Case is about violation of the rules of the House
FACTS:
Petitioners seek a rehearing and reconsideration of the Court's
decision dismissing their petition for certiorari and prohibition.
They claim that respondents violated the rules of the House when
the Chair of the Committee (Deputy Speaker Raul Daza)
allegedly ignored a privileged question raised by Rep. Arroyo
during the committee report for the approval of RA 8420.
R.A. 8420 amends certain provisions of the National
Internal Revenue Code by imposing “Sin Taxes” on the
manufacture and sale of beer and cigarettes
ISSUE:
Whether or not RA 8240 is null and void
because it was passed in violation of the
rules of the House
RULING:
No. It is well settled that a legislative act will not be
declared invalid for
non-compliance with internal rules.
ISSUE:
Whether or not the House of Reps committed a grave
abuse of discretion in enacting RA 8240.
RULING:
No. The Court finds no ground for holding that Congress committed a grave abuse
of discretion in enacting RA 8240. It is clear that what is alleged to have been
violated are merely internal rules of procedure of the House rather than
constitutional requirements for the enactment of a law.

SO ORDERED.
