Regulatory status of INEOS Styrolution product K-Resin® KR03

Animal-Derived Materials / Kosher


To the best of our knowledge no animal-derived materials are used in the manufacture or formulation of
this product. This product can be considered free from bovine spongiform encephalopathy (BSE) and
other transmissible spongiform encephalopathies (TSE). INEOS Styrolution has not made any efforts to
certify its K-Resin® SBC as Kosher/Halal or in compliance with Kosher/Halal guidelines.

California Proposition 65 (Status on January 27, 2017)


Please be advised that the above grade contains substances which are listed in the safe drinking water
and toxic enforcement act of 1986 edited by the Environmental Protection Agency of the State of
California. The substances in question are:

- 1,3-butadiene (CAS No. 106-99-0): < 1 ppm


- Ethylbenzene (CAS No. 100-41-4): < 5 ppm
- Lithium carbonate (CAS No. 554-13-2): < 0.2 %
- Styrene (CAS No. 100-42-5): < 10 ppm

There is the potential for another substance that is known to the State of California to be a carcinogen
which may be present in trace quantities. This substance is cumene (isopropylbenzene) (CAS No. 98-
82-8). Though we do not routinely measure for this, the levels are expected to be very low.

We have no information to suggest that exposure to the low levels of above mentioned substances
found in our K-Resin poses any significant risk to the end-user or consumer.

Please note that the above mentioned substances are technically unavoidable. The mentioned residual
contents have been analysed on several test specimens. The observed maximum values are given
above. However, determination of residual monomers contents is not part of our continuous production
control. The values given can be used for general safety assessment but are not a specification.
Converters and manufacturers of finished articles must assess Prop 65 warning requirements based on
their specific situations.

Consumer Product Safety Improvement Act of 2008 (H.R. 4040)


Please be informed that we do not intentionally add lead and phthalates to above mentioned product.
The incidental level of lead is not expected to exceed 100 ppm by weight in the product as shipped.
Therefore, the listed grade would be in compliance with the final standard (August 14, 2011) requiring
lead to be present at not more than 100 ppm maximum. We also have no reason to suspect that
phthalates would be present in the resins as produced at individual concentrations exceeding 0.1%.

Given the above, we can state that the grade listed would be in compliance with the Consumer Product
Safety Improvement Act of 2008, H.R. 4040 and its enforced final limitations for calendar year 2011.

Absence declaration – Ozone Depleting Substances


We confirm that the current product referred to above complies with the requirements of the Regulation
(EC) No. 1005/2009, and the US labelling requirements of Section 611 of the Clean Air Act
Amendments of 1990 (CAA), §602 and §611.

The following Ozone Depleting Substances, as listed in the above legislations and the Montreal
Protocol of 16th September 1987, are not intentionally used as additives or ingredients:

 Group I to VII (Class I in USA)


 Group I Chlorofluorocarbons (CFC’s)
 Group II Other fully halogenated Chlorofluorocarbons
 Group III Halons
 Group IV Carbontetrachloride
 Group V 1,1,1-Trichloroethane
 Group VI Methylbromide
 Group VII Hydrobromofluorocarbons
 Group VIII (Class II in USA) Hydrochlorofluorocarbons (HCFC’s)
 Group IX Bromochloromethane

Therefore the requirements of the above listed regulations are fulfilled.

Clean Air Act


This product does not contain as intentional additives or ingredients any of the following substances
regulated by the U.S. Clean Air Act:

• Hazardous Air Pollutants as defined in Section 112(b)(1) of the U.S. Clean Air Act (40 CFR 61)

This product does contain trace amounts of the following substances regulated by Section 112(r) of the
U.S. Clean Air Act List of Regulated Flammable Substances for Accidental Release Prevention (40
CFR 68.130):

• 1,3-butadiene

This product does contain trace amounts of the following substances regulated by Section 111 of the
U.S. Clean Air Act List of Volatile Organic Compounds (VOC) (40 CFR 60.489):

• 1,3-butadiene
• Cyclohexane
• Ethylbenzene
• Styrene

RoHS, WEEE, ELV, California Toxics in Packaging Prevention Act


No heavy metals (i.e., antimony, arsenic, barium, cadmium, chromium, lead, mercury, selenium, or
silver) are purposely added to this product in quantities that would violate governmental guidelines. The
summation of lead, cadmium, mercury, and hexavalent chromium in this product is less than 20 ppm.
No polybrominated biphenyls (PBB), polybrominated diphenyl ethers (PBDE), Deca Brominated
Diphenyl Ethers (Deca BDE), or phthalates are intentionally added to this product. This product
therefore meets the relevant requirements of the following Directives or Regulations:

 2015/863/EU, 2011/65/EU and 2002/95/EC (RoHS)


 2002/96/EC and 2012/19/EU (WEEE)
 2000/53/EC (ELV)
 California Toxics in Packaging Prevention Act

Heavy metals
The sum of lead, cadmium, chromium-VI and mercury does not exceed the maximum value of 100 ppm
(i.e. 0.01%) as required by the CONEG (Coalition of North Eastern Governors) for the January 1, 1994.
Thus, also the maximum value for these elements laid down in Directive 94/62/EC as last amended by
Commission Directive 2013/2/EU is met.

Toys
European Standard EN71-3:2013 + A1:2014 and ISO 8124-3:2010 + AMD1:2014 set limits on the
migration of several metals. We wish to inform you that INEOS Styrolution does not deliberately add
any of these metals to the above grade and their concentrations therefore should not exceed the
migration limits set in the above mentioned standards. Please note that according to EN-71-3 and ISO
8124-3, the compliance of the material must be tested on the finished toy.

Genetically-Modified Organisms (GMO)


This product does not intentionally contain GMOs. However, one substance used in the manufacturing
process may be derived from GMOs. It is expected to be completely consumed by the manufacturing
process.

Residual Monomer
Typical values for styrene residuals in K-Resin® SBC products are below 10 ppm.

Phthalates
No phthalates, including di-(2-ethylhexyl) phthalate (DEHP), dibutyl phthalate (DBP), benzyl butyl
phthalate (BBP), diisononyl phthalate (DINP), diisodecyl phthalate (DIDP), and di-n-octyl phthalate
(DnOP), are intentionally added to this product. This product therefore meets the requirements of the
Consumer Product Safety Improvement Act of 2008 and EU Directive 2005/84/EC.

Canadian Environmental Protection Act (CEPA) “Challenge” Substances


The following substances are not used as intentional additives or ingredients in the manufacture of the
above mentioned product:

Batch 1 through 12 Challenge Substances as identified in the Canadian Environmental Protection Act,
1999. These substances were on the Domestic Substances List (DSL) and categorized as a) persistent,

bioaccumulative, and inherently toxic to the environment and that are known to be in commerce in
Canada; and/or b) a high hazard to humans and as having a high likelihood of exposure to individuals
in Canada.

Nanomaterial
This product is not a nanomaterial.

In addition, the manufacture of the product, no intentionally produced nanoparticles according to the
OECD definition (OECD, ISO, SCENIHR (2007b)) with an intended technical function based on their
nanoscaled structure like e.g. nano tubes, or materials intended to release nanoparticles in normal
conditions of use, are used as additives or ingredients.

Conflict minerals
Please be informed that “Conflict minerals” as defined by the Securities and Exchange Commission
(SEC), i.e. cassiterite, columbite-tantalite, gold, wolframite, and their derivatives, have not been
intentionally added as ingredients in the manufacture of the above mentioned product and, to the best
of our knowledge, are not known to be present in the final product.

Absence of Substances and Chemicals


None of the following substances are used as additives or raw materials in the manufacture of this
product:

 Acrylamide
 Alkylphenol Ethoxylates, including nonylphenol ethoxylate and octylphenol ethoxylate
 Allergens, including but not limited to those listed in EU Regulation 1169/2011, Directives
2000/13/EC, 2003/89/EC, and Section B.01.010.1 (1) of Canadian Regulation C.R.C., c.
870 such as: peanuts, tree nuts, milk, eggs, wheat gluten, soybeans, fish and shellfish
 Aromatic amines
 Asbestos
 Azo compounds
 Bisphenol compounds, including but not limited to: BPA, BPB, BPC, BPE, BPF, BPS, and
BPZ
 Brominated or halogenated flame retardants
 Butylated Hydroxyanisole (BHA)
 Chlorinated paraffins
 Colorants or pigments
 Cyanuric acid
 Di(ethylhexyl) adipate (DEHA), diethyl hydroxyl amine (DEHA), or di(ethylhexyl)maleate
(DEHM)
 Dimethylfumarate (DMF)
 Dioxins or furans
 Epoxy derivatives listed in EU Directives 2002/16/EC and 1895/2005
 Formaldehyde
 Melamine
 Methyl bromide
 Natural rubber latex, dry natural rubber, or synthetic latex
 Organotin compounds
