measuring a total Area of 974.274 sq.Mtrs bounded by pillar numbers No. SC/SP150, SC/SP151, SC/SP152, and SC/SP153 - respectively, thereon verged "RED" by SURV. ONARI .J. BRIGGS to HOLD SAME UNTO the Purchaser in fee simple absolute free from all charges and encumbrances of whatever nature, and incidents of customary tenure or other-wise. THE VENDOR HEREBY COVENANT WITH THE PURCHASER AS FOLLOWS: That the Vendor has the full rights, authority and capacity to sell and convey the said land herein described unto the Purchaser. That the Vendors and all those claiming under or through them undertake to indemnify the Purchaser to full value of the consideration together with interest at commercial bank rate from the date of this Deed and other incidental expenses incurred and/or may be incurred by the Purchaser in cause of this transaction, and also w here/if the vendor's title become defective and/or there is a subsequent sale of the land to another party either by the Vendor or their agent and/or those claiming through them. That the Vendor covenant with the Purchaser to assist the Purchaser obtains any consent or instrument that may be necessary and proper for carrying the tern1s of this Deed into effect provided that where it is impossible to obtain such consent or instrument, without the fault of both parties, the Vendor shall hold the said piece of land as trustees for the benefit of the Purchaser and shall accordingly treat the said piece of land as the Purchaser mat direct from time to time. That neither them (Vendor) nor any member of their families, nuclear or extended have previously given any conveyance, assent or parted with the possession of the parcel of land here-in-before described and conveyed any part thereof to any other person or persons apart from the Purchaser. That the Purchaser in entitled to enter, take quite possession in peace and apply to the Executive Governor of Rivers State and other relevant authorities for purposes of obtaining a Ce1iificate of Occupancy and/or Perfection of Statutory documents over the said piece and parcel of land. That the context of this Deed is binding on the heirs, agents, administrators, executors and successors-in-title of both parties.
