STUDY OF DOWRY DEATH

INTRODUCTION-
Under the Dowry Prohibition Act, 1961-86, “Dowry” is defined as any property or
valuable security given or agreed to be given, directly or indirectly by one party to
the marriage to the other party to marriage, or by parents to either party to the
marriage, or by any other person to either party to marriage or to any other person
at or before or at any time, after the marriage “in connection with the marriage of
said parties” and Dowry deaths are deaths of married women who are murdered or
driven to suicide by continuous harassment and torture by their husbands and in-
laws over a dispute about their dowry, making women's homes the most dangerous
place for them to be. India has by far the highest number of dowry-related deaths
in the world according to Indian National Crime Record Bureau.

OBJECTIVE AND SCOPE OF RESEARCH-


The objective of the research is to study in depth the concept of Dowry Deaths in
the light of the modern era with respect to the laws made to prevent it.

So, the scope of this project will be limited up till the constituents of medical
negligence, English and Indian case laws discussing how they have gradually
developed over time.

RESEARCH METHODOLOGY-
Researcher is going to adopt Doctrinal Research Methodology in this research. In
case of Doctrinal Research field work is not needed rather library is sufficient.
Doctrinal Research is not concerned with people but with documents. This
research can provide a systematic exposition of the rules governing a particular
legal category, analyses the relationship between rules, and explains areas of
difficulty and, perhaps, predicts future developments. This research is concerned
with the legal prepositions and doctrines. Research will be referring primary
sources such as Acts, cases and judgements given by the Indian courts. Secondary
sources like books, articles, research papers and journals.

MODE OF CITATION-
In this research paper, Blue Book citation has been used of the recent edition, i.e.
19th edition.
