Assignment Question
George Boyd and Marilyn Boyd were married sometime in 1990. George Boyd died on
26th January, 2021 in Lusaka, Zambia. At the time of his death the parties had been on
separation. They had been on separation for about 21 years during which period
Marilyn lived in United Kingdom and was not maintained by the deceased. Marilyn is
now aged about 56 years. During the separation the marriage between the parties was
still valid and subsisting; but the deceased lived with a lady now deceased with whom
he had a son named George Boyd jnr. still living and aged 10 years old. The testator left
a Will in which he left his entire estate to his son George and the Will does not appoint
anyone as executor. The testator's estate comprises of residential house at plot 594,
ibex hill Lusaka and cash at the Bank in ZANACO amounting to K100, 000. The testator
did not make any provision for Marilyn and she commenced the matter in court on 1 st
June 2022 to contest the Will. Imagine you are the judge in this matter, with the aid of
case law and statutory law, write a ruling.
