Definition of Rape under Malaysian Law

According to the Malaysian Penal Code,

• Rape is defined as sexual intercourse with a woman against her will or without her consent.
• Sexual intercourse with a woman is called a rape when:
 Her consent is obtained by putting her in fear of death or hurt,
 When she is unable to understand the nature and consequences of what she is consenting to,
 Or when her consent is obtained by using a position of authority, a professional relationship, or other
relationship of trust.
• Sexual intercourse with a girl under 16 years of age, with or without her consent, is also rape.
The Effect Of The Rape Victims Physically And Mentally

• The physical effects include:

• The victim suffered a painful penetration. The pain can be significant and can be felt during and after rape.

• had a urinary tract infection

• can get pregnant. Many victims may not want to take care of the baby because it reminds them of a traumatic
event.

• Victims can get sexually transmitted infections such as HIV.

• The victim may have difficulty walking or have a fracture


• After rape, the victim’s mental and emotional health can also deteriorate significantly.

• Some of the effects of rape on the victim's mentality are they felt shame and all wrong.

• There are cases when embarrassment makes the victim decide to remain silent.

• the victims remain fearful that the rapist will return, and they suffer will be raped again.

• they are afraid that others will find out about the incident and look down on them.

• Victims felt intimidated in the place where they were raped.

• they may wonder why the rapist chose them. Why do they have to experience it? Why don't rapists choose someone
else? This is a natural response because the victim knows that only a handful of people suffer from this problem.
