IPC 7 (General Principles of Criminal Liability)

1. A Panchayat as a form of punishment made a person accused of an offence


paraded through the village with face blackened and beaten him with
shoes to save him from the attack of a particular community against which
he has committed the offence. Discuss the liability of the panchayat
considering section 81 and 87, IPC.
2. The accused branded ‘W’ and ‘A’ the initials of his name on his wife’s
buttocks with a hot knife. She had asked him to do so. Her skin became
infected and she sought medical treatment from her doctor. The doctor
reported the matter to the police and the husband was charged with causing
harm. Decide liability of the husband.
3. A teacher gave 5 – 6 strokes with a cane to a boy of 16 yrs who was guilty of
misconduct. Can good faith be pleaded as defence to liability on the part of
the teacher.
4. A, who is about 80 years old, walks into a pawn shop. She wanted to sell her
ring that has been in the family for 200 years. A asks the dealer, how
much will you give me for this ring.? The dealer, in good faith, tells A that
he doesn't know what kind of metal is in the ring, but he will give her $150.
A needed cash to buy medicine and therefore accepted Rs.150. The
ring turns out to be solid gold and is really worth Rs.2,50,000. Can the consent
be considered valid or vitiated under misconception of facts?.
5. A, negligently rams his car in to M’s car and M gets off the road and the front
part of her car also gets damaged. F, came to the rescue of M and attempted
to help her. When F pulled M out of the car, he severely injured her (M) back.
The injury was caused not due to the accident but due to the act of F,
removing M from the car. Whether A and F will be liable and if liable
based on which factor or a combination of f actors? - proximity cause /
forseeability, superseding intervening factors, But for test……or what?
6. F, sprayed a harmful chemical in A's hair thinking it was hair tonic. A
needed medical assistance, and she was taken to the hospital by B. On the
way, lightning strikes and the front tire blows out. A suffers fracture to her legs and
was hospitalized. ,But for the act of F, the chain of events would not have
occurred. Discuss the criminal liability of F if any on the basis of proximity
cause / forseeability, superseding intervening factors, But for test……
or what?

7. B and M, both teenagers were having a ride through the desert in a car. M,
started drinking alcohol and also compelled B to drink. B never had tasted
alcohol in his life and refused to drink. M got enraged and threatened B to
throw him out of the car. B, thereafter consumed alcohol and got inebriated
and in that state of mind, he killed M. Can B be exempted on the ground of
intoxication?
8. A young girl needed money badly as she was hungry and without support. X,
an adult guy offered money to her provided she would have sex with him. The
girl readily agreed but later on she alleged that her consent was in fact a
compulsion or submission rather than consent. Decide
9. A, was having HIV and he had sex with a girl with her consent. The girl was
unaware of the HIV status of the guy. Later she came to know of the reality
and filed a case against him for endangering life and procuring consent by
deceit or fraud. A was of the view that the girl did not ask and it was never his
duty to disclose it on his own. Decide whether consent was free or vitiated?
