10.2 NOTES TO SPARE PART LIST

a) The spare parts noted “wear parts” are subject to substantial wear, tear, erosion and/or
corrosion and thus they are not included in the contractual warranty. In addition to the parts
expressly noted, are excluded from the warranty also those parts which according to criteria
generally accepted by the industry are considered to be consumable or wear parts. No
warranty is applicable to those components which are specifically designed to break, fuse or
collapse for safety reasons, such as but not limited to electrical fuses, rupture diaphragms
and safety pins.

b) The list included in this section is preliminary. The final list of spares will be submitted after
the completion of the engineering design and procurement of the equipment.

c) It is proposed to agree on the scope of supply of spares when the final list will be available.
The basis for the discussion shall be the commercial value of the spares proposed in this
section.

d) Non-critical spares, which are believed to be readily available in the local market or can be
locally repaired or manufactured, are not included in the list of recommended spares.
