AFFIDAVIT OF UNDERTAKING

I, ELVES GAMAY Y BAYUDAN, of legal age, married, farmer and a resident of

Purok 2, Barangay Villa Pagaduan, Aglipay, Quirino after having been duly sworn to an
oath in accordance with law do hereby depose and say;

1. That I am the same person executing this affidavit;

2. That I am the owner of the confiscated one (1) Utility Vehicle (Isuzu Elf)
color blue, bearing plate number NGS 5987, with engine number 4HE1746475 and
chassis number JAANPR70PY7100587 and now under the custody of the PNP
Aglipay which was involved for violation of PD 533;

3. That the said Utility Vehicle were presented as one of the evidences of the
case filed before the Office of The Provincial Prosecutor. That I already submitted a
motion to release and still waiting for the approval. However, the said vehicle may be a
great help to sustain my business while the case is still on the process;

4. That I will undertake to keep the said utility vehicle and promise to make it
available at any time and shall promise to deliver the same in the event that the
Honorable Prosecutor or the Court, order it to be presented;

5. That I am executing this Affidavit to make it known that I am very much

willing to undertake and to deliver the same to the Court or to anyone if legally ordered
to do so and to attest the truthfulness of the above facts and for all legal intents and
purposes.
