l) The existing provision in Regulation No.7.6.1 is replaced by the following - .

7.6.1 Redevelopment of multi-dwelling buildings of Co-Operative Housing Societies /


Anartmen ts-
v. FSI allowed for redeveloprnent shall be FSI of existing authorized building and
incentive FSI to the extent of 30o% of existing built up area or 15 sq.mt. per tenement,
whichever is more.

6.1 or 6.3, as the case may be, then society may avail premium FSI / TDR upto

vi. [n cases where carpet area occupied by residential tenement in the existing building is
less than the carpet area of 27.87 sq.m. then such tenement shall be entitled lor
minimum carpet area of 27.87 sq.m. and difference of these areas shall be allowed as
additional F SI without any premium.
In case of non-r'esidential oocupier the area to be given in the reconstructed building
shall be equivalerlt to the area occupied in the old building.
vii. This re.-lulation shall be applicable only when existing members of the societies are
proposed to be re-accommodated.
viii. If tenanted building's and building/s ol co-operative housing society/non-tenanted
building/s coexist on the plot under development, then proportionate land component as
per existing authorized built up area of existing tenanted building on the plot shall be
developed as per Regulation No.7.6.2. and remainder notional plot shall be developed as
per this regulation.

2) In chapter 10 the follou'ing new Regulation is added as Regulation No.10.2.9 as


follows -
10.2.9 Redevelopment of Okl Dilapidated / Dangerous Buildings -
Recorstruction Redevelopment in whole or in part of any building which has ceased
to exist i:r cr)ilsequel)co rrl aoci'lental fire / natural collapse or demolition for the reasons
of the sarne having been declared dangerous or dilapidated or unsafe by or under a lawful
order oi the ,\uthoril)' or buildine having age of more than 30 years, shall be allowed

Regulation No.6. I or ti.-l including FSI on payment of premium and maximum
permissible TDR ioading as per Table 6-,{ or 6-G, or the FSI consumed by the existing

3) The Note (vi) below Table 6 G of Regulation No.6.3 is modilied as follows -


vi) The restrictions ofroad nidth mentioned above shall no1 be appliiable in cases where, the
permissible FSI is more than the basic FSI in various schemes such as slum
rehabilitation scheme, redevelopment of dangerous buildings. cluster development for
congested (core) area, redevelopment of MHADA buildings. TOD etc. in such scheme,
regulations of respective scheme shall be applicable Horrever for soecial buildinss as
mentioned in Repulation No.l.3(93Xxiv). provisions meirtioned in Regulation
No.J.3.9 sha ll be aonlicable.

Whereas, the Govemment ol'Maharashtra has sanctioned the Unified Development
Control and Promotion Regulations ('LTDCPR') for the state except Municipal Corporation
of Greater Mumbai, other l)lanning Authorities / Special Planning Authorities /
Development Authorities within the limits of Municipal Corporation of Greater Mumbai,
MIDC, NAINA, Jawaharlal Nehru Port Trust, Hill Station Municipal Councils, Eco-
Sensitive/ Eco-Fragile region notified by MoEF & CC and Lonavala Municipal Council
and Area under CIDCO's jurisdiction as Planning Aurhority, PCNTDA, MIHAN, MADC,
MSRDC, in Maharashtra under the provisions ol the Maharashtra Regional & Town
Planning Act, 1966 (hereinafter refened to as 'the said Act') vide Notification No.TPS-
1818/CR.236l18/DP. & RP./Sec.37 (lAAXc) & sec.20(4)AJD-13, dated 02112/2020 which
has come into force from 03/1212020, excluding area of Pune Metropolitan Region
Development Authority and Regional Plan of Ratnagiri District;

And whereas. to make applicablc the said sanctioned Unified Development Control
and Promotion Regulations for the area of CIDCO as Planning Authority, for the area of
Pimpri-Chinchwad Neu, 'forvn Development Authority, for the area of Mdlti-Model
Intemational Hub Airport Notified area (MIHAN), for Shirdi Airport Notified area of
Maharashtra Airportpevelopment Company Ltd. (MADC) as Special Planning Authority
and for notified'area of Maharashtra State Road Development Corporation as Special
Planning Authority, the Govemment has published Notices under section 37(1AA) &
section 20(3) of the said Acl, bearing No.TPS-1818/CR-236/18/Sec.37( IAA) &
Sec.20(3)tuD-13. dared 0211212020 and No.TPS-1818/CR-236/18/Sec.20(3)tuD-13. dated
0211212020 respectively, along w.ith directives under section 154 ofthe said Act, 1966 vide
resolurions No.TPS-1818/ CR-236/18/Sec.37(lAA) & Sec.2O(3)tuD-13, dated02/12/2020
andNo.TPS-l818lCR-2361 l8/Sec.20(3)/UD-13, dated 02112/2020 respectively;
And whereas, the Government is of opinion that, it is necessary to modify some
provisions ofthe said sanctioned Unilied Development Control and Promotion Regulations
(hereinafter referred to as 'the said modification');

And whereas, in exercise of the powers conferred under section3 7( I AA)(a) and
section 20(3) of the said Act, the Govemment in Urban Development Department has
declared its intention regarding the said modification and published a Notice No.TPS-
l8l8/CR-236/l8iSec.37( I AA) & Sec.20(3)/Modification/UD- 13, dated 02/12/2020 &
um No.TPS- I 8 I 8/CR-216/l 8/Sec.37 ( I AA) & Sec.20(3 )/Addendum/UD- I 3. dated
/12/2020 to thal effect, for inviting suggestions/objections from the general public, which
is appeared in the Maharashtra Govemment Gazette, extra-ordinary part-I, central sub-
division dated 03112/2020 and dated 10112/2020 respectively. Divisional Joint Directors of
Town Planning of concemed Divisions are appointed as 'Officer' (hereinafter referred to as
'the said Officers') to hear the suggestions and objections which are received and also say
of the respective Planning Authorities and submit their reports to the Go\.ernment;

And whereas, the said Officers have submitted their reports to the Govemment after
completing the legal procedure as contemplated under section 37(lAA) and 20(3) of the
said Act, as the case may be;

And whereas. after considering the reports ofthe said Officers and after consulting
the Director of Town Planning, Maharashtra State the Govemment has kept some
modifications in abeyance and sanctioned some modifications, with some changes out of
the said modification vide Notilication No.TPS-1818/CR-236/18 (Part-3)/Sec.37 (1AA)(c)
& Sec.20(4)/Modification/UD- 13 dt.16.06.2021 . (hereinafter referred to as 'the said
Notification');
And whereas, after considering the reports of the said Othcers, after consulting the
Director ofTown Planning, Maharashtra State and after necessary enquires the Govemment
is of the opinion that. out olthe modifications kept in abeyance vide the said Notification,
Modification in Regulation No.7.6.1 needs to be sanction. uith some changes;
Now therefore, in exercise of the powers conf'ened under section 37(AA)(c) and
section 20(4) of the said Act. the Govemment herebl, :-

A) Sanctions the modifications, with some changes. in provisions of Regulation


No.7.6.1 of the said sanctioned Unified Development Control and Promotion
Regulations, as specifically mention in schedule-A appended herewith.
B) Fixes the date of publication of this Notification in Government Gazette as lhe
date of coming into force ofthese sanctioned modifications.

This Notification along with the schedule shall be available in the offices of all
concerned Planning Authorities, all Divisional Offices and District Branch Offices of Town
Planning and Valuation Department, all Collector Oflices, all Zilla Parishad Offrces for
inspection of general public for a period of one month.

iv. If tenanted buildingi's and building/s of co-operative housing society/non-tenanted
building/s coexist on the plot under development, then proportionate land component as
per existing authorized built up area of existing tenanted building on the plot shall be
developed as per l{egulation No.7.6.2. and remainder notional plot shall be developed as
per this regulation.

2) In chaptcr l0 thc following new Regulation is added as Regulation No.10.2.10 as


follows -
10.2.10 Redevelopment of Old Dilapidated / Dangerous Buildings -
Reconstruction; Redevelopment in whole or in part ofany building which has ceased
to exist ir collsequcnco of acci,Jental fire / natural collapse or demolition for the reasons
of the sarne having been dec,ared dangerous or dilapidated or unsafe by or under a lar.rflrl
order of the Authority or buikling having age of more than 30 years, shall be allo*ed
subject to following conditions.
Redevelopment of multi-dwelling buildings of society / Co-Operative Housing
Societir:s / Apartments -
i. The FSI alloq,ed ftrr redevel,:pment of such building shall be FSI permissible under
or 6.3 including FSI on pa)'ment of premium and maxrmum
) ading as per Table 6-4, or 6-G, or the FSI consumed by the existing

( ) if iucluding TDR" premium FSI etc., wh.ichever is more. (Such TDR,
( utilised in existing building shall be treated as a basic FSI for
redevelopment.) In addition to this, incentive FSI to the extent of 50% of the existing
authorised built up area or l5 sq.mt. per tenement, whichever is more, shall be allowed.
Provided that in cases where carpet area occupied by residential tenement in the
existing building is less than the carpet area of 27.87 sq.m. then such tenement shall be
entitled for minimum carpet area of 27.87 sq.m. and difl-erence of these areas shall be
allowed as additional FSI without any premiunr.
In case of non-residential occupier the area to be given in thc reconstructed building
shall be equivalent to the area occupied in the old building.
Such incentive FSI shall not be applicable lor redevelopmenl ofexisting bunglow.
ii. This regulation shall be applicable only when existing members ol the societies are
proposed to be re-accommodated.
iii. If tenanted building/s and building/s of co-operative housing society/non-tenanted
building/s coexist on the plot under development, then proportionate land component as
per eiisting authorized built up area of existing tenanted building on the plot shall be
developed as per Regulation No.7.6.2. and remainder notional plot shall be developed as
per this regulation.
iv. Notes below Regulation No.7.6 shall be applicable to this regulation.

3) The Note (vi) below Table 6 G of Regulation No.6.3 is modified as follows -


vi) The restrictions of road q'idth mentioned above shall not be applicable in cases where, the
permissible F'Sl is more than the basic FSI in various schemes such as slum
rehabilitation scheme, redevelopment of dangerous buildings. cluster development for
congested (core) area. redevelopment of MHADA buildings. TOD etc. in such scheme,
for soecial buildinss as
regulations of respective scheme shall be applicable. However
mentioned in Regulation No.l.3(93Xxiv), provisions mentioned in Regulation
No.3.3.9 shall be applicable.
