I. Identifying Information
teenagers were hanging out in the streets, when Jassi walked by. He went out to buy
something to eat when someone from the group recognized him. His friends who were
drinking and doing drugs which accordingly to him, was marijuana, invited him to
join them. Jassi refused and continued walking away. However, one of his friends
followed him with an excuse to buy cigarettes. Jassi knew that his friend was walking
behind him in a distance and thought it was harmless, so he ignored him completely.
When they passed a dark alley, Jassi looked back to check on his friend. To his
surprise, he saw his friend stabbing someone in the chest. Without thinking, he ran to
check the situation and pulled his friend away from the man, whose hands were
completely covered with blood. Jassi started to panic, and when his friend realized
what he did, he got scared and ran away, leaving him. Jassi knew he would be
accused of the crime, so he also ran away. The next day, they were both summoned
with an arrest warrant from the PNP-Surigao because they were seen through a CCTV
near the crime scene. Children under the age of 18 are protected by law and must not
be detained in the police station for more than 24 hours. According to the Juvenile
Justice and Welfare Act of 2006, a child above fifteen (15) but below eighteen (18)
years of age shall likewise be exempt from criminal liability and be subjected to an
intervention program. Jassi was turned over and referred to a rehabilitation center
under the temporary care and custody of Bahay Pag-asa, located at Barangay Anomar,
Surigao City, for two (2) years and one (1) month from October 1, 2020, to the
present.
A. The Child
Chad is the only son of Mr. Reynaldo Salino, Jr., and Mrs. Maridel
Sumayod. He has a full-blooded older sister, Bretain Salino, who now also has
a family of her own. He also has two younger half-sisters, Nazi Salino and
Riyadh Salino. He is 5'5" tall, weighs 48 kg, has a medium build, and a fair
complexion. He is a shy, soft spoken person, friendly, and expressive in his
thoughts and actions. He knows how to display courtesy and communicate
respectfully with other people.
Given the family’s predicament and influences from peers, at the age
of thirteen, Chad started to rebel and cut classes, and whenever he does, he
often wanders the streets and pretends to be an orphan to beg people for
money. Oftentimes, whenever he is hungry, he will steal fruit and "kakanin"
from the market secretly to eat. Chad does not want to become a burden to his
family, so instead of asking for money from his parents to support him, the
child will find a way to support his needs. His family did not know his
whereabouts until he was caught by Bantay Bata in 2017 and was brought to
the Bahay Silungan because they believed that he was an orphan.
It was then that his father knew what he was doing. Chad was
reprimanded by Reynaldo and was advised not to do it again. However, the
child was not convinced and returned to his vices due to peer pressure. In
2018, he was again caught by Bantay Bata and was released later because he
still had his immediate family.
Chad dropped out of school, stowed away from home for weeks, and
stayed at Barangay Canlanipa, where his sister temporarily resides. He was
influenced by his peers to beg money on the streets and use it for their vices,
such as gambling and smoking. Chad was charged with taking part in a
robbery involving the theft of an air conditioner in Barangay Canlanipa in July
2022.
B. The Family
Chad’s parents both have stable jobs that can support the needs of their
family. Reynaldo, Chad’s father, owns a small arts and design shop that offers
services such as painting, calligraphy, drawing, and lettering. The shop was
situated adjacent to their house, making it convenient for Reynaldo. Most of
the time, his father spent the entire day at the shop, and Chad would assist him
and frequently commission drawings because the minor has acquired skills in
drawing and cartooning. Miradel, the boy's mother, on the other hand, was a
plain housewife until she decided to work abroad as a domestic helper in
Quatar in 2015. Chad was close to his mother, so the absence of Miradel
affected him. Because of the distance, Reynaldo and Miradel’s relationship
starts to become shaky. Three years later, the two decided to separate. All of
the children chose to stay with Reynaldo and felt sad about it, so she did not
go home for quite some time and stayed in Davao City whenever she came
back from abroad.
C. The Community
The family lived in the small town of Mainit, Surigao del Norte, a one-
hour ride from the urban city of Surigao. They have settled in one place for
more than 15 years, where they owned a small arts and design shop as the
source of their income. Houses in their neighborhood were made from mixed
materials and had access to basic commodities such as water, electricity, food,
internet connectivity, health services, and other government facilities. The
occurrence of crimes and vices in the community was closely linked to the
existence of out-of-school youth, poverty, gang involvement, and broken
homes.
VI. Assessment
This is a case of a child in conflict with the law (CICL). Chad was
apprehended for his alleged participation in a robbery case. He was 16 years
and 4 months old when the alleged crime occurred, and he was turned over to
a rehabilitation center. The minor is under the temporary care and custody of
Bahay Pag-asa, located at Barangay Anomar, Surigao City, Surigao del Norte,
for four (4) months and two (2) weeks from July 12, 2022, to the present.
Considering that he was a minor at the time of the commission of the alleged
crime, he availed himself of the benefit of no criminal liability and will
undergo a series of activities for reformation and rehabilitation while awaiting
the proper disposition of his case.
