By Angela Macdonald, Examiner.com The FBIs statistical data shows crime is down across California, and areas of country with most medical marijuana states. Theres a lot of concern from citizens far removed from the medical marijuana movement regarding crime associated with new changes in the law. After over 70 years of misinformation and propaganda its no wonder confusion is so rampant. With the exception of a few dispensaries being robbed, there have been no noticeable increases in crime near dispensaries. The simple fact that dispensaries have existed for such a short period in history also makes it very difficult to associate any increase in crime with dispensaries. Additionally, sources like CNN have released stories this year about the possibility of an increase in crime in large cities being associated with the economy. How can one differentiate any increase in crime when factors like the economy exist. For this same reason is is impossible to say that dispensaries actually decrease crime either. The theory that dispensaries cause crime leaves to question all the areas in the country with an increase in crime, but without any medical marijuana dispensaries. Unless a dispensary is directly involved in some sort of criminal activity it is impossible to say if crime increased in any area solely due to the dispensary. If crime were on an upward swing this would all matter, but crime is actually down and mostly so in the region of the United States where dispensaries exist. Lets take the FBIs Preliminary Annual Uniform Crime Report. According to the data, the western area of the United States saw the greatest decrease in murders, and came in second to the mid-west in greatest decrease in violent crimes, aggravated assaults, and larceny. Given the fact that the majority of the western states (CA, OR, WA, MT, NV, NM, and CO) in the country have legalized medical marijuana, it seems if legalizing medical marijuana causes crime there would be an increase in these crimes, not a decrease. More importantly, this area shouldnt be the part of the country with the greatest decline if medical marijuana causes crime. Since California has had legalized medical marijuana the longest, the data for this state was run through the Angela Macdonald number cruncher. If anything, the data shows quite the opposite. Logic determines that when a crime is no longer a crime there will be less criminals. What does it say when the primary reason produced by most of the counties, cities, and towns to support banning dispensaries is completely unfounded? What will the next excuse be?

The study on which the RAND report is based claims that crime was as much as 60 percent greater around medical marijuana dispensaries that had been shut down by the City of Los Angeles compared to those areas with open dispensaries. [W]e found no evidence that medical marijuana dispensaries in general cause crime to rise, said Mireille Jacobson, the studys lead author and a senior economist at RAND. RANDs study, which challenges the common wisdom that medical marijuana dispensaries promote criminal activity, affirms the findings of patient advocates. We have reached the same conclusions as RAND using a qualitative study of public officials with firsthand experience of how dispensaries reduce crime in their neighborhoods, said Steph Sherer, Executive Director of Americans for Safe Access (ASA), the countrys leading medical marijuana advocacy group. According to a statement from RAND, the study examined crime reports for the 10 days prior to and the 10 days following June 7, 2010, when the city of Los Angeles ordered more than 70 percent of the citys 638 medical marijuana dispensaries to close. Researchers analyzed crime reports within a few blocks around dispensaries that closed and compared that to crime reports for neighborhoods where dispensaries remained open. In total, RAND said that researchers examined 21 days of crime reports for 600 dispensaries in Los Angeles County 170 dispensaries remained open while 430 were ordered to close. RAND calls its study the first systematic analysis of the link between medical marijuana dispensaries and crime, however Los Angeles Police Chief Charlie Beck conducted his own study in 2010 comparing the levels of crime at the citys banks with its medical marijuana dispensaries. Chief Beck found that 71 robberies had occurred at the more than 350 banks in the city, compared to 47 robberies at the more than 500 medical marijuana facilities. At the time, Beck observed that, banks are more likely to get robbed than medical marijuana dispensaries, and the claim that dispensaries attract crime doesnt really bear out. Alpha brain waves are considered relaxed brainwave activity. Alpha brainwaves are brainwaves that cycle within the range of 8 12 Hz and are usually generated in the brains right hemisphere or in a synchronized pattern between both right and left hemispheres. Alpha waves kick in when our mind and body are completely relaxed and free of stress. Alpha is generally thought of as the normal brainwave that is dominant in people who are relaxed, creative, and have a clear mind. Alpha is considered the normal brainwave pattern and is dominant when people close their eyes. Children tend to have much higher levels of alpha brainwaves than adults. Alpha brainwaves are considered the healthiest brainwave range and 10 Hz has widely been accepted as the safest brainwave frequency to train. Most children and younger teenagers have a dominant alpha rhythm. There isnt a single brain wave pattern is better than the others so dont think alpha brainwaves are a cure all. The body is completely relaxed and free of all tension and nervousness. Boosting the alpha brain wave is a great way to enjoy the feeling of relaxation and a great way to let go of all worries and tension.
PEAK-PERFORMANCE
The 10 Hz alpha brainwave frequency is commonly referred to as a peak performance state of mind or being in the zone. There has been conclusive evidence from studies with professional basketball players and golfers that show alpha brainwaves increasing in their left hemispheres just before making a free-throw or shooting a great golf shot. In players that did not make the shot, beta brainwaves ooded their left-hemisphere. It seems that over thinking (beta brainwaves) or under thinking (theta brainwaves) are detrimental to gameplay. The study was also proved by comparing elite marksmen to novice marksmen. The elite marksmen showed a big burst of alpha in their left-brain hemisphere before their perfect shots. Professional athletes are much more likely to show the alpha rhythm, while novices and intermediate players show virtually none! It seems that the 10 Hz alpha brainwave is the best brainwave for athletes and marskmen looking to improve their performance and overall game.
CHILDREN
Children tend to have much higher amounts of alpha and theta brainwaves than the average population. As we age, our beta brainwave pattern tends to increase and dominate the other patterns. That is why many adults would de nitely bene t from an alpha brainwave increase more than a younger person. Just like any of the other brainwave patterns, too much of a dominant rhythm can cause problems. By no means would it be recommended to increase a brainwave that you already have high levels of. In fact, you may experience some negative affects from the alpha brainwaves.
POSITIVE THINKING
There has been some research that has found the alpha brainwave rhythm, especially the 10 Hz frequency, to be associated with a positive state of mind (i.e. positive thoughts), a positive mood, and an overall feeling of wellness. In my experience with alpha brainwaves, the positive thoughts

Deep breathing is not only great for improving overall oxygen levels in the brain and body, it is great for achieving a state of relaxation. When you make deep-breathing a habit, you will begin to feel more relaxed and your brainwaves will shift from the somewhat stressful beta brainwaves to the alpha rhythm.

SMOKING MARIJUANA
Though there is controversy as to whether or not smoking marijuana is good or bad, I personally dont consider marijuana or any other illegal substance to be healthy. Smoking marijuana does increase alpha brainwaves, which is why smoking marijuana makes people feel relaxed. Marijuana will not give you the aware, synchronized, peak-performance alpha brainwave that most people are striving for.
DEPRESSION
High amounts of alpha brainwaves in conjunction with relatively little beta brainwave
activity has been linked to depression. Though peak-performers are able to generate a big burst of alpha in their left hemisphere right before their best shots, too much alpha activity in the left-hemisphere of the brain has been linked to depression. If you are depressed from being overstimulated, alpha will probably help you out, if you are too understimulated, I suggest staying away from alpha and sticking to beta waves.
TIREDNESS
The alpha brainwave pattern has been linked to tiredness and drowsiness in some individuals. If you are working to increase your alpha and you notice yourself becoming tired or drowsy, it may be temporary and your brain is most likely readjusting to t the new pattern. With that said, alpha brainwaves are the brainwaves that are naturally produced right after you close your eyes to fall asleep.
MEDITATION
The goal of most types of meditation is to lower the brainwaves into the alpha-theta brainwave range. A very safe, healthy way to increase your alpha brainwaves is to make meditation a daily habit or start up a meditation routine. If you are already meditating, great! Youll naturally increase exibility with your alpha brainwaves as you continue the process.
LACK OF EXCITEMENT
Though it is usually rare, some people may run into the problem of not feeling excitement for awhile. After my personal experience with alpha brainwaves, I felt super relaxed and unexcited for a couple weeks. It de nitely helped calm my mind, but I did miss the feeling of excitement.
SELF-HYPNOSIS
The goal of self-hypnosis is to target the lower brainwave ranges (i.e. alpha and theta). Doing self-hypnosis on a consistent basis will de nitely help you reduce stress by increasing the natural amount of your alpha brainwaves.
VISUALIZATION
Every time that you close your eyes and visualize, alpha activity signi cantly increases. If you are the type of person that often enjoys shutting your eyes to imaging or picture things, youll have a naturally higher amount of alpha brainwave activity than others. Visualization can go hand-inhand with a meditation practice, but if youd rather only visualize, youll still be boosting your alpha brainwaves!
WATCHING T.V. After just 30 seconds of watching T.V., your brains alpha brainwaves kick in. Even if you happen to be reading captions or text on the T.V. screen, the alpha waves still kick in! Normally, beta brainwaves kick in while reading, but not while reading on T.V. All radiant light from cathode-ray technology in T.V.s and other appliances automatically cause the brain to idle and shift to the alpha rhythm. I personally dont consider watching T.V. to be the best way to increase your alpha brainwaves, but Im not going to put it in the unhealthy category. UNHEALTHY WAYS TO INCREASE ALPHA BRAINWAVES: DRINKING ALCOHOL
In moderation, alcohol probably wont kill your precious brain cells, but it isnt a healthy activity for your body or your brain. Alcohol is a huge alpha brainwave booster. Are you a person that is constantly getting drunk to relax? Alpha brainwaves are the
OVERLY RECEPTIVE
In the alpha brainwave state, your brain may be overly receptive to suggestions and new information. Being overly receptive isnt always a good thing and can make your subconscious more open to accepting negative suggested beliefs.
YOGA
Like meditation, yoga is yet another activity that promotes relaxation and wellbeing by shifting your brainwaves to the calming patterns of alpha and theta. There are many different types of yoga, and if practiced right, theyll de nitely allow you to tap into your alpha awareness.

The human brain is a wondrous and complex organic computer that governs every motion of our bodies. Within this computer there is a virtual storm of electrical, magnetic, and chemical activity. This storm of seeming chaotic activity is a big part of what gives us order in our lives. Since the early 1900s doctors and scientists have been able to look into the brain and view this activity, in hopes to decipher why people do one thing verses another. While the doctors and scientists were probing the regions of the brain they found out that for the most part the activity detected was composed of many different frequencies of rhythmic and non-rhythmic waves or pulsations ranging from 0.2 to several hundred hertz. These pulsations were further broken down into individual categories for easier study and for there particular properties. These categories are the Beta, Alpha, Theta, and Delta waves. The rst type of brain wave is the Beta wave. This wave is in the range of approximately 10-30 hertz or pulses per second, sometimes Beta waves are also referred to those frequencies up into the hundreds of hertz. The mental activity normally assoiated with Beta waves is the active awareness state that we experience from day to day at work and play. There are many external chemicals that can be induced into the brain to produce this state and they are known generally as stimulants. Some of those stimulants are small amounts of alcohol, the nicotine in cigarettes, caffeine in coffee and tea, diet pills, and aphetamines (which are illegal). The second type of wave and I should say the most widely known and publicized is the Alpha wave. Most people equate this wave with ESP, meditation, and all sorts of strange ideas. The truth is the alpha waves account for only half the story. Alpha ranges between 7-12 hertz and is prominent during relaxation mostly with eyes closed, day dreaming, and upon deep self-introspection. The 1960s made this activity famous when it was found out that cannabis or marijuana, which grew naturally, induced this state in people. Ive already mentioned that the Alpha was half the story, well the Theta wave is the other half of a state of mind that brings about creativity, intelligence, and a host of other abilities the brain is capable of doing when properly stimulated. The lowering of sensory input serves to normally protect the central nervous system from sensory overload caused by stress or physical damage. This range is between 7-8 hertz and this is not so surprising when you learn that the resonant frequency of the earth and ionosphere is approximately 7.5 hertz. As it were LD was treated with 10 mg./day Dexedrine spansules (time release). I showed marked improvement in concentration and my grades went from Cs & Ds to As & Bs. The medication made me feel like I was in fast gear while under its influence. I took this medication from middle school age through High School. After High School I decided to work rather than going to college. After working labor type jobs for a few years, during which time I was introduced to Cannabis, I decided to attend a four year college. I majored in Computer Science, a very difficult subject. I graduated with my BS in CS. I went on to get my MBA (Business) and also achieved this degree. Heres my point, I used Cannabis every day (in moderation) during college, while studying for t! ests, taking tests and while coding huge 1000+ lines of computer program code As your . article states Cannabis calms the mind and allows focus and circumspection for the ADD afflicted individual. I never had ADHD as a kid, instead I was diagnosed with AADD (adult attention deficit disorder) when I was 22. I started ritalin, and actually started smoking grass around the same time. It worked, I made the dean list, then took a 100% commission sales job and made about a half a million bucks in 2 years. Im now 31, and still take ritalin, although Im getting tired of it. Pot has the same focusing effect, its natural, and I have clearer hyperfocusing. Since I loathe the smoking part, Im about to try a vaporizer. I actually met with the same therapist who diagnosed AADD, just last week, and talked about finding a way to get marijuana prescribed to me, to replace ritalin. He absolutely agreed! http://blogs.alternet.org/ By Paul Armentano The results of a series of randomized, placebo-controlled clinical trials assessing the efficacy of inhaled marijuana consistently show that cannabis holds therapeutic value comparable to conventional medications, according to the findings of a 24-page report issued earlier today to the California state legislature by the California Center for Medicinal Cannabis Research (CMCR). Four of the five placebo-controlled trials demonstrated that marijuana significantly alleviated neuropathy, a difficult to treat type of pain resulting from nerve damage. There is good evidence now that cannabinoids (the active compounds in the marijuana plant) may be either an adjunct or a first-line treatment for neuropathy, said Dr. Igor Grant, Director of the CMCR, at a news conference at the state Capitol. He added that the efficacy of smoked marijuana was very consistent, and that its pain-relieving effects were comparable to the better existing treatments presently available by prescription. A fifth study showed that smoked cannabis reduced the spasticity associated with multiple sclerosis. A separate study conducted by the CMCR established that the vaporization of cannabis a process that heats the substance to a temperature where active cannabinoid vapors form, but below the point of combustion is a safe and effective delivery mode for pa tients who desire the rapid onset of action associated with inhalation while avoiding the respiratory risks of smoking. Two additional clinical trials remain ongoing. The CMCR program was founded in 2000 following an $8.7 million appropriation from the California state legislature. The studies are some of the first placebo-controlled clinical trials to assess the safety and efficacy of inhaled cannabis as a medicine to take place in over two decades. Placebo-controlled clinical crossover trials are considered to be the gold standard method for assessing the efficacy of drugs under the US FDA-approval process. These scientists created an unparalleled program of systematic research, focused on science-based answers rather than political or social beliefs, said former California Senator John Vasconcellos, who sponsored the legislation in 1999 to launch the CMCR. Vasconcellos called the studies design state of art, and suggested that the CMCRs findings ought to settle the issue of whether or not medical marijuana is a safe and effective medical treatment for patients. This (report) confirms all of the anecdotal evidence how lives have been saved and pain has been eased, said California Democrat Senator Mark Leno at the press conference. Medical marijuana has been proven in numerous studies to be a viable treatment for many medical conditions. Yet, it is one drug that has had a dif cult time being approved for medical use around the world. There have been far more scienti c studies, clinical trials and other data that has proven medical marijuana works as an anti-cancer medication, an anti-in ammatory, it is able to help shrink tumors, stop nausea, and reduce pain and other disease symptoms. The use of medical marijuana has not been approved in many states in the United States, but other drugs with less testing and severe side effects have been approved to treat conditions that marijuana could treat without the side effects. While the battle continues whether to legalize marijuana for medical use, the largest thing that is forgotten is the science proving that medical marijuana is not addicting like other medications, it does work effectively and without side effects. Medical Marijuana and Nutrition Medical marijuana has been proven in study after study to help with medical conditions that involve what is termed wasting. This is a condition that the eating is poor due to anorexia, chemotherapy and other medical conditions. In studies that have been done for these diseases show that marijuana and its active properties effectively can increase the appetite. The studies also showed that unlike other medications that may be used to treat poor appetite medical marijuana does not have any side effects and is able to treat other symptoms of disease such as pain, muscle spasms, anxiety and other symptoms. In the studies that have been done patients showed a marked improvement in their weight gain. The researchers have published articles to the effect that medical marijuana could be a long term medication of nutritional value. In many cases medical marijuana works more effectively and without side effects compared to the prescription medication that would be used.

This is a medicine that has been used since ancient times and now is being investigated to find what medical conditions it can be used to treat. The use of medical marijuana for its antibiotic properties has been recently researched at Italys Universita del Piemonte Orientale and in the Britain University of London School of Pharmacy. this is where the antibacterial properties of medical marijuana were assessed. All five of the cannbinoids showed potent antibacterial activity, according to the study data. MRSA is a resistant variation of the common bacterium Staphylococcus aureus that according to the 2007 study that was published in the Journal of the American Medical Association is responsible for over 18,500 death per year. medical marijuana and Hypertension Hypertension is more commonly known as high blood pressure and is a contributing factor to many illnesses, like cardiovascular disease. This is a condition where internal pressure is exerted on the walls of the arteries and veins, when the blood pressure fluctuates due to the rise and fall of physical activity. Scientific studies have proven that medical marijuana is able to help hypertensive patients, which is normally treated with a combination of medicines and other changes, including stress management, the use of salt in the diet and cholesterol, and weight reduction. Medical marijuana has been proven to reduce hypertension to normal levels when it is used regularly and to maintain its normal level. However, few physicians prescribe medical marijuana to reduce a high blood pressure. This is due to the laws making it illegal and the pressure that they are under to describe medical marijuana for only certain medical conditions.

There are studies being conducted in to the use of medical marijuana for women with severe premenstrual syndrome. These women that suffer a severe form of this condition have traditionally been prescribed medications like anti-depressants including Valium, which was not effective for treatment, but was addicting. During the studies that have been conducted and history proves that medical marijuana is able to effectively treat severe PMS. Medical marijuana has been studied to see what symptoms it can reduce for stroke patients that conventional medications might be ineffective in treating. One of the most involved human trials showed great promise with the use of medical marijuana for treatment of the symptoms of stroke patients. The study of marijuana found that it has properties like the THC contained in the marijuana that was effective in the treatment of stroke patients symptoms, including the possible muscle spasms that can occur due to the effects of the stroke. medical marijuana and Osteoporosis Osteoporosis is a degenerative skeletal disease that involves the deterioration of bone tissue. There is a potential risk of suffering multiple fractures and other serious disabilities by patients suffering from Osteoporosis. According to the U.S. Surgeons Generals Office there are approximately 10 million Americans over the age of 50 that suffer from osteoporosis and there are approximately 34 million people at risk for developing the disease. of municipalities to regulate the distribution of medical cannabis to patients. The new law, AB 1300, says the state of California cannot prevent cities and other local governments from adopting and enforcing local ordinances that regulate the location, operation, or establishment of a medical marijuana cooperative or collective.
ASA opposed this bill because it did not do enough to protect critical patient services, said ASA California Director Don Duncan. But recognizing the legitimate role of Californias more than 1,000 storefront dispensaries and delivery services is an important step. Currently, more than 50 California localities have ordinances regulating the distribution of medical marijuana, and more than 90 local governments are considering such regulatory laws. Research conducted by ASA found that dispensary regulations not only benefit the thousands of patients across the state, but also help to reduce crime and improve the neighborhoods surrounding such facilities.

An act to amend Section 11362.785 of, and to add Section 11362.787 to, the Health and Safety Code, relating to medical marijuana. AB 2279, as amended, Existing law, the Compassionate Use Act of 1996, provides that a patient or a patient's primary caregiver who possesses or cultivates marijuana for personal medical purposes of the patient upon the written or oral recommendation or approval of a physician is not subject to conviction for offenses relating to possession and cultivation of marijuana. Existing law requires the State Department of Public Health to establish and maintain a voluntary program for the issuance of identification cards to patients qualified to use marijuana for their personal medical purposes, and to their primary caregivers, if any. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: The definitions in this section apply throughout this chapter unless the context clearly requires otherwise. Defined relationship means that the parties have agreed to become collective members and shall cultivate, manufacture, sell, dispense, distribute, transport, or deliver marijuana and marijuana products on behalf of other members who are qualified patients and/or primary caregivers, as provided by as provided for under California Health and Safety Code 11362.765 The Department means the California Department of Food and Agriculture. The Division means the Inspection Services Division of the California Department of Food and Agriculture. "Dispense" means the selection, measuring, packaging, labeling, delivery, or distribution or sale of marijuana by a Medical Cannabis Dispensing Collective, a Medical Cannabis Delivery Collective, a Medical Cannabis

cannabis products for their own individual use or for the use of a patient under their care. Visiting Qualified Patient means a person with a medical condition who is currently participating in another states medical marijuana program, and is in possession of a valid out-of-state medical marijuana program identification card or its equivalent. EMPLOYMENT SECTION 1. Section 11362.785 of the Health and Safety Code is amended to read: 11362.785. (a) Nothing in this article shall require any accommodation of any medical use of marijuana on the property or premises of any place of employment or during the hours of employment, except as provided in Section 11362.787, or on the property or premises of any jail, correctional facility, or other type of penal institution in which prisoners reside or persons under arrest are detained. (b) Nothing in this article shall require a governmental, private, or any other health insurance provider or health care service plan to be liable for any claim for reimbursement for the medical use of marijuana. SEC. 2. Section 11362.787 is added to the Health and Safety Code, to read: 11362.787. (a) Notwithstanding subdivision (a) of Section 11362.785, and except as provided in subdivision (c), it is unlawful for an employer to discriminate against a person in hiring, termination, or any term or condition of employment or otherwise penalize a person, if the discrimination is based solely upon either of the following: (1) The person's status as a qualified patient or a designated primary caregiver. (2) The person's positive drug test for marijuana, provided the person is a qualified patient and the medical use of marijuana, as defined in Section 11362.7, does not occur on the property or premises of the place of employment or during the hours of employment, as required by Section 11362.785. (b) A person who has suffered discrimination in violation of

Manufacturer, or a Medical Cannabis Cultivator, as defined by this act, to a qualifying patient or a primary caregiver. "Labeling" means all labels and other written, printed, or graphic matter (a) upon any marijuana intended for medical use, or (b) accompanying such marijuana. Medical Cannabis Cultivator means any individual or not for profit entity organized to cultivate, dispense, and deliver marijuana and marijuana products for medical use to Medical Cannabis Delivery Collectives, Medical Cannabis Dispensing Collectives, or Medical Cannabis Product Manufacturers, or their own qualifying patients and/or primary caregiver members. Medical Cannabis Delivery Collective means any not for profit entity organized to cultivate, dispense, and deliver marijuana and marijuana products for medical use to patients and their primary caregivers who are members. Medical Cannabis Dispensing Collective means any not for profit entity organized to cultivate and dispense marijuana and marijuana products through storefronts for medical use to patients and their primary caregivers who are members. "Medical cannabis products" means products that contain marijuana or marijuana extracts, and are intended for human consumption or application, including, but not limited to, edible products, tinctures, and lotions. Medical Cannabis Product Manufacturer means any person or not for profit entity organized to manufacture medical cannabis products meant for dispensing within Medical Cannabis Dispensing Collectives and/or Medical Cannabis Delivery Collectives and/or directly to the manufacturers qualified patient and/or primary caregiver members, if organized as a collective. Medical Cannabis Product Manufacturers shall be members or have a defined relationship with Medical Cannabis Dispensing Collectives and/or Medical Cannabis Delivery Collectives, as provided for under California Health and Safety Code 11362.765(b)(3). Medical Cannabis Product Manufacturers may be members or have a defined relationship with Medical Cannabis Cultivators. Medical Cannabis Product Manufacturers do not include qualified patients and primary caregivers who produce medical

subdivision (a) may institute and prosecute in his or her own name and on his or her own behalf a civil action for damages, injunctive relief, and any other appropriate equitable relief to protect the peaceable exercise of the right or rights secured. (c) (1) Paragraph (2) of subdivision (a) shall not apply when an employer employs a person in a safety-sensitive position. (2) For purposes of this section, a safety-sensitive position means a position in law enforcement, as defined in subdivision (d) of Section 13951 of the Government Code, or a position in which medical marijuana-affected performance could clearly endanger the health and safety of others. A safety-sensitive position shall have all of the following general characteristics: (A) Its duties involve a greater than normal level of trust, responsibility for, or impact on the health and safety of others. (B) Errors in judgment, inattentiveness, or diminished coordination, dexterity, or composure while performing its duties could clearly result in mistakes that would endanger the health and safety of others. (C) An employee in a position of this nature works independently, or performs tasks of a nature that it cannot safely be assumed that mistakes like those described in subparagraph (B) could be prevented by a supervisor or another employee. DUI MJ SECTION 2. Section 23152 of the Vehicle Code, subdivision (b) is amended to include: Nothing in this chapter shall authorize the operation of a vehicle while under the influence of marijuana. A qualified patient shall not be considered to be operating a vehicle under the influence solely for having marijuana metabolites in his or her system, being a qualified patient, or being in possession of marijuana. HOUSING SECTION 3. Add Section 11362.84 to the Health and Safety Code: A qualified patient or primary caregiver shall not be subject to any civil

penalty, including but not limited to the loss of property, or eviction solely for one or more of the following: 1)testing positive for marijuana use, or 2)for being a qualified patient or primary caregiver, or 3)for exercising rights as defined by Section 11358 of the Health and Safety Code, or 4)for use of marijuana, or 5)as an employee or agent of a Medical Cannabis Dispensing Collective, Medical Cannabis Delivery Collective, Medical Cannabis Cultivator, or Medical Cannabis Product Manufacturer. CHILD CUSTODY SECTION 4. Section 3011 of the California Family Code, subdivision (d), is amended to read: The habitual or continual illegal use of controlled substances or habitual or continual abuse of alcohol by either parent. Before considering these allegations, the court may first require independent corroboration, including, but not limited to, written reports from law enforcement agencies, courts, probation departments, social welfare agencies, medical facilities, rehabilitation facilities, or other public agencies or nonprofit organizations providing drug and alcohol abuse services. As used in this subdivision, "controlled substances" has the same meaning as defined in the California Uniform Controlled Substances Act, Division 10 (commencing with Section 11000) of the Health and Safety Code. As used in this subdivision, habitual or continual illegal use of controlled substances does not include the following: 1)testing positive for marijuana use, or 2)for being a qualified patient or primary caregiver, or 3)for exercising rights as defined by Section 11358 of the Health and Safety Code, or 4)for use of marijuana, or 5)as an employee or agent of a Medical Cannabis Dispensing Collective, Medical Cannabis Delivery Collective, Medical Cannabis Cultivator, or Medical Cannabis Product Manufacturer. RECIPROCITY SECTION 5. Add Section 11362.85 to the Health and Safety Code: A visiting qualified patient shall have the same rights and privileges under

SECTION 7. Add Section 11362.87 to the Health and Safety Code: For the purposes of medical care, including organ and tissue transplants, a qualified patients authorized use of marijuana shall be considered the equivalent of the authorized use of any other medication used at the direction of a physician, and shall not constitute the use of an illicit substance. COLLECTIVE MEMBERS DUTIES SECTION 8. Add Section 11362.776 to the Health and Safety Code: Qualified patients and primary caregivers who associate within the State of California in order to collectively or cooperatively cultivate marijuana for medical purposes as stated in section 11362.775, may share responsibility for acquiring and supplying the resources required to produce and process marijuana for medical use such as, for example, money, a location for a collective garden; equipment, supplies, and labor necessary to plant, grow, and harvest marijuana; marijuana plants, seeds, and cuttings; and equipment, supplies, and labor necessary for proper construction, plumbing, wiring, and ventilation of a garden of marijuana plants. It is the sole discretion of the collective or cooperative to determine the requirements for membership within the collective or cooperative, and responsibilities and duties may be carried out by any or all members of the collective or cooperative. It is also within the discretion of the collective or cooperative to determine allocation of the costs and benefits of the efforts of the collective or cooperative, including the allocation of reasonable compensation for services rendered amongst those associated. FEES SECTION 9. Add Section 11362.711 to the Health and Safety Code: Any and all governmental fees and taxes related to the registration or regulation of qualified patients and primary caregivers or Medical Cannabis Dispensing Collective shall be used only to recover the cost of the services provided, including education, inspections, and civil enforcement of standards under this article. Add Section 11362.86 to the Health and Safety Code: The fact that a person is a qualified patient or primary caregiver, or is the employee or agent of a Medical Cannabis Dispensing Collective, Medical Cannabis Delivery Collective, Medical Cannabis Cultivator, or Medical Cannabis Product Manufacturer does not, alone: (a) Constitute probable cause to search the person or the persons property; or (b) Subject the person or the persons property to inspection by any governmental agency. Except as otherwise provided in this subsection, if officers of a state or local law enforcement agency seize marijuana, drug paraphernalia or other related property from a person engaged or assisting in the medical use of marijuana: (a) The law enforcement agency shall ensure that the marijuana, drug paraphernalia or other related property is not destroyed while in the possession of the law enforcement agency. (b) Any property interest of the person from whom the marijuana, drug paraphernalia or other related property was seized must not be forfeited pursuant to any provision of law providing for the forfeiture of property, except as part of a sentence imposed after conviction of a criminal offense. (c) Upon a determination by the district attorney of the county in which the marijuana, drug paraphernalia or other related property was seized, or the district attorneys designee, that the person from whom the marijuana, drug paraphernalia or other related property was seized is engaging in or assisting in the medical use of marijuana in accordance with the provisions of this chapter, the law enforcement agency shall immediately return to that person any usable marijuana, marijuana plants, drug paraphernalia or other related property that was seized. For the purposes of paragraph (c) of subsection 2, the determination of a district attorney or the district attorneys designee that a person is engaging in or assisting in the medical use of marijuana in accordance with the provisions of this chapter shall be deemed to be evidenced by: (a) A decision not to prosecute; (b) The dismissal of charges; or (c) Acquittal. (a)Cities and counties within the State of California may enact regulations and ordinances governing the manufacturing and labeling of medical cannabis products. (b)The manufacture of edible medical cannabis products shall be regulated as the type of food or beverage being manufactured, and no additional requirements made. The same exemptions made by the California Retail Food Code shall apply, both as to the size of manufacture and the intent of the manufacturer. (c)Enforcement of Section 11362.893 shall be determined by California Retail Food Code 113713. Any violation of these regulations and ordinances shall not be deemed a violation of California Health and Safety Code 11362.765. Nothing in this article shall prevent a city or other local governing body from adopting and enforcing laws consistent with this article. CULTIVATION Section 14. Add Section 11362.895 to the Health and Safety Code: (a) Medical Cannabis Cultivators fall within three classes. Class 2 and Class 3 registration shall be renewable annually. Registration classes are as follows: (1) Class 1. Less than 25 qualified patients and primary caregivers wishing to collectively cultivate marijuana plants and manufacture medical cannabis products for exclusive use by their members are exempt from registration with the Department of Food and Agricultures Inspection Services Division. (b)Class 2. Collectives of qualified patients and primary caregivers with between 25 and 50 members, the collective shall register with the Department. The application for a Class 2 registration shall include the name of at least 1 collective or cooperative member, the address and contact information for that member, a statement that the collective wishes to

cultivate collectively and is seeking a Class 2 registration, and any accompanying fees necessary, as determined by the Department. Accompanying this application, the collective shall submit copies of each collective members recommendation, or, in the alternative, documentation of a defined relationship with one or more Medical Cannabis Dispensing Collective(s) and/or Medical Cannabis Delivery Collective(s) and/or Medical Cannabis Product Manufacturer(s). Renewal procedures shall be determined by the Department. (c)Class 3. Collectives of qualified patients and primary caregivers with more than 51 members, the collective shall register with the Department. The application for a Class 3 registration shall include the name of at least 5 collective or cooperative members, the address and contact information for those members, a statement that the collective wishes to cultivate collectively and is seeking a Class 3 registration, and any accompanying fees necessary, as determined by the Department. The Department shall determine a graduated fee scale for Class 3 registration applicants. Accompanying this application, the collective shall submit copies of each collective members recommendation, or, in the alternative, documentation of a defined relationship with one or more Medical Cannabis Dispensing Collective(s) and/or Medical Cannabis Delivery Collective(s) and/or Medical Cannabis Product Manufacturer(s). The Department shall promulgate regulations in order to regulate Class 3 registrations. These regulations may include inspections and quality controls as well as requirements for defined contractual relationships with Medical Cannabis Dispensaries and security requirements. RESCHEDULING SECTION 15. Add Section 11362.85 to the Health and Safety Code: The State Board of Pharmacy shall classify marijuana as a controlled substance in Schedule III, IV or V. The State Board of Pharmacy shall classify marijuana no later than 180 days after the effective date of this chapter.

Los Angeles, CASeptember 7James Shaw, director of the Union of Medical Marijuana Patients (UMMP), announced that today his organization led a legal challenge in Superior Court to the City of Los Angeles ordinance regulating medical marijuana patient associations, based on the failure of the City to do an environmental impact report (EIR). The City Attorney pushed an ordinance through the City Council in January 2010 that was so full of contradictions and legally questionable rules that a judge placed a hold on its implementation, and it has since then had to be frequently amended in an effort to survive 57 lawsuits, which should be decided by the end of this month, Shaw noted. No one, however, has recognized that the ordinance cannot be implemented at all until an EIR is prepared, as required by the California Environmental Quality Act, or CEQA, on the impact of reducing the number of medical cannabis locations from 400 to 100 and then forcing most of the 100 to move. The Citys argument that the CEQA only applies to development projects and not administrative changes is incorrect, said the UMMPs attorney, Jamie Hall of the Channel Law Group. The City is compelled to consider the results of this dramatic change to the neighborhoods of the surviving patient associations or collectives, including a potential increase in traf c, parking, noise, air and water pollution, land use, utilities, and many other factors. The 75 percent reduction in available locations means, just to give one example, that cultivation has to be quadrupled at the 100 remaining collectives, which would need to use a lot more electricity and water and dispose of additional waste water and plant matter. Shaw elaborated on the impact on patient services: A three-quarters reduction in places where the estimated 75,000 to 100,000 patients using medical cannabis in L.A. can bring their physician recommendations means most will then have to travel a much longer way, said Shaw. That alone would be a tremendous disruption of service, since many patient collectives have been functioning for over ve years. But the ordinance requires something much more drastic: a buffer zone for each patient association of no less than 1000 feet from schools, libraries, parks, child care facilities, religious institutions, drug rehab centers, youth centers, residential zones, and other collectives. If you look at a map, that means almost all of them will have to move to distant industrial zones or rural areas, which would be a tremendous hardship on the most seriously ill. The result would be an effective ban on access in most areas, which would seem to be the cynical goal the City Attorney intended if you look at the blatant misinterpretations of case law used to support the ordinance, said Shaw, as analyzed on the UMMPs web site www.UnionMMP. org. However, a majority of the City Council has stated that it does want medical marijuana to be accessible to legitimate patients, as the majority of Californians voted in 1996 when the Compassionate Use Act passed. Citizens should let their member of the City Council know that the ordinance should be amended to enable patients to have access to their medicine, Shaw said. This would end the litigation that is expensive for the City and for the patient associations. He pointed to the state standard that collectives be at least 600 feet away from just residential zones and schools, as a model for improving the ordinance to serve patients better. This would allow more associations to remain based near their current members. There is actually no evidence that their location near any of the places listed in the current City ordinance causes a signi cant increase in crime and the white paper from the state police chiefs association that has been cited to support this extreme measure had no science to support its assertions. As L.A. Police Chief Charlie Beck testi ed before the City Council, banks are much more likely to be targets of robbery, but no one is insisting that banks move to industrial zones. Shaw also took issue with the common analogy to the need to limit liquor stores. There are approximately 3,400 retailers selling liquor in the City, or 34 times the number of proposed medical marijuana locations. While liquors harm is very well known, the City Attorney is trying to make a form of legitimate medication virtually inaccessible to patients. He added: No one who has studied the scienti c evidence can dispute that cannabis has been shown effective in alleviating many medical problems, from offsetting nausea from chemotherapy and reducing depression to retarding the development of Alzheimers disease and providing pain relief for those suffering from HIV/ AIDS. Man has discovered psychoactive drugs serendipitously, has cultivated them deliberately, and has been producing them in laboratories and even in suburban homes. Many people consider that only a minority take psychoactive drugs. However, in his excellent book Living with Drugs, Michael Gossop points out that drug-taking is, almost a universal phenomenon, and in the statistical sense of the term it is the person who does not take drugs that is abnormal. While some people might react strongly to the idea that they are a drug taker, drugs come in various forms other than illegal substances such as heroin and cocaine. Other drugs include nicotine in cigarettes, alcohol, and a multitude of prescription drugs that are used for problems such as sleeplessness, depression and anxiety. Even tea and coffee contain a drug caffeine. So what is a psychoactive drug? The World Health Organisation defines a drug as, any chemical entity or mixture of entities, other than those required for the maintenance of normal health (food), the administration of which alters biological function and possibly structure. A psychoactive drug is a drug that affects the brain to produce alterations in mood, thinking, perception and behaviour. The positive effects of psychoactive drugs are the pleasurable mood states they induce, which can range from a general feeling of well-being through to a state of euphoria. In addition, psychoactive drugs can reduce stress and tension, as well as negative mood states such as anxiety and depression. However, psychoactive drugs may also produce negative psychological effects, such as the paranoia and delusions caused by excessive use of amphetamine and cocaine. Society has clung to the notion that some psychoactive drugs we use are good, whereas others are bad. Heroin is a bad drug, and heroin users are often classed

PSYCHOACTIVE DRUGS - CONTINUED minor tranquilisers such as valium and other benzodiazepines, barbiturates such as Nembutal, as well as anaesthetic gases and other volatile substances such as gas lighter fuels. These substances have the common property of down-regulating mental activity, producing a state of relaxation or sleepiness. They can slow reaction time and impair co-ordination. Higher doses produce intoxication and sometimes unconsciousness. Stimulants include amphetamines, cocaine and caffeine. These drugs up-regulate mental activity, causing alertness, feelings of enhanced energy, and excitement. However, these drugs can also produce agitation and anxiety. These drugs change a persons perception of the world, distorting what is heard or seen, or leading to a person experiencing things that do not really exist. Drugs that cannot readily be fitted into one of these classes include cannabis (sedative and hallucinogen), nicotine (sedative and stimulant) and ecstasy (stimulant and hallucinogen). Although we have categorised drugs in this fashion for convenience purposes, we must not assume that drugs have fixed effects dependent purely on their chemical properties. Far too many people believe the idea that specific drugs have fixed and predictable effects, which are the same from person to person. In fact, the way that a drug affects a person depends on three factors: The drug (the pharmacological action of the substance itself) The set (e.g. personality, attitudes, and expectancies, physical condition of the user) The setting or context (the influence of the physical and social setting within which the use occurs). When trying to understand a drug effect and ultimately a drug problem, the situation is made all the more complex by the fact that each of these factors can be broken down further. For example, the impact of the first factor (the drug) needs to take into consideration the amount of drug taken (dose), the route by which the drug is taken (e.g. by injecting or by mouth), and the speed by which the drug reaches the brain. The situation is made more complex by the fact that drugs are not taken on a single occasion. If a person likes their experience they will use the drug again, and then on repeated occasions. When this happens, the brain tries to adapt to the changes that each dose of the drug produces. This brain adaptation can lead to alterations in future drug effects. For example, tolerance develops following repeated administration of heroin, such that higher doses of the drug are required to produce the same effect. Repeated drug administration can also lead to changes in psychological experiences when the person is drug-free. For example, following long-term amphetamine use a person may show depressed mood when not taking the drug, i.e. an effect opposite to the drug effect occurs. The situation is made even more complex by the fact that many people who develop a drug problem do not use just one drug. For example, a person who misuses amphetamine may also take benzodiazepines to help them overcome the adverse effects of the stimulant. This then leads to more adverse effects. Poly-drug use is the norm amongst the majority of heroin users. The situation is made more complex again by the fact that the person is probably purchasing an impure product in an unsafe environment (from the street) at a time when they are possible experiencing adverse health, social and emotional problems. And, finally, it is imperative to stress that a person may already have problems of social deprivation, childhood abuse, learning difficulties, and personality problems before they developed a drug and/or alcohol problem. There is a long and tangled path between the psychoactive drug and the drug problem in todays society.

There is two-way communication between the CNS and the motor system (musculature), the endocrine system (the collection of glands within the body which release hormones into the blood supply) the sensory systems, and all of the internal organs. As you can see, this inter-communication within the brain and between the brain and the rest of the body makes specific psycho-pharmacologic interventions nearly impossible. To prescribe a drug to alter communication in one area, can alter communication throughout the body; hence, the potential for side-effects is immense, and response to medication can vary widely across individuals. Within the central nervous system, communication within nerve cells (neurons) is mediated electrically, while communication between neurons is mediated chemically. The purpose of the electrical communication within neurons is to regulate the release of chemicals which the neuron uses to communicate with other neurons. The purpose of the chemical communication between neurons is to influence the electrical excitability of the receiving cell. As you can see, this relationship is circular. The chemicals which the neurons use to communicate with each other are referred to, collectively, as neurotransmitters. Many of these neurotransmitters you may have heard of. Serotonin is the neurotransmitter which is enhanced by Prozac, Paxil, Zoloft, and several other antidepressants. Dopamine is the neurotransmitter which is deficient in Parkinsons disease, due to the selective death of dopamine releasing neurons. The L-DOPA medication which Parkinsons patients take elevates dopamine levels in the brain. On the other hand, if the brain is excessively sensitive to dopamine, schizophrenia will result. Most anesthetics induce unconsciousness, which allows patients to undergo medical procedures like surgery without physical pain or emotional trauma.[15] To induce unconsciousness, anesthetics affect the GABA and NMDA systems. For example, halothane is a GABA agonist,[16] and ketamine is an NMDA receptor antagonist.[17]
Pain control
Main article: Analgesics Psychoactive drugs are often prescribed to manage pain. As the subjective experience of pain is regulated by endogenous opioid peptides, pain can be managed using psychoactives that operate on this neurotransmitter system as opioid receptor agonists. This class of drugs can be highly addictive, and includes opiate narcotics, like morphine and codeine.[18] NSAIDs, such as aspirin and ibuprofen, are a second class of analgesics. They reduce eicosanoidmediated inflammation by inhibiting the enzyme cyclooxygenase.
Psychiatric medication
Main article: Psychiatric medications Zoloft (sertraline) is an SSRI antidepressant. Psychiatric medications are prescribed for the management of mental and emotional disorders. There are six major classes of psychiatric medications: Antidepressants, which are used to treat disparate disorders such as clinical depression, dysthymia, anxiety, eating disorders and borderline personality disorder.[19] Stimulants, which are used to treat disorders such as attention deficit disorder and narcolepsy and to suppress the appetite. Antipsychotics, which are used to treat psychosis, schizophrenia and mania. Mood stabilizers, which are used to treat bipolar disorder and schizoaffective disorder. Anxiolytics, which are used to treat anxiety disorders. Depressants, which are used as hypnotics, sedatives, and anesthetics.
History
Psychoactive drug use is a practice that dates to prehistoric times. There is archaeological evidence of the use of psychoactive substances (most likely plants) dating back at least 10,000 years, and historical evidence of cultural use over the past 5,000 years.[2] The chewing of Coca leaves for example was found to date back over 8000 years ago in Peruvian society. [3][4] Medicinal use is one important facet of psychoactive drug usage, however some have postulated that the urge to alter ones consciousness is as primary as the drive to satiate thirst, hunger or sexual desire. [5] The long history of drug use and even childrens desire for spinning, swinging, or sliding indicates that the drive to alter ones state of mind is universal.[6] One of the first people to articulate this
Uses
The theory of dosage, set, and setting is a useful model in dealing with the effects of psychoactive substances, especially in a controlled therapeutic setting as well as in recreational use. Dr. Timothy Leary, based on his own experiences and systematic observations on psychedelics, developed this theory along with his colleagues Ralph Metzner, and Richard Alpert (Ram Dass) in the 1960s.[14] Dosage The first factor, dosage, has been a truism since ancient times, or at least since Paracelsus who said, Dose makes the poison. Some compounds are beneficial or pleasurable when consumed in small amounts, but harmful or deadly in higher doses. Set The set is the internal attitudes and constitution of the person, including his expectations, his wishes, his fears. This is an important factor especially relative to the hallucinogens. These substances have the ability to activate, potentiate, and sometimes mercilessly expose everything that a person has in his or her consciousness or buried beneath it. In traditional cultures set is shaped primarily by the worldview that all the individuals share.

Timothy Leary was a leading proponent of spiritual hallucinogen use. Main article: Entheogens Certain psychoactives, particularly hallucinogens, have been used for religious purposes since prehistoric times. Native Americans have used mescaline-containing peyote cacti for religious ceremonies for as long as 5700 years.[25] The muscimolcontaining Amanita muscaria mushroom was used for ritual purposes throughout prehistoric Europe.[26] Various other hallucinogens, including jimsonweed, psilocybin mushrooms, and cannabis, have been used in religious ceremonies for millennia. [27] The use of entheogens for religious purposes resurfaced in the West during the counterculture movements of the 1960s and 70s. Under the leadership of Timothy Leary, new religious movements began to use LSD and other hallucinogens as sacraments.[28] In the United States, the use of peyote for ritual purposes is protected only for members of the Native American Church, which is allowed to cultivate and distribute peyote. However, the genuine religious use of Peyote, regardless of ones personal ancestry, is protected in Colorado, Arizona, New Mexico, Nevada, and Oregon.[29]

In World War II, between 1939 and 1945, 60 million amphetamine pills were made for use by soldiers.[citation needed] Brownbrown, a form of cocaine adulterated with gun powder, has been used in the Sierra Leone Civil War by child soldiers.[citation

Main article: Neuropsychopharmacology Psychoactive drugs operate by temporarily affecting a persons neurochemistry, which in turn causes changes in a persons mood, cognition, perception and behavior. There are many ways in which psychoactive drugs can affect the brain. Each drug has a specific action on one or more neurotransmitter or neuroreceptor in the brain. Drugs that increase activity in particular neurotransmitter systems are called agonists. They act by increasing the synthesis of one or more neurotransmitters or reducing its reuptake from the synapses. Drugs that reduce neurotransmitter activity are called antagonists, and operate by interfering with synthesis or blocking postsynaptic receptors so that neurotransmitters cannot bind to them.[31] Exposure to a psychoactive substance can cause changes in the structure and functioning of neurons, as the nervous system tries to re-establish the homeostasis disrupted by the presence of the drug. Exposure to antagonists for a particular neurotransmitter increases the number of receptors for that neurotransmitter, and the receptors themselves become more sensitive. This is called sensitization. Conversely, overstimulation of receptors for a particular neurotransmitter causes a decrease in both number and sensitivity of these receptors, a process called desensitization or tolerance. Sensitization and desensitization are more likely to occur with long-term exposure, although they may occur after only a single exposure. Patients with a physicians recommendation and their primary caregivers, defined as, The individual designated by the person exempted under this act who has consistently assumed responsibility for the housing, health, or safety of that person. According to a state supreme court decision, People v Mentch (2008), caregivers must supply some other service to patients than just providing marijuana. As an alternative, SB 420 allows patients to grow together in non-profit collectives or cooperatives. PATIENT ADVOCATES APPEAL FEDERAL DECISION TO DENY MEDICAL MARIJUANA TO MILLIONS OF AMERICANS
Americans for Safe Access Notice of appeal filed in D.C. Circuit challenges recent denial to reschedule marijuana for medical use Washington, DC -- The countrys leading medical marijuana advocacy group, Americans for Safe Access (ASA), with the Coalition for Rescheduling Cannabis (CRC), today appealed a recent decision by the federal government to keep marijuana classified as a dangerous drug with no medical value. The appeal to the D.C. Circuit comes just two weeks after the Obama Administration denied a 2002 petition to reschedule marijuana filed by a coalition of patients and advocacy groups. ASA will argue in a forthcoming appeal brief to be filed in the next few weeks that the federal government erred by keeping marijuana out of reach for millions of patients throughout the United States. By ignoring the wealth of scientific evidence that clearly shows the therapeutic value of marijuana, the Obama Administration is playing politics at the expense of sick and dying Americans, said ASA Chief Counsel Joe Elford, who filed the notice of appeal today. For the first time in more than 15 years we will be able to present evidence in court to challenge the governments flawed position on medical marijuana. Although two other rescheduling petitions have been filed since the establishment of the Controlled Substances Act in 1970, the merits of medical efficacy was reviewed only once by the courts in 1994. Patient advocates argue that by failing to reclassify marijuana, the federal government has stifled meaningful research into a wide array of therapeutic uses, such as pain relief, appetite stimulation, nausea suppression, and spasticity control among many other benefits. In 1988, the government ignored the ruling of its own Administrative Law Judge Francis Young who said that, Marijuana, in its natural form, is one of the safest therapeutically active substances known to man. Since the CRC petition was filed, even more studies have been published that show the medical benefits of marijuana for illnesses such as neuropathic pain, multiple sclerosis, Alzheimers. Recent studies even show that marijuana may inhibit the growth of cancer cells. Earlier this year, the National Cancer Institute, a division of the federal Department of Health and Human Services, added cannabis (marijuana) to its list of Complementary Alternative Medicines, pointing out that its been therapeutically used for millennia. Ironically, in December of 2010 the Obama Administration issued a memorandum on the preservation and promotion of scientific integrity of the executive branch. Yet, the application of such integrity appears to be applied selectively and not with regard to medical marijuana. With science on our side, we will put an end to the governments political posturing, continued Elford, and force the Obama Administration to adhere to its own stated policy of emphasizing science over politics. When the latest petition was filed by the CRC in 2002, eight states had adopted laws recognizing and decriminalizing the medical use of marijuana. Today, sixteen states and the nations capitol have passed medical marijuana laws with many more states currently considering proposals to implement similar laws.

As such, CPR works to protect medical marijuana (cannabis) patients rights, under Prop. 215, Senate Bill 420, the 2008 Attorney Generals Guidelines, and related case law. Big Pharma and Big Biotech have already developed a strain of cannabis (marijuana) with a knock-out gene so that the plant will not produce THC. Why? Because THC is a cancer preventative and a cancer cure, aids in many of marijuanas other medicinal uses in combination with the other natural cannabinoids, and is therefore a huge threat to Big Pharma and the Cancer Industrys profit-making model. Individuals rights to grow a natural cure and preventative for cancer must be destroyed for them to continue to make huge profits; that is one reason that marijuana has been kept federally illegal while Big Business consolidated its plans to control access to this very valuable commodity. One way to seize control of THC is to introduce the legal cultivation of GMO cannabis/hemp/marijuana that contains no or little THC. Cannabis is wind-pollinated, and therefore corporate cultivation of huge fields of GMO cannabis/ hemp/marijuana will pollute the genetics of all outdoor cannabis and even allow the biotech owners of the GMO genes to sue anyone unfortunate enough to have plants pollinated with their patented genetic property! Therefore, any initiative that allows the legal cultivation of marijuana must include an express ban on GMO cannabis cultivation to be effective at protecting California marijuana/ cannabis genetics and individual citizens rights to grow full, natural, THC-producing cannabis. 2 The Regulate Marijuana Like Wine initiative, from Judge Gray, Steve Kubby, Bill McPike and David Malmo-Levine, is intentionally written in a way to open the door to cultivation of GMO cannabis. The first draft of the initiative which they shared with me and others contained an express prohibition on cultivation of GMO cannabis. In the second draft version, it was removed. Why? To allow GMO cannabis to be legally grown in California. Lets compare the wording in the most recent-but-not-final version of the Jack Herer initiative being promoted by Jacks Acolyte, Mikey Jolson. For purposes of this comparison, you must remember this basic rule: Marijuana is illegal to grow in California except as allowed by law. The Herer initiative, by defining in its provisions that marijuana, whose legal cultivation it expressly allows, is only non-GMO cannabis, makes it illegal to grow anything BUT non-GMO cannabis. Heres an example: if I define cars as only Fords and Dodges, and then pass a law that makes it legal to only own cars, then it is illegal to own anything except Fords and Dodges. In contrast, the Regulate Marijuana Like Wine (hereinafter RMLW)initiative adopts a definition that requires voters to look up other California code sections wording that is already less than helpful in terms of informing voters what they are getting. This is an unnecessarily confusing provision; but thats not the only problem with the RMLW let alone its most fundamental problem. The RMLW initiative not only adopts the definition of marijuana and THC as they are presently set forth in Health and Safety Code Sections 11018 and 11006.5, but then it adds that those definitions shall be broadly interpreted to include the species Cannabis Indica, Ruderalis, and Americana, as well as any plant part, derivative, interspecies hybrids or cross-breeds, and all non- genetically-modified strains of the Cannabis genus and plant. First problem, regardless of those code sections: the Kubby initiative definition of marijuana - - the plant that one can only grow legally as it is defined by law -- no longer includes genetically- modified strains of the Cannabis genus and plant. It takes genetically-modified strains of the Cannabis genus and plant out of the definition of marijuana. Do you see how that works? To use the car analogy, my new car ownership law will now say that the definition of cars shall be broadly interpreted to include all makes and models of Ford cars, Ford trucks, Dodge cars, and Dodge trucks, and any vehicles that are composed of any combination of Dodge and Ford parts. So, under this definition, can you legally own a Subaru? Or a VW? Well, the only car you can legally own is a Dodge or Ford car or truck or hybrid of the same, right? Yes. But Subarus and VWs are no longer cars. The definition of cars is all makes and models of Ford cars, Ford trucks, Dodge cars, and Dodge trucks, and any vehicles that are composed of any combination of Dodge and Ford parts. And VWs and Subarus are not any makes and models of 3 Ford cars, Ford trucks, Dodge cars, and Dodge trucks, and any vehicles that are composed of any combination of Dodge and Ford parts. Therefore, they do not come within the definition of a car, and you can own one. This is why people HATE lawyers. Because they are so good at tricking people with words. To go back to the RMLW initiative, to put it another way, according to the initiatives definition of marijuana, genetically-modified strains of the Cannabis genus and plant are no longer marijuana; they are genetically-modified strains of the Cannabis genus and plant. They are a new organism. And they will be LEGAL TO GROW IN CALIFORNIA --but only if this initiative passes! And to make it even more certain that GMO cannabis will be legal, the Kubby initiative makes general references to using the same regulations that apply to the wine industry. Are there any prohibitions against GMO grapes? No? Then if GMO grape vines are legal, so is GMO cannabis. The RMLW initiative will allow fields of GMO cannabis to pollute the genetic lines of all natural, whole herb cannabis all over California. Dont think Big Pharma and biotech companies like Monsanto, working together, wont buy up land in Humboldt and Mendocino Counties and start work on that project right away? Guess again! Can RMLW get any worse? Oh, yes! If it passes, stand by for THC-free medical marijuana as the only legal medical marijuana. The RMLW initiative splits marijuana into two categories: less than one percent (1 %) THC and more than three percent (3%) THC. It then defines who can use marijuana with less than 1% THC as anyone regardless of age, which is the current definition of medical marijuana. (Think about it Prop. 215 lets anyone with a recommendation, regardless of age, use medical marijuana so medical marijuana is marijuana that even children can use regardless of THC levels which is really important to its usefulness for lots of ailments for both children and adults.) Under this new Trojan Horse, medical marijuana will be defined as marijuana with less than 1% THC. Now, if you do some background investigation of Steve Kubby, one of the RMLWs proponents, you will discover that he has a corporation that works on licensing and patents for pharmaceutical cannabinoid medicines, and that he is working with big pharmaceutical companies AND that one of his pet projects is a non-toxic cannabis lozenge. Guess what the toxic part of cannabis is? Three guesses . . . yup, its the THC. Now, would you want to vote for an initiative thats sponsored by someone who plans to make money by calling THC toxic? Sure, he can say that THC is toxic because too much THC especially when divorced from all the other cannabinoids with which Mother Nature wisely balanced the THC in the first place can make you feel pretty sick until you get used to it. But it wont kill you. 4 So toxic here -- as in Steve Kubbys nontoxic cannabis lozenge -- means not deadly, but harmful, as in something that is capable of causing harm if used in too high a dose. As in, Some sunlight is good for you it helps make Vitamin D3, and improves your mood but too much will give you a sunburn and hurt your skin. As in too much THC for the unacclimatized patient will make the patient sick until they can build up a tolerance so they can use MORE THC because it has great medicinal benefits for chronic conditions. Am I convinced the Kubby people did this intentionally? You bet. Why? Because as an attorney, I know how to do this. This is like reverse engineering. You decide on the results you really want, and then work backwards from there, making things SOUND okay but drafting to get what you want. Someone could use Prop. 19 as a model to teach a class on how to do this. If this were really a REAL difference of legal opinion, Judge Grey or Bill McPike would have been able to actually engage in a legal analysis with me -- instead of just expressing polite disagreement. J. David Nicks tried to take my analysis of Prop. 19 apart, in writing, which turned out to be a disaster for him. I could take what he wrote, and then respond to it in writing for all to see, This must have worked for our side, because the lay people/patients who were able to get the whole written debate all told me that they decided FOR SURE after reading me, then him, then me, that I was telling the truth and my analysis made logical sense. (1) These persons, upon registration and payment of a nonrefundable training and materials fee, not to exceed $200, must complete a minimum of two days training in the following curriculum areas: (A) State and federal Cannabis laws and regulations; (B) Indoor and outdoor cultivation hazards and safe practices; (C) Applicable fire, building, environmental, labor, and safety codes; and CD) The state and federal Bills of Rights and appropriate civil rights, including 18 USC 241 and 242 and Civil Code Sections 52.1 et seq., and 54. (2) Training shall be privately contracted. Training shall be repeated by HROs every three years, and curriculum updates shall be provided to HROs annually. Upon payment of the processing fee to the Department of Health, not to exceed $100, a HRO shall be issued a photo identification card, which shall be identical throughout the state. [This would mean that these people would be like State humane Officers, with STATEWIDE JURISDICTION! Even regular law enforcement officers dont have such broad jurisdiction!] (4) The HROs shall be charged with the duty of compelling persons to comply with this Act by informing persons of compliance requirements or perceived violations, and reporting actual uncorrected violations to law enforcement for follow-up action. (5) By their status of being peace officers, HROs shall be considered to be in full compliance with both 21 USC 885(d) and Health and Safety Code section 11367, and therefore shall be immune from all state and federal liability and prosecution for enforcing and operating under the provisions of this Act. FBI: 750,000 PEOPLE ARRESTED FOR SIMPLE MARIJUANA POSSESSION . . . AND FOR WHAT?

Across the country, people continue to be arrested for marijuana-related violations at an alarming rate, despite the steadily decreasing stigma associated with it and increasing efforts at reforming our irrational marijuana laws. And guess what? It still isnt working. Our esteemed leaders claim otherwise, even while admitting that they need to change their tactics! Over the past year, the Obama administration stated that the war on drugs is over, and that the government was going to shift its focus away from law enforcement and interdiction and instead put more effort toward public health and education with regard to drugs. At a press conference just last week, Office of National Drug Control Policy director Gil Kerlikowske stated that we cannot arrest our way out of the drug problem. If these statements are true, then how do they justify the arrests of more than 853,000 people for marijuana-related violations in 2010? Thats one person arrested every 19 seconds! The Drug Czar maintains that law enforcement protocols are still considered a useful tool for eliminating suppliers and dealers as a way to decrease overall use. Okay, that seems like it makes sense. So how many of those 853,000 arrests were for sale or manufacture of marijuana? The answer is just over 103,000. That means that more than 750,000 people were arrested last year for simple possession! A remarkably small number of people who may have distributed marijuana were arrested last year, along with three quarters of a million simple users, in an effort to curb marijuana use nationwide. Were those people useful tools in preventing marijuana use? Absolutely not. According to the governments own data, marijuana use actually increased last year. Now, weve seen that Kerlikowske is correct when he says that we cant arrest our way out of this problem. We can see that arresting people for marijuana, even for marijuana sales, has no effect on marijuana use rates. This glaringly obvious fact makes such statements from the federal government even more confusing, given their continued trend of upholding the status quo at all costs. Lets look at some slightly more disturbing aspects of this report. Arrests for simple marijuana possession accounted for 5.7% of all arrests in 2010! That is a significant percentage of our law enforcement efforts devoted to punishing people for a victimless crime. It seems that there are better ways to use those resources, especially considering that there were more arrests for marijuana possession than for all violent crimes. How many violent acts occurred last year that did not result in an arrest? How many rapes and murders went unsolved due to lack of funds or personnel? The Obama administration has repeatedly claimed that we need to rethink our approach to drug problems. If it really means this, it needs to seriously consider the most obvious starting point: taxing and regulating marijuana for adults. It is time we stop spending billions of dollars ruining peoples lives in a vain attempt to prevent them from using a plant that humans have used safely for thousands of years.

September 15th, 2011 posted by Kris Hermes A Nevada trial court judge threw out an indictment Monday against Leonard Schwingdorf and Nathan Hamilton, two medical marijuana dispensary operators arrested in federal Drug Enforcement Administration (DEA) and local law enforcement raids on several Las Vegas facilities last year. This was the first legal disposition since the Obama DEA raided at least 5 area dispensaries on September 8, 2010, indicting 15 people as a result. When dismissing the indictments, Nevada District Judge Donald Mosley called the states law mind boggling. Judge Mosley further questioned the legislatures failure to craft a law that benefits patients: [W]hy dont they (the Legislature) make up their mind if they want to make it legal or notI cant make any sense out of this law. Judge Mosley also asked about the law: Are people supposed to give it away? I mean it just makes no sense. Although all 15 indictments stemming from last years raids were initially filed in federal court, only 7 remain as federal cases. The rest of the indictments, two of which were tossed earlier this week by Judge Mosley, were transferred to state court. According to the Las Vegas Review-Journal, defendants have called the state law paradoxical because it allows patients registered with the state to possess the herb, but makes it illegal to obtain it. Mosley agreed with defense attorneys in their allegations that prosecutors withheld important medical-related information from the grand jury that indicted Schwingdorf and Hamilton. Seven federal prosecutions are still pending as are another state case, which will be heard Friday by District Judge Doug Smith. An indictment against multiple operators and the vagueness of Nevadas medical marijuana law will again be at issue this Friday.
