Module 10.4 Air Operations
In June 2008 the original EASA Basic Regulation (EC) 159212002
was replaced by Basic Regulation (EC) 216/2008. Amongst other
things, a new Annex IV was included and legislated for operation
of aircraft under the name Air Operations.

MAINTANANCE TRAINING

General
An operator shall not operate an aircraft for the purpose of
Commercial Air Transportation (CAT) other than in accordance with Air
operations. Where the regulations apply to both the number is omitted. For the
purpose of these notes the word aircraft should be taken to mean either
aeroplane or helicopter. Each aircraft shall be operated in compliance with the
terms of its Certificate of Airworthiness and within the approved limitations
contained in its aircraft flight manual

Air Taxi and aircraft Emergency Medical' Service (EMS)
operations shall be conducted in accordance with the requirements contained in Air
operations except for the variations contained in subpart Q, appendices A and B
respectively.
All Synthetic Training Devices (STD), such as flight simulators or
light training devices replacing an aircraft for training and/or checking purposes are to be
qualified in accordance with the applicable EASA requirements and user approved by the
authority for the exercises to be conducted.

Air Operators Certificate (AOC) An applicant for an AOC, or
variation of an AOC, shall allow the authority to examine all safety aspects of the
proposed operation.
An applicant for an AOC must:
• Must have a sound and effective management structure in order to
ensure the safe conduct of air operations.
• Not hold an AOC issued by another authority unless specifically
approved by the authorities concerned.

• Have his principal place of business and his registered office
located in the state responsible for issuing the AOC.
• Have registered the aircraft which are to be operated under the AOC in the state
responsible for issuing the AOC.
• Satisfy the authority that he is able to conduct safe operations.
The operator must satisfy the authority that:
• Its organisation and management are suitable and properly
matched to the scale and scope of the operation
• Procedures for the supervision of operations have been defined

• The operator must have nominated an accountable manager acceptable to the
authority who has corporate authority for ensuring that all operations and
maintenance activities can be financed and carried out to the standard required by
the authority
• The operator must have nominated post holders, acceptable to the authority, who
have managerial competency together with appropriate technical/operational
qualifications in aviation. Post holders are required and in that function responsible
for the management and supervision of the following areas:

obtain approval for a system to inform the authority about the registration
markings for aircrafts operated under its AOC

Operator's Responsibilities

• All employees are made aware that they shall comply with the laws, regulations
and procedures of those states in which operations are conducted and which are
pertinent to the performance of their duties; and
• All crew members are familiar with the laws, regulations and
procedures pertinent to the performance of their duties.

Operator's Responsibilities
OPS 1.020 Subpart B
An operator must ensure that:

Quality System
An operator shall establish one quality system and designate one
quality manager to monitor compliance with and the adequacy of
procedures required to ensure safe operation and airworthy aircraft. Compliance
monitoring must include a feed- back system to the Accountable Manager to ensure
corrective action. An operator shall establish an accident prevention and flight safety
programme, which may be integrated with the quality system.
A crew member shall be responsible for:

• Proper execution of duties in relation to the safety of the
aircraft and its occupants.
• Proper execution of duties specified in the instructions and
procedures laid down in the operations manual.
• Report any fault, failure, malfunction or defect which he believes may affect the
airworthiness or safe operation of the aircraft including emergency systems.
• Report any incident that endangered or could have endangered the safety of
operation
• Make use of the operator's occurrence reporting schemes in
accordance with EU-OPS 1

OPS 1.125 Subpart Band ff
An operator shall ensure that the following documents - the original or a copy
thereof - are carried on each flight
• The Certificate of Airworthiness
• The Certificate of Registration
• The Noise Certificate (if applicable)
• The Air Operator Certificate
• The Aircraft Radio Licence
• The Liability Insurance Certificate for aircraft
• The flight crew member must have a valid flight crew licence with appropriate
rating(s) for the purpose of the flight.

Manuals to be Carried
OPS 1.130 Subpart B
An operator shall ensure that:
• The current parts of the operations manual relevant to the
duties of the crew are carried on each flight
• Those parts of the operations manual which are required for the conduct of a flight
are easily accessible to the crew on board the aircraft
• The current aircraft flight manual is carried in the aircraft

Additional Information and Forms to be Carried
OPS 1.135 Subpart B
An operator shall ensure that, in addition to the documents and manuals prescribed
in Air operations
• all information and forms, relevant to the type and area of operation, are carried
on each flight. For example:
• Operational Flight Plan,
• Aircraft Technical Log,
• Appropriate meteorological information,
• Mass And Balance Documentation,
• Notification of special loads including dangerous goods

Aircraft Placarding (Markings)
Ref. CS-25, Subpart G, CS-25.1541
The aircraft must contain:
The specified markings and placards Any information, instrument markings · and
placards required for the safe operation if there are unusual design, operating or
handling characteristics. Each marking and placard prescribed above must be
displayed in a conspicuous place; and may not be easily erased, disfigured, or
obscured.

Instrument markings:
When markings are on the cover glass of the instrument, there must be means to
maintain the correct alignment of the glass cover with the face of the dial. Each
instrument marking must be clearly visible to the appropriate crew member.

General
Master Minimum Equipment List (MMEL), Minimum Equipment List (MEL)
and Configuration Deviation List (CDL) MMEL, MEL and CDL are documents
used by the operator to perform commercial flight operations even when
some systems, components or other requirements do not function or
correspond with the defined standard of functionality. These lists define the
requirements in which limitations such operations may be performed. They
define the required system function, operational limitations and
rectifications intervals.

Master Minimum Equipment List (MMEL)
(JAR-MMELIMEL and EU-OPS 1.030) The Master Minimum Equipment List/MMEL is
a master list appropriate to an aircraft type which determines those instruments,
items of equipment or functions that, while maintaining the level of safety
intended in the applicable regulation, may temporarily be inoperative either due to
the inherent redundancy of the design, and/or due to specified operational and
maintenance procedures, conditions and limitations, and in accordance with the
applicable procedures for continued airworthiness.

All items related to the airworthiness of the aircraft and not
included m the list such as landing gear, engine, primary flight
controls surfaces are automatically required to be operative. Non safety-related
equipment, such as galley equipment, passenger convenience items, need not be
listed.
The authority will only accept an application for MMEL approval
from the type certificate holder.

Operational and maintenance procedures are necessary to support certain MMEL
items. These procedures shall be identified to the authority during the approval
process; however, the procedures themselves will not be subject to approval. These
procedures shall be referenced in the MMEL and published concurrently with the
MMEL as a guide for operators. The procedures shall be appropriately amended, as and
when the MMEL is revised the MMEL is approved by the ce11ification authority and
issued as the basis for the preparation and authorisation of the individual operator's
minimum equipment list (MEL) for each aircraft type. Where a change to the type
certificate has an effect upon the MMEL, the type certificate holder shall apply for
approval of the necessary changes to the MMEL.

Minimum Equipment List (MEL) and Configuration
Deviation List (CDL)
The MEL is a list which provides for the operation of aircraft, under specified
conditions, with particular instruments, items of equipment or functions
inoperative at the commencement of flight. This list is prepared by the operator for
his own particular aircraft taking account of their aircraft definition and the relevant
operational and maintenance conditions in accordance with a procedure approved
by the authority.

An operator shall establish, for each aircraft, a MEL approved by the authority. The
MEL shall be based upon, but no less restrictive than ,the relevant MMEL. All items
related to the airworthiness of the aircraft and not included in the list are
automatically required to be operative. Non-safety related program that includes
tracking of the inoperative items and coordinating parts, personnel, facilities and
procedures necessary to ensure timely rectification. Dispatch of the aircraft is not
allowed after expiry of the rectification interval and possible extension specified in
the MEL.

Under certain specified conditions and circumstances operators may be granted
approval by the authority to introduce and implement special procedures for
operations outside the condition of the MEL. The special procedures will · in no
circumstances be used to permit flights outside the constraints of the relevant MMEL.
Any operator-specific MEL is based on the manufacturer's MMEL and must be
approved by the competent authority. The MEL shall include all restrictions
(manufacturer and engineering) shown in the Configuration Deviation List (CDL).

Configuration Deviation List
The CDL should not be confused with the Minimum Equipment List (MEL). MELs are
associated with inoperative equipment and systems. They define a safe deviation from
the certified configuration. Items listed in the CDL, however, define a new certificated
airplane configuration. Therefore, the airplane may be flown indefinitely without
replacing a qualified missing part.

In practice, the part is usually replaced at the first convenient opportunity, but it is
important to remember that the airplane remains airworthy regardless of the time
the airplane flies with an open CDL item. On the line, procedures to handle CDL
items consist of the administrative practices necessary to release the airplane and
include log entries, down line, pilot and dispatch notification. Also included will be
any maintenance limitations associated with the missing item.

Definitions in Respect to the MMEL/MEL
m - Means that a maintenance action is required when operating
with item inoperative
• Means that a specific operation procedure must be accomplished by the flight
crew
• The inoperative equipment, system or function must be visible
by a placard in the cockpit
• No standard interval is specified, however, items in this category shall be
rectified in accordance with the conditions stated in the MEL.

• Where a time period is specified it shall start at 00:01 on the
calendar day following the day of discovery.
• Items in this category shall be rectified within 3-days consecutive
calendar days, excluding the day of discovery.
• Items in this category shall be rectified within 10-days consecutive calendar days,
excluding the day of discovery.
• Items in this category shall be rectified within 120-days
consecutive calendar days, excluding the day of discovery

Authority to taxi an aeroplane
An operator shall take all reasonable steps to ensure that an aeroplane in his
charge is not taxied on the movement area of an aerodrome by a person other
than a flight crew member, unless that person, seated at the controls, has been
duly authorised by the operator or a designated agent and is competent to:
1. Taxi the aeroplane and use the radio telephone; and 2. has received instruction
in respect of aerodrome layout, routes, signs, marking, lights, air traffic control
signals and instructions, phraseology and procedures, and is able to conform to
the operational standards

OPS 1.125
a) An operator shall ensure that the following documents or
copies thereof are carried on each flight:
1. The Certificate of Registration;
2. The Certificate of Airworthiness;
3. The original or a copy of the Noise Certificate (if applicable),
including an English translation, where one has been provided by
the Authority responsible for issuing the noise certificate;

4. The original or a copy of the Air Operator Certificate;
5. The Aircraft Radio Licence; and
6. The original or a copy of the Third Party Liability Insurance
Certificate( s ).
b) Each flight crew member shall, on each flight, carry a valid flight crew licence with
appropriate rating(s) for the purpose of the flight

Additional Information and Forms to be Carried
OPS 1.135
An operator shall ensure that, in addition to the documents and manuals prescribed
in OPS and OPS 1.130, the following information and forms, relevant to the type and
area of operation, are carried on each flight:
1. Operational Flight Plan containing at least the information required in OPS 1.1060;
2. Aeroplane Technical Log containing at least the information required in Par - M
paragraph M.A. 306 Operator technical log system;

3. Details of the filed ATS flight plan;
4. Appropriate NOT AMI AIS briefing documentation;
5. Appropriate meteorological information;
6. Mass and balance documentation as specified in Subpart J;
7. Notification of special categories of passenger such as security
personnel, if not considered as crew. handicapped persons
.inadmissible passengers, deportees and persons in custody;

8. Notification of special loads including dangerous goods including
written information to the commander as prescribed in OPS 1.1215
(c);
9. Current maps and charts and associated documents as prescribed in OPS 1.290 (b )

10. Any other documentation which may be required by the States concerned with
this flight, such as cargo manifest, passenger manifest etc and
11 . Forms to comply with the reporting requirements of the
Authority and the operator.

Loss of Documents
OPS 1.125 and Appendix 1 to OPS 1.125 In case of loss or theft of
documents specified in OPS 1.125, the operation is allowed to continue
until the flight reaches the base or a place where a replacement
document can be provided

Information Retained On the Ground
OPS 1.140
At least for the duration of each flight or series of flights;
• information relevant to the flight and appropriate for the type of operation is
preserved on the ground; and
• the information is retained until it has been duplicated at the place at which it will
be stored in accordance with OPS 1.1065 ;or, if this is impracticable,
• the same information is carried in a fireproof container in the
Aeroplane

Marking of Break-In Points
OPS 1.800
An operator shall ensure that, if designated areas of the fuselage suitable for break-in
by rescue crews in emergency are marked on an aeroplane, such areas shall be marked
as shown below. The colour of the markings shall be red or yellow, and if necessary they
shall be outlined in white to contrast with the background. If the comer markings are
more than two metres apart, intermediate lines 9 cm x 3 cm shall be inserted so that
there is no more than two metres between adjacent marks.

Emergency lighting
OPS 1.815
An operator shall not operate a passenger carrying aeroplane which has a maximum
approved passenger seating configuration of more than nine unless it is provided
with an emergency lighting system having an independent power supply to facilitate
the evacuation of the aeroplane. The emergency lighting system must include: For
aeroplanes which have a maximum approved passenger seating configuration of
more than 19:
i. Sources of general cabin illumination;
ii. Internal lighting in floor level emergency exit areas; and
iii. Illuminated emergency exit marking and locating signs
