest and shall refund the said deposit
immediately in the same manner in which it has been received at the
time of delivery back of vacant possession of the premises by the
LESSEE to LESSOR _ subject to permissible deductions. (Such as any
arrears of rent, painting, electrical charges, water charges, any damages
to the schedule premises. Etc)

4. PURPOSE:- The LESSEE shall use the schedule premises for the
Commercial (OPTICAL SHOP) Purpose only

5. CHARGES FOR ELECTRICITY: The LESSEE shall pay the charges for
Electricity separately as per separate meter provided.

6. BAR ON SUB-LETTING: The LESSEE shall not sub-let, re-let or part


with possession of the schedule premises or any part or portion this of
to/ or in favour of any person / s on any term or conditions.

7. ADDITIONS AND ALTERATIONS: The LESSEE shall keep the schedule


premises in good and tenantable condition, and shall not carry out or
make any alterations, modifications or repair in respect of the schedule
premises without the prior approval or consent of the LESSOR. The
LESSEE shall not put-up or install any permanent / temporary
structure in the schedule premises.

8. USE OF PREMISES: The LESSEE shall use and enjoy the premises with
utmost care and caution breaking and/ or any of the amenity,
furnishing, accessory etc., the LESSEE shall make good the loss to the
LESSOR. The LESSOR shall be entitled to deduct such amount/ s to
make good the loss from and out of the advance / deposit with the
LESSOR and/ or shall also be entitled to recover the same from the
LESSEE in this behalf.

9. REPAIRS AND MAINTENANCE: The LESSEE shall keep schedule


premises in good condition subject to normal wear and tear and shall
not cause or suffer any damage thereof. Any damages to the fixtures and
fittings of the premises, which shall be used by the LESSEE during the
lease period, shall be reimbursed by the LESSEE or the same shall be
deducted by the LESSOR out of the deposit paid by the LESSEE.

10. DELIVERY BACK OF POSSESSION: On termination of the tenancy
period, the LESSEE shall deliver back vacant possession of the schedule
premises to the LESSOR in the same condition in which it was let out
subject only to change by natural wear and tear. The LESSEE shall not
remove / cause to remove change / cause to change any of the fittings
and fixtures or their place or position.

11. PROVISION FOR EARLIER TERMINATION: In the event of the


LESSEE failing to pay the rent for a period of two months consecutively
or committing breach of any other terms and conditions of tenancy, the
LESSOR shall be entitled to terminate the tenancy and re-enter upon
the premises. The Lease may be terminated by either party by giving two
(2) months notice in writing.

12. PROPERTY TAX: The LESSOR shall bear and pay the property taxes,
rates and cesses payable to the Bangalore City Corporation in Regard to
the premises.

13. INSPECTION AND ENTRY: The LESSOR and/or his representatives


shall be entitled to enter upon the premises with prior appointment to
inspect the same to satisfy himself that the premises is being used in
accordance with the terms of tenancy.

14. PAINTING: The Lessee shall paint the schedule premises at the time
of vacating at their own cost and risk. Otherwise the lessor shall deduct
the same from the advance amount.
15. The Lessee has done interior work in the schedule premises at his
own cost. While vacating, the tenant shall remove Li..; interior and
handover the vacant possession to the Lessor.

16. The Lessee shall carryout any repairs wherever necessary and
mentions it in good order & condition. However major repairs shall be
carry out by the Lessor

SCHEDULE

All that piece and parcel of commercial premises bearing SHOP NOS. 3
AND 4, BUILDING NO. 83, KHATA NO. 574/83, DASARAHALLI MAIN
ROAD, NEAR UNION BANK, BHUVANESHWARI NAGAR, K.R. PURAM
HOBLI, BANGALORE SOUTH TALUK, BENGALURU, It consists of extreme
corner front shop area with two rolling shutters along with electricity and
water facilities.

LESSEE HAVE SET THEIR RESPECTIVE SIGNATURES TO THIS RENTAL
AGREEMENT ON THE DAY, MONTH AND YEAR FIRST ABOVE
MENTIONED.
