Contract Price is Rs. 58,436,468,00 (Rupees Fifty Eight Millon Four Hundred Thity Six Thousand Four Hundred Sixty Eight Only) as given inthe attached Bils of Quantities with preambles (Appendix 1 to this letter) subject to making payment on re-measure basis. 2. Time for completion is 90 days from the issue of the instruction to commence by the Engineer and handing over of the site 3. Other documents applicable for this Contract are as follows: 3.1 CIDA Publication No,CIDA'SBDI02 Second edition January, 2007) 3.2 Specification applicable for Earth Work shall be CIDA Publication no SCAV3I3 2nd Edition (Revised) December 1999 3.3 Speeification applicable for Road Construction shall be CIDA Publication no SCA/S 2nd Eston June 2008 3.4 Particular Specification applicable for Internal Road Construction 3.5 Drawings No HAIGA/LD (RO) for Earth work and Drawing No HA/GA/RL(RO) for Intemal Road Construction (Refer Appendix 2) 3.6 Soil Investigation Report Produced by MKS Civil and Geotechnical Construction (Pvt) Ltd, Dated con 30 July 2018 (Refer Appendix 3) 4, The Contractor to submit Performance Bond for value of 5% of the Contract Price and Validity of the performance bond shall be 90 days of time for completion and 365 days of defects rectcation period. 10. 11 12, 13, 14, 15, ‘The Contractor to submit Contractor's all Risk policy and such insurance shall be in compliance with the Clauses 18 of the CIDA Publication No. CIDA/SBDIO2. Amount for 3¢ Party Insurance is Rs.10,000,000.00 Payment Terms: 2. Interim payments are subject to 10% of Retention to maximum of 5% of the Contract Price. Retention release shall be in accordance with the Sub Clause 14.8 ofthe CIDA Publication No. CIDA/SBDIO2 b. Interim Payment shall be made on fortight basis and payment willbe released within 21 days (07 days for certification by the Engineer and 14 days for the Employer to release payment) of the ‘submission of payment application tothe Engineer by the Contractor. Rates given in the Appendix 1 are fixed and, there willnot be any adjustments due to increase / decrease cf prices of material, labour, lubricant, equipment, currency fluctuation and any other associated cost and expenses etc. except forthe increase / decrease the prices ofthe Auto Diesel Fuel price adjustment will be done base on the Actual consumption records or a formula which willbe ‘mutually agreed by the both parties. Base price of Auto Diesel Rs. 118,00 per liter. APPENDIX — 1 FOR BILL OF QUANTITY & PRICING PREAMBLE Proposed Cement Manufacturing Plant at Hambantota Proposed Cement Manufacturing Plant at Hambantota for Lanwa Sanstha Cement (Pvt) Ltd. Preamble to Bills of Quantities for Earth Work and Internal Road Construction General 1.1. The Bills of Quantities (BOQ) herein, including all notes and instructions, form an integral part of the Contract. However, the descriptions contained in the Bill of Quantities for each item are not necessarily complete. 1.2. The quantities in the BOO are approximate. The basis of payment will be the actual quantities of work ordered and carried out, as measured by the Engineer or his Representative and valued at the rates or prices quoted in the Bills of Quantities. 2. Method of Measurement 3.1. All measurements are net, and the rates shall include for all waste, working space, double randling and trade of traditional allowances. 3.2. Admeasurements of completed work from drawings and / or work at site shall be considered to the nearest centimeter for linear dimensions 3.3. Unit prices and all payment shall be in Sri Lanka Rupees. y— 4, Pricing 4.1. The prices shall be comprehensive and must include for complying in all respects with the instructions to Tenderers, Conditions of Contract, Specifications and Drawings and forall matters and things necessary for the proper construction, completion, and maintenance of the whole of the Works. No claims for additional payment will be allowed for any error or misunderstanding by the Contractor of the work involved. 4.2. The rates and prices inserted in the Bills of Quantities are deemed to include for the following: ‘© Labor and all costs in connection therewith. ‘+ Materials, goods and all costs in connection therewith (e.g. carriage freightage, delivery, unloading, storing, returning, packing, handling, hoisting or lowering, replacing work, goods or materials damaged, broken, lost or stolen until the issue of a Certificate of Completion) ‘© Fittings and fixing materials or goods in position ‘© Construction Equipment, Plant and tools ‘© Waste, bulking, shrinkage and overlaps ‘© Land required for tips and stockpiles including all costs for obtaining any necessary licenses and approvals ‘© Allowance for phasing requirements of works, effect on programming of the work of all traffic diversions and construction activity associated with diversion or installation of services ‘© For taking measures for the support and full protection of pipes, cables and other apparatus required during the progress of the Works as required by Service Authority or the Engineer ‘© Dewatering as required, unless separately inserted and priced by the Tenderer under method related charges ‘© For working alongside and liaising with other Contractors working on the same site ‘© “Preparation and submission of working drawings ‘+ Preparation of as built drawings ‘© Overhead charges and profit ‘ 4.3, The prices and rates entered by the Contractor against items in the Bill of Quantities shall apply ‘throughout the duration of the Contract. 4.4, The rates inserted will be used to determine the amount of the Contractor's Interim Payments. 5. Preliminary and General 5.1. Performance Security (Provisional sum item) Payment for the Performance Security shall be made upon approval ofall the relevant documents by the Employer and actual amount paid to the Bank will be reimbursed after receipt of the documentary evidence to substantiation the amount. gy | 7 5.2. Insurance (Provisional sum). Payment shall be made after receiving comprehensive insurance covers and documentary evidence to confirm that premium with respect to all insurances have been made. Actual amount will be reimbursed after receipt of the documentary evidence to substantiation the amount. 5.3. Utilities (Temporary Electricity, Water, Telephone etc.) a. Payment for establishment costs applicable to such items will be made only after completion of erection/installations and ready for use b. Payment for the consumptions will be proportionate to the gross value of work done 5.4. Temporary Works (site offce, stores, yards, accommodations, sanitary facilites etc) a. Payment for temporary works will be in monthly instalments in a manner to be agreed between the Contractor and the Engineer, prorate to the measured works completed b. All materials supplied by the Contractor for temporary works shall remain in the property of. the Contractor and their removal from site is deemed included in sums and rates ‘Surveying and setting out 6.1. The Contractor is responsible for establishing Temporary Bench Marks within the site area, and, a joint survey shall be carried out by the Contractor and the Engineer before commencement of ‘the works. 6.2. Measurements for excavation and filling work shall be based on the survey level (spot levels) established at grids agreed by both parties. Oversite Excavation 7.1. The quantities of excavation shall be computed net using dimensions from the Drawings with no allowance for bulking, shrinkage, waste or working space. 7.2. Measurements for general excavation shall be from bottom of top soil layer or as determined by the Engineer. 7.3. Measurement for excavation of the top soil shall be as per the thickness mentioned in the Bills of Quantities or determined by the Engineer. 7.4. Excavation in areas which is designated by the Engineer as unsuitable material shall be measured separately. Quantities for unsuitable excavated shall be measured form the drawings based on the areas identified as unsuitable material or as determined by the Engineer. 7.5. All excavations shall be commenced from the existing ground or already filled surfaces where applicable 7.6. Rate for the excavation include the following ‘Excavating by whatever means are necessary including hand excavation in any kind of ‘ground except rock but removal of boulders which could be pushed by 200HP Dozer shall be included ‘Trimming or grading ground to produce level surfaces or falls or slopes ‘+ Keeping free from water including any dewatering as necessary ‘Any hand excavation required around existing services or the like Testing compaction on filled surfaces where necessary (by the Employer) Removing surplus excavated material in the site and stock piled at approved location including obtaining necessary permission from relevant authorities for disposal and dumping of earth Providing due protection to avoid any damages to temporary work, any new or old structures during excavation Working space if required Protection of completed work 8. General Earth Filling 8.1. The quantities of earth filling shall be computed based on the drawings with no allowance for bulking, shrinkage, and waste or working space. Measurement shall be from the bottom of the top soil layer removed 8.2. Rate for filling shall include the following: 9. The quantities of excavation shall be computed net using dimensions from the Drawings with no allowance for bulking, shrinkage, waste or working space. 11.2. Excavation for structures shall commence from the already excavated/filled surfaces 11.3. Rate shall include the following: ‘Excavating by whatever means are necessary including hand excavation in any kind of ground except rock which required blasting but removal of boulders which could be pushed by 200HP Dozer shall be included ‘Trimming or grading ground to receive structural foundation ‘* Disposal of the excavated material to the stock piles located by the Engineer within the site ‘+ Keeping free from water including any dewatering as necessary 12. Sub base 12.1. The quantities of shall be computed net using dimensions from the Drawings. with no allowance for compaction, shrinkage, waste or working space. 12.2. Rate shall include : ‘© Making sub base material by mixing 30% ABC material (supplied by others) with 70% selected earth stocked piled at the site ‘+ Preparation of the subgrade to specified density ‘+ Transportation, laying, spreading and watering as per the levels shown in the drawings ‘+ Compaction to specified density. ‘© Keeping free from water ‘+ Protection of work Ree 13. Aggregate Base Course (ABC) 13.1.The quantities of shall be computed net using dimensions from the Drawings with no allowance for compaction, shrinkage, waste or working space. 13.2.Allowance for compaction and wastage of ABC material to be mutually agreed by the parties prior to commencement of works. However, the maximum limit shall not be more than 35% of the compacted volume.
