Madam,

Under instruction from our client Mr. AAA S/O Mr. FFF, aged 31
years, residing at No.93, MEG Layout, B Narayanapura Bengaluru, we are
issuing the following notice to you

1. Our client states that both of his parents Mr. FFF (Father) and
Mrs. GGG (Mother) died intestate on 13.10.2000 and 23.01.2017
respectively leaving yourself and our client as legal heirs.
2. Our client’s father purchased a flat at Door No.77/8, A4 Jeenis
Apartments, Jeenis road, Saidapet, Chennai-15 in his name.
Likewise, our client’s mother purchased two plots measuring about 2
grounds at Pozhichallur, Chennai and also constructed house
ground floor and first floor in Pozhichallur plots. Both of our clients
parents were employed in government service. After the demise of
our client’s father our client’s mother brought up both yourself and
our client and maintained the family. Our client’s mother performed
your marriage with Mr. RRR. After your marriage both our client and
our client’s mother lived separately in a rented house. Then in the
year 2017, just after her retirement from service died due to illness.
Our client’s mother’s some of the retirement benefits were shared by
our client and yourself.
3. After the demise of our client’s mother yourself arranged the
marriage of our client and our client got married on 19.02.2018.
After marriage our client along with his wife lived in the first-floor of
the Pozhichallur house and yourself lived in the ground floor along
with your family.
4. After the marriage of our client, our client’s wife Mrs. BBB and
yourself repeatedly quarreled with each other in sharing the assets of
our client’s deceased parents. Since our client’s wife is a single girl
child to her parents, who are residing at Bangalore, our client’s wife
started a business at Bangalore. Therefore our client left to
Bangalore as he was having workplace at Chennai and Bangalore
and used to visit Chennai whenever necessity arises at Chennai
office. While leaving to Bangalore the first floor of the house was
locked along with the belongings of our client including jewellery and
valuables and given the key of the same to yourself for cleaning the
house frequently.
5. Our clients state that when he visited Chennai during the first week
of December 2020 he came to know that you vacated the house at
Pozhichallur long before and residing at Navalur. Further, our client
also noticed the tolet board hanging on the front entrance of the
house at Pozhichallur. When enquired with the neighbor at
Pozhichallur house they informed our client that both the ground
floor and first floor of the house was let out long back and they
recently vacated the house. Thereafter only the tolet board was
hanged. Since our client was not aware of your house address
contacted you over mobile phone and yourself refused to inform
about your whereabouts. Therefore our client has given a complaint
at Shankar Nagar Police station on 08.12.2020 for getting the key of
the house from you.
6. Our client sates that though yourself came to the Police station but
threatened our client and his wife by influencing the higher police
officials. Therefore our client was forced to return to Bangalore.
7. Our client states that since his parents died intestate leaving
yourself and our client both of them are entitled to share assets
( Both movables and immovables). Further, since our client’s father
married our client’s mother as second wife, the first wife and 3
children are also entitled to share the assets of our client’s father. In
fact for our client’s marriage nearly 100 sovereigns of gold has been
gifted to him which was kept in the locker kept inside the first floor
of the house and other valuables were also kept in the house. That
apart another 150 sovereigns of gold belonging to our client’s mother
was also with you. Therefore you are liable to return the 100
sovereigns and other valuables kept in the house to our client
immediately. Further the 150 sovereign, other silver articles and the
2 movable properties one at Saidapet and Pozhichallur are liable to
be partitioned between you and our client. Our client is very much
interested in sharing the same with mutual understanding and
amicable settlement by discussion. But you have failed to disclose
the address and threatened our client and his wife. Therefore our
client is forced to issue this notice for mutual partition and amicable
settlement of assets belonging to our client’s parents.

We therefore call upon you to fix a date for the discussion to mutually come
for amicable settlement for sharing and partition the assets left by our client
and your parents. We request you to fix a date and inform our client within
a period of 15 days failing which our client has no other option except to
initiate appropriate action before court of law to recover our client’s 100
sovereigns gold and other valuables taken by you from the house in
pozhichallur and also for portioning the assests (both movables and
immovables) left by our clients parents at your costs and consequence
thereafter.
