08.09.2015 Heard Mr. T. Mishra, learned counsel for the petitioner and Mr. B.S. Mishra-2, learned counsel for opposite party nos. 2 and 3. The petitioners files this application to stay the process of nomination of CAS promot ee professors for members of Syndicate of the Berhampur University. Mr. T.S. Mishra, learned counsel for the petitioner submits that the petitioner being the senior most person and on direct recruitment basis he is eligible to be nominated as profe ssor for member of Syndicate of the Berhampur University. Mr. B.S. Mishra-2, learned counsel for opposite party nos. 2 and 3 submits that no suc h gradation list has been prepared by the authority at any point of time regarding position of the petitioner and he seeks time to file counter affidavit. Considering the contention raised by learned counsel for the parties and after going t hrough the records, without expressing any opinion on the merits of the case, this Court direc ts that as an interim measure, any nomination of professor for member of Syndicate of the Berh ampur University shall abide by result of the writ petition. Misc. Case is disposed of.
