Registration of Firms

Section 56-71
Procedure of Registration
 State Govt. is authorized to appoint
registrar.

 office of registrar exists in every state.

 application is to be submitted with


prescribed form & fees.
 Application has following particulars :

 Name of the firm


 Place of business
 Date when each partner joined
 Name in full & permanent address of
partners
 Duration of the firm
 - Application form should be signed &
verified by each partner.

 - If Registrar is satisfied as to the


registration , he registers the firm &
enters the name in the Register of
Firms.

 - Certificate will be issued

Effect of Non Registration
 Section 69
 No Suit between partners and firm
 No Suits between firm and third party
 No claim of set off or other proceedings

 Recovery of insolvents share
 Value of suit Rs 100
 penalty for furnishing false particulars
Section 70.
 Imprisonment which may extend to
three months or with a fine or with both.
