Sir;
In relation to OCA Circular 107-2023, directing all first and second level
courts to hear, try, and decide cases reported as pending as of March 9,
2023 and considering that the Covid-19 cases have decreases in many
parts of the country, particularly ILOILO PROVINCE which was under alert
level 2.
The court hereby directs your office to bring the body of the accused in
court to attend his/her schedule hearing effective May 29 2023.
Let it be noted that under Rule 115 of the Rules of Court the accused has
the right to be present and defend in person and by counsel at every stage
of the proceedings.
Further, for your guidance, as much of this court wants to comply with the
OCA Circular 107-2022 the court was placed into heavy-handed situation
considering that this is a single-sala court. To provide a just and adequate
decision the court hear, try and decide cases only in practicable condition.
