Oak Street Colville, WA 99114 Re: Notice to Cease and Desist Defamation Dear Mr. Nickel: It has come to my attention recently that you are personally defaming me to others. This information has come to me a second time, the first time through New Alliance counselors. The information you are maliciously spreading about me is false. It concerns the discovery of a carcass of a dead dog in the trunk of a Mercedes vehicle that I owned when I was jailed, that was immediately towed from my home and repoed. The defamation also concerns your outrageous statements about deplorable conditions on my property, in my new home. These statements have gone from Colville all the way to West Seattle, and worldwide. You have no lawful excuse. All of my pets were found in beautiful, excellent condition during both takings in 2008 and 2010. The statements in the e-mails from rescuers speak the truth. Your statements clearly are not. My property was immaculate. To correct your erroneous information and untruthful statements you continue to disseminate, a dog carcass was discovered by certain persons repoeing my Mercedes vehicle AFTER I WAS SENT TO JAIL. The dog, Lady, was my dog previously spayed and returned to me by SpokAnimal Care on 12/24/08. Lady was a beautiful, quiet, and kind golden retriever. Lady had been traumatized from her previous 85 day impound by Stevens County as had the other dogs. I am told that your Stevens County Sheriff's Detective James Glover, acting on marching orders from your chief prosecutor Tim Rasmussen, demanded that 3rd persons trespassing on my property shoot dogs. There were no dogs on my property that were adjudicated dangerous or potentially dangerous by any competent authority. This unlawful intimidation tactic was under color of law and an abuse of the police power. It was also an unlawful shortcutting of forfeiture procedures under RCW 69.50.505 et seq. I am told that because of the unlawful demands made upon 3rd parties, AFTER I WAS INCARCERATED, Lady was then shot by a person named Corrina Meyers. Lady would not come out from her hiding place because of her fear of people removing her from her home. After the dogs were returned to my home, they were forever changed from their horrific experience. This Corrina Meyers person was no friend of mine; I barely knew of her. I am told from Mike Benson that Corrina Meyers shot Lady point bank after being threatened by Detective Glover, through Tim Rasmussen. Lady's carcass was then placed into the trunk of my Mercedes (who knows why) by someone to remove her from view, while Corrina Meyers and 3rd parties were unlawfully removing the rest of my dogs. Before they could bury Lady, the repo man showed up immediately to repossess all of my financed vehicles. The financial institution became anxious over the long highly publicized jail term and immediately ordered all of vehicles repoed. So the repo man took Lady's carcass down the road with him in my towed vehicle. Apparently, repo agents came onto my property and trespassed through my locked gate when the other rescuers left the property temporarily. Lady never

Lloyd Nickel Page 2 Lady never received a proper burial on the property she was raised on, and she was probably tossed out like some piece of garbage. Lady and the other animals deserved far better than their fate. I received no notice in the jail of any repo of any vehicle of mine so these were unlawful acts on the part of the finance company. I was extremely anguished to learn of Lady's death from Mike Benson, while jailed and unable to protect her and other pets from illegal tactics. I still suffer nightmares and emotional distress about these actions against my pets and livestock, unlawfully ordered removed by Stevens County and this regime, and then tragically lost in transit or killed. There are at least 6 pets of mine that I know of who were either lost or killed. Attached are emails I have gained access to from a member of the network of rescuers involved in this tragedy. The e-mails describe the excellent physical condition, wagging tails and friendly dogs they picked up from my home 90% of them re-homeable described rescuers. The e-mails also demonstrate Stevens County's threats to shoot animals which explains why Corrina Meyers (who was very rattled) felt she was forced to shoot Lady who would not cooperate in being crated. Mike Benson said he couldn't do it as he was attached to Lady. He would never harm a hair on any animal. Mike Benson's Service Dog, Mo, was also transported to Grainger, Washington on the demands of your prosecutor. He was immediately killed on the highway when he tried to run away from his would-be rescuers and was buried and put to rest in Grainger, Washington by a good samaritan. Another tragic and sickening loss - on the orders of Stevens County. Moreover, this is to advise you that I have never bagged up any carcass of any dog of mine. As you are quite aware, testimony in my trial was perjured and video evidence tampered with. I don't have to tell you what occurred in order to get this win. At some point, I will move to appoint a Special Prosecutor to look into perjury by Strongs, Feilers, Frost and Lantz. Further, I will be seeking an inquiry into felony theft by neighbor Terry Feiler of some $3,000 worth of farm fencing on my back 2 acres after I was jailed the same farm fencing that Feiler tried to remove before trial (and which he was ordered to stay 300' away from by the court). I will make special trips from the coast, driving long distances, to bring a complaint before this Court. I have proof now including prior sworn affidavits of the perjury by Lauri Strong, Amy Strong, and Terry and Betty Feiler in this case. I have sworn affidavits of legal professionals about perjury. I have examined the record closely. Finally, it is noteworthy that I never received any information from your office about your personal knowledge that Feilers had made prior false allegations in another superior court case, lying to a polygraph examiner. Those polygraph results were filed on the superior court record to which Feilers objected. The case brought by Feilers was subsequently dismissed because of Feilers' fraud and deceit upon the court. Second the owner is in jail over these dogs for a very long time. I am a person helping to find homes before the sherriff picks the dogs up on March 5, 2010. I cannot give discriptions of all the dogs, but I will give you some examples. Bunny is a 3 year old spayed female retriever cross very quiet and housebroke ( very nice dog) she is very light in color. Dillion is a 7 month old not nuetered weinheimer cross very large and brown in color and a nice dog. There are dogs of various ages some spayed and nutered some are not. There is a bunch of 8 week old puppies. All colors and sizes. PLEASE HELP US TO FIND HOMES FOR SOME OF THESE DESERVING DOGS BEFORE ITS TO LATE>...

I just talked with the lady who is trying to place these dogs. They are in Steven's County, Wa. 5522 Walbridge. The Sherrif just gave her orders to shoot ... She sounded very rattled to say the least. I am going to be away from the computer for a few hours, don't know if I can get there to take pictures or not. The lady, Corrina, can not as she is with them and away from her home to get computer access. We have been out to see them. They Sheriff has been hassling the folks trying to get them homes, so they need to be out of there ASAP. We went there and the dogs are very sweet, just scared. The Sheriff has harassed the dogs, the folks trying to save them were helpful and nice. I guess Spokanimal is taking the puppies in the morning. My husband went inside, there were more dogs inside than out. Most of them were very nice, timid, and need to be in quiet safe settings. Neither my husband or I felt intimidated by these dogs at all. And we don't do big dogs. Their tails were wagging.... They have nearly 50 and we feel that 90% of them are rehomable. They were wagging their tails and some of them wanted petting...Again, they have until March 5th. ... Lona
