RA 7610

An Act Providing for Stronger


Deterrence and Special Protection
Against Child Abuse, Exploitation and
Discrimination, Providing Penalties for
its Violation, and for Other Purposes.
Definition of Terms

 Children - below 18 y
- 18 y or above, but unable to fully take
care of themselves or protect themselves
from abuse, neglect or cruelty, exploitation
or discrimination because of a physical or
mental disability or condition.
 Child Abuse
- refers to maltreatment, whether
habitual or not, of a child; includes:
(1) Psychological & physical abuse, neglect, cruelty,
sexual abuse & emotional maltreatment;
(2) Any act by deeds or words which debases,
degrades or demeans the intrinsic worth & dignity
of a child as a human being;
(3) Unreasonable deprivation of his basic needs for
survival, such as food & shelter; &
(4) Failure to immediately give medical treatment to an
injured child resulting in serious impairment of
his/her growth & development or his/her
permanent incapacity or death.
Punishable acts:
 Child Prostitution & Other Sexual Abuse

Children, male or female, who, for money, profit, or


any other consideration or due to the coercion or
influence of any adult, syndicate or group, indulge in
sexual intercourse or lascivious conduct.
 Penalty: 14y 1d  40y to those who Engage,
Promote, Facilitate, or Induce Child
Prostitution:

 Procurer of child prostitutes


 Induce customers through advertising
 Take advantage of influence or relationship
to procure a child as prostitute
 Threaten or use violence against a child to
engage in prostitution
 Give money, goods or other benefits to a
child w/ intent to engage him/her in
prostitution
Sexual Intercourse or Lascivious Conduct w/ a
Child Exploited in Prostitution & Other Sexual
Abuse

 Penalty: 14y 4m 1d  40 y
 Exception: child under 12
 Sexual Intercourse  Rape : 20y1d  40y
 Acts of Lasciviousness  14y4m1d to
17y4m
Profiting from child prostitution

 Persons liable: manager or owner of


establishment
 Penalty: 14y 4m 1d  40 y
 Also: Immediate closure of
establishment for at least one year
Attempt to Commit Child Prostitution

 A non-relative found alone w/ a child


inside a motel, inn, hotel, room, cubicle,
pension house, apartelle or other similar
establishment or a vessel, vehicle or
any other hidden or secluded area
under circumstances w/c would lead a
reasonable person to believe that the
child is about to be exploited in
prostitution & other sexual abuse.
Attempt to Commit Child Prostitution

 Receiving Services from a child in a


sauna parlor or bath, massage clinic,
health club & similar establishments.
Child Trafficking

 Penalty: 12y1d  40y


 Trading & dealing with children; includes
 Buying & selling the child for money, profit
or other consideration, or barter
 If child is less than 12 years, maximum
period
Attempt to Commit Child Trafficking
 A child travels alone to a foreign country
w/o valid reason & clearance from DSWD
or written permit or justification from
parent or legal guardian;
 Pregnant mother executes affidavit of
consent for adoption for a consideration;
 Person, agency,establishment or child-
caring institution recruits women or
couples to bear children for the purpose of
child-trafficking
 When a doctor, hospital or clinic official or
employee, nurse, midwife, local civil
registrar or any other person simulates
birth for the purpose of child trafficking;

 A person engages in the finding of children


among low-income families, hospitals,
clinics, nurseries, daycare centers, or other
child-caring institutions who can be offered
for the purpose of trafficking.
Obscene Publications &
Indecent Shows
 Hire, employ, use, persuade, induce or coerce
a child to perform in obscene exhibitions &
indecent shows, whether live or in video,
pose or model in obscene publications or
pornographic materials or to sell or distribute
said materials
 Ascendant or guardian of child who allows
child to participate in obscene publications &
indecent shows, also liable.
Other Acts of Abuse

1. Any person who shall commit any other


acts of child abuse, cruelty or
exploitation or be responsible for other
conditions prejudicial to a child’s
development

Penalty: 8y1d  10y


2. Any person who keeps a minor 12 or
under, or who is 10y younger than him
or more, in any public or private place,
hotel, motel, beer joint, disco, cabaret,
pension house, sauna, massage parlor,
resort or similar places
 Penalty: 10y1d  12y
3. Any person who delivers a minor to
anyone prohibited as described above
 Penalty: 8y1d  10y
 Ascendant, Stepparent, Guardian
10y1d  12y
4. Person, owner, manager or one
entrusted w/ the operation of any public
or private place and allows any person
to take along w/ him a child
 Penalty: 8y1d  10y
Fine: P59T
Loss of License to operate
5. Coercing or intimidating a child to –
 beg or use begging as a means for living
 Act as conduit in drug trafficking / pushing
 Conduct any illegal activity
 Penalty: 2y4m1d  40y
