4. Requirements
Legality – Product, packaging (primary and secondary packaging materials, packaging aids and all
ingredients incl. all technical agents used during production are in accordance to the German food law
and all relevant EC legislations in the latest issue. Legal or in directives defined maximum levels must
not be exceeded.

Product Specification - All goods must comply with the product specification agreed – for new
suppliers: to be agreed - between August Töpfer & Co. and the supplier.
The microbiological requirements are based on the guideline values of the DGHM (German Hygiene
and Microbiology Society). The specification is valid for 3 years after expiration a review takes place.

Code of Conduct - The supplier has to comply with the “Code of Conduct” of August Töpfer & Co.

Traceability - A traceability system must be installed. The supplier must be able to identify the point of
origin of each raw material, packaging material and for all goods delivered to August Töpfer & Co. In
case of need this information must be provided to August Töpfer & Co.

GMO - Products and all ingredients are not subject to labelling and traceability requirements as laid
down in Regulations (EC) No. 1829/2003 and 1830/2003

Allergens - The manufacturer / distributor has established an allergen management System at all
stages. This System is considering allergens and possible cross contamination within the supply
chain, including cultivation, harvesting, transport and processing of the products. Equipment,
conveyances, and containers intended for harvesting, transporting, or storing allergenic products shall
not be used for foods that do not contain the corresponding allergen. Exceptions apply with
appropriate cleaning and visual inspection.

Nanotechnology, Irradiation - August Töpfer & Co. does not allow nanotechnology or irradiation in
food production and processing and packaging materials.

Disinfection - The supplier meets the applicable EU-regulations regarding the use of agents
containing BAC and DDAC. For surfaces that come into contact with food, none of the above
substances are used in agents and/or disinfectants. When cleaning surfaces that come into contact

Fumigation - The supplier meets the applicable EU-regulations regarding fumigation of raw material
during harvesting, processing and storage as well as for the application on the production site and in
freight containers. The use of ethylene oxide and methyl bromide is not permitted at all stages.

Pesticides - The use of pesticides complies with Regulation (EC) No 396/2005 and should be
reduced to a necessary minimum. In particular, substances that are harmful to insects and bees
should be avoided, wherever possible.

Food Defense, Food Fraud - The supplier confirms the protection of food products from intentional
adulteration by biological, chemical, physical or radiological agents, based on a food defense hazard
analysis and an assessment of associated risks, both documented. The according documentation can
be presented when requested. The supplier has to ensure security of the supply chain.
The supplier confirms the authenticity of the delivered goods and ensures that any deliberate and
intentional substitution, falsification, mislabeling, adulteration or counterfeiting of product and packaging
is excluded.
Any signs of this are identified and reported to August Töpfer & Co. immediately.

Mineral oil components - MOSH/MOAH (mineral oil saturated hydrocarbons / mineral oil aromatic
hydrocarbons) are mineral oil components which can migrate into food by different ways and at different
stages of the process such as during cultivation, harvesting, storage, processing or production and
transport. Since mineral oils are considered potentially carcinogenic guideline levels for assessing a
potential risk have been published by Consumer Protection Consortium of the Federal States.
Benchmark levels for mineral oil hydrocarbons (MOH) in foods (September 2022):
MOSH/POSH (C10 - C50) max. 4 mg/kg; MOAH (C10 - C50) not detectable.
The supplier ensures that all raw materials are in compliance with this guideline levels and implements
a systemic risk-based monitoring system. Analyses have to be carried out by an accredited laboratory
via online-coupled HPLC-GC-FID-method. Results can be provided on request.

Storage, Transport - The supplier confirms to August Töpfer & Co. that the goods are produced,
stored, treated or processed and shipped in safe places, which are protected against unauthorized
access at all times. The vehicles/containers used have to be suitable for the transport of food
products. Prior to loading, vehicles have to be examined to determine its hygienically acceptable
condition. There must be no leftovers of products from previous loadings, foreign bodies, foreign
odours, formation of dust, humidity, pests, moulds or residues of cleaning agents in the space where
products are stored for transportation. Transport and storage of allergenic and non-allergenic products
must be organized in such a way that accidental contamination with allergenic substances can also be
excluded.

5. Confirmation
The supplier confirms to have read and understood the above information and associated attachments
answered truthfully and complies with the requirements accordingly.
Individual examinations of the supplier’s premises are possible after consultation.
The supplier will inform August Töpfer & Co. immediately as soon as a certificate mentioned in
section 2 is suspended or not renewed or provided goods do not comply with this declaration, agreed
specification or relevant legislation.
Changes must be checked and confirmed in writing by August Töpfer & Co. (GmbH & Co.) KG.

The supplier agrees that audit reports as well as quality management documents sent to August Töpfer
& Co. may be forwarded to customers upon request.
