Libya - Sanctions

Further to the News Summary Issue No. 421, 10 March 2011, the EU has now extended the sanctions against Libya. The Council of the European Union agreed Council Decision 2011/332/CFSP on 7 June 2011. Under the new sanctions, trading with Libya is prohibited, unless authorised by the appropriate authority, if it involves: (a) trading directly with designated persons/entities; (b) trading with entities that are owned or controlled by designated persons such as Colonel Qadhafi; or (c) making or receiving payments through designated Libyan state banks. There is no prohibition against making payments to ports not listed above. The relevant competent authority will be able to grant exemptions from the asset freeze affecting the port authorities in respect of existing contracts until 15 July 2011. An existing contract is one which was concluded before the date of the

Regulation coming into force. The exemption does not, however, apply to contracts relating to oil, gas and refined products. The Norwegian Maritime Directorate issued a circular on 8 June 2011advising that from that date, it is mandatory for all ships registered under the NIS or the NOR flag operating in the piracy high risk area as defined in Best Management Practices, version 3,to register with MSCHOA and to report to the UKMTO office in Dubai. MSCHOA: Instructions for updated Vessel Movement Registration Form In accordance with paragraph 1.3 of Best Management Practice3,please note the following change to paragraph 6.3 and 7.2 regarding the registration instructions and procedures for vessel registration at MSCHOA. It is recommended for every ship that transits through the High Risk Area to register at MSCHOA upon entry. An updated registration procedure has been introduced on the MSCHOA Vessel Movement Registration Form. The form is unchanged except for the following: Entry point to High Risk Area (HRA) ETA to HRA Exit Point from HRA ETD from HRA Do you intend to transit the Internationally Recommended Transit Corridor (IRTC)?

The entry/exit points are in accordance with the area defined in paragraph 2.3 of BMP3 (Suez,23N,78E,10S). If the transit starts/completes in a port inside HRA, option Port should be selected. If the checkbox for Do you intend to transit the IRTC? is selected, additional fields are shown for the details of the transit (ETA,ETD for IRTC and Direction).
