An international agreement across the world sets out rights for children 0-18 years old. 54 articles and two optional protocols.

Governments are responsible for ensuring that all people understand and respect children's rights this includes children, families, carers, teachers etc.
Rights in the UNCRC are universal and unconditional

When children are adopted the first concern must be what is best for them.

Article 20| Erthygl 20

A child in whose best interests cannot be allowed to remain in their birth family, shall be entitled to special protection and assistance provided by the State.

Family Justice Review:


Children and young people should be given age appropriate information to explain what is happening when they are involved in cases. They should as early as possible be supported to make their views known and older children should be offered a menu of options, to lay out the ways in which they could if they wish do this (Saesneg yn unig)

The majority of children going through the adoption process will have experienced a difficult start in life and many will have been placed for adoption because they have been the subject of abuse or neglect; Children are also likely to have been cared for by a number of different significant adults before living with their adoptive parents; Almost nine in ten children (87 per cent) were adopted by others and not by their former foster carer in 2010-11. Research also suggests that: There is a general lack of understanding of and sensitivity towards the additional needs of adopted children in education settings. (Article 29, UNCRC). That there are access, continuity and consistency of support issues for adopted children who require help with their emotional wellbeing and mental health needs. This included problems in securing continued therapeutic support where a child moves to a new local authority (Article 24, Article 39, UNCRC).
Mae ymchwil hefyd yn awgrymu bod:
Dim digon o ddealltwriaeth neu sensitifrwydd tuag at anghenion ychwanegol plant sydd wediu mabwysiadu o fewn addysg. (Erthygl 29, CCUHP). Bod yna faterion yn ymwneud mynediad, parhad a chysondeb syn effeithio ar blant wediu mabwysiadu sydd angen cymorth gydau lles emosiynol ac anghenion iechyd meddwl. Mae hyn yn cynnwys problemau sicrhau cymorth therapiwtig parhaol lle mae plentyn yn symyd i awdurdod lleol newydd. (Erthygl 24, CCUHP).

Packages of post-adoption support appear to be inadequate in many cases. Families have reported the specific difficulties that they can face when the child enters the teenage years. Support needs to move beyond a package of support during the first few years following adoption. Children and their adoptive families need access to support at the point at which they may decide to seek more information about their birth families or consider contact with birth relatives. Information, advice and support is needed to address the emotional challenges that these issues are likely to raise. Nid yw pecynau l-fabwysiadu yn ddigonol mewn llawer o achosion.

Adopted children often face the same challenges as looked after children but we know that those children who can benefit from a successful adoption have much better outcomes than their peers who remain in the care system. There is a case for the specific duties applied towards looked after children in relation to wellbeing, mental health and additional educational needs to be extended to adopted children.
