HEARON IN SUPPORT OF PLAINTIFF'S MOTION FOR TEMPORARY
RESTRAINING ORDER AND PRELIMINARY INJ UN CTION

I, Jeffrey C. AHearon, being first duly sworn upon my oath, hereby state under

penalties of perjury as follows:

1. I am of sound mind and am competent to make this affidavit and am over the

age of 18.

2. I am a Lieutenant with the Indiana State Police, serving as the Investigative

Commander of Field Investigations for Area V. I have worked as an officer of

the Indiana State Police for approximately 35years.

3. As part of my work with the Indiana State Police, I have been involved in the

investigation of Jamey Noel ("Jamey"), Misty Noel ("Misty"), and Kasey Noel

("Kasey") for the events and actions described in the criminal information

filed against thém in Clark Circuit Court under cause numbers 10001-2311-

F5-000297, 10001-2401-F5-000029, and 10001-2403-F6-000230, respectively.

4 . Attached to this affidavit as Exhibit 1 is a true and accurate copy of the


criminal charging information filed against Jamey Noel in the Clark Circuit

Court Case under case no. 10001-2311-F5-000297.

. Attached to this affidavit as Exhibit 2 is a true and accurate cOpy of the

criminal charging information filed against Misty Noel in the Clark Circuit

Court Case under case no. 10001-2401-F5-000029.

. Attached to this affidavit as Exhibit 3 is a true and accurate copy of the

criminal charging information filed against Kasey Noel in the Clark Circuit

Court Case under case no. 10001-2403-F6-000230.

. As part of my work on the investigation, I have had occasion to identify

assets belonging to Jamey Noel (including properties owned by Noel and his

wife, Misty), Misty Noel, and/or Kasey Noel.

8. On or around May 3, 2024, I learned that a property owned by Jamey and

Misty, located at 722 E. Court Avenue, Jeffersonville, IN 47130, was on the

market for sale. Specifically, I observed a listing for the property on a real

estate selling website. Attached to this affidavit as Exhibit 4 is a true and

accurate copy of the listing that I located during my investigation.

. Upon further investigation, I discovered that the 722 E. Court Avenue

property had already been sold by Jamey and Misty back in March of 2024,

and was now being resold by those new owners. This sale in March of 2024

would have been after Jamey had his initial hearing-on the above referenced

criminal matter as well as after the publication of SBOA Audit Report

844771.

10.I investigated further, and found another property owned by Jamey and

Misty: specifically, 516 Eagle Creek Dr., Naples, FL 34113. This property
was also listed as being available for sale beginning approximately January

of 2024. Attached as Exhibit 5 to this affidavit is a true and accurate copy of

an internet listing for the home which I viewed during my investigation.

Furthermore, on or about May 7, 2024, I did call and speak to the real estate

agent who is listing that home on behalf of Jamey and Misty Noel and did

confirm that it is for sale.

11.T0 date, it is my understanding that the 516 Eagle Creek Dr. property is still

for sale by Jamey and Misty.

12. I was also made aware that on or about April 16, 2024, Jamey and/or Misty

Noel requested duplicate titles for at least five (5) vehicles that they owned.

Many original titles for their vehicles were seized by ISP during search

warrant service on August 16, 2023, as well as seizing many physical

vehicles. The 5 duplicate titles requested dealt with vehicles which were not

physically seized by ISP and could potentially be sold if proper titles are

obtained. Subsequent to learning of these 5 duplicate title requests, ISP did

seize 4 out of the 5 vehicles for which duplicate titles were requested.

13. After that, I did learn of additional duplicate titles requested. More

specifically, based on information from the BMV, I have learned of a

minimum of seventeen (17) duplicate titles applied for on behalf of Jamey

Noel since August 16, 2023. Of those vehicles for which duplicate titles were

requested, there still remain some of those vehicles which have not been

seized by ISP and could potentially be sold.

14.011 or about April 23, 2024, after the criminal case as to Jamey was filed, I

spoke to Donavan Harrod ("Harrod") and learned that Misty Noel asked

Harrod to assist in selling approximately twenty-one (21) vehicles which were

owned by Jamey and/or Misty. Specifically, Harrod was asked by Misty to

inspect the vehicles and write out a list and distribute it to people Harrod

thought might be interested in classic cars.

15. On or about April 25, 2024, ISP did seize 9 of those 21 vehicles Harrod was

asked to help sell. While many of these vehicles appear to be owned by

Jamey Noel alone or with "open" titles, Misty is still attempting to sell them.
Some of the vehicles for which Misty requested the duplicate vehicle titles

were included in the list that Harrod was asked to help sell.

16. Specifically, I was provided with photographs of the list of vehicles Misty

wanted Harrod to help her sell. True and accurate copies of these

photographs are attached as Exhibits 6 through 9 of this affidavit.


17.1 was made aware on or about April 12, 2024 that Misty Noel had requested a

family friend, Kenneth Hughbanks (also a co-defendant relating to Audit

Report B8447 7I), assist in cleaning a property of Kasey Noel's located at 711

Old Salem Road Jeffersonville, Indiana, in order to make it ready for sale.

During the service of a search warrant on Jamey and Misty's pole barn I

personally observed evidence of the removal and relocation of items from

Kasey's residence.

18.1 was also made aware that on or about May 5, 2024, Misty contacted a

realtor in effersonville and informe-d him that she had found a buyer for

Kasey's home at 711 Old Salem Road and asked him to complete the sale of

the home.

19.After researching and reviewing property cards, it is my belief that Kasey

Noel owns the following additional properties (See attached as Exhibit 10):

a. Real Property located at 711 Old Salem Road, Jeffersonville IN 47130;

20.After researching and reviewing property cards, it is my belief that Jamey

and/0r Misty Noel own the following additional properties (See attached as

Exhibits 11 through 13):


a. Real property located at 709 Old Salem Road, Jeffersonville, IN 47130,

assigned parcel number 10-41—01-274.000-037;

b. Real property located at 3001 Old Tay Bridge, Jeffersonville, IN 47130;

c. Real property located at 2408 Turnberry Drive Units A &B,

Jeffersonville, IN 47130,

21. Based on my investigation of this matter and my experience in my role as a

detective, I believe that Jamey Noel, Misty Noel, and/or Kasey Noel are all in

the process of and will continue to attempt to dissipate and liquidate

his/her/their assets.

22.Further, Affiant says not.
