Indian constitution did not feel it to
necessary to incorporate the
fundamental duties of the citizens in the
constitution.

• They incorporated the duties of the

Origin Of
Fundamental
Duties
• On the recommendations
of the Swaran Singh
Committee, the
fundamental duties were
added by the 42nd
Amendment, 1976 in our
Indian Constitution. The
fundamental duties were
originally 10 in numbers
but in 2002, the 86th
Amendment increased its
number to 11.
The 11 Fundamental
Duties
According to the report given by Swaran Singh committee in
1976, most of the people were not aware of the
fundamental duties.
NON-
JUSTIFIABILITY
OF THE They also felt that in order to make people obey the
FUNDAMENTAL fundamental duties some sort of legal action must be
DUTIES taken in case of violation.

Keeping this in view the Supreme Court issued a notice

in 1998 to create awareness about the fundamental duties
and their plan to teach them in response the Government of
India established the Verma committee to examine
operational aspects of Fundamental Duties.
Significance of
fundamental duties

• It acts as a continual reminder to citizens that

while exercising their rights, they must be
mindful of their responsibilities to their country
and to other citizens.
• These contribute to the development of a sense of
discipline and patriotism.
• They contribute to the achievement of national
goals through active citizen participation rather
than passive spectatorship.
Enforceability of
fundamental duties

• Duties are observed by individuals as a result of

dictates of the social system the environment in which
one lives, under the influence of role models, or on
account of punitive provisions of law.
• If the existing laws are inadequate to enforce the
needed discipline, the legislative vacuum needs to be
filled. If legislation and judicial directions are
available and still, there are violations of duties by the
citizens
LET US SUM UP

•Fundamental Duties lead to national integration, unity and cultural harmony

among the members of different castes and creeds within Indian society. Though
erstwhile USSR was the first country in the world to adopt Fundamental Duties in
its Constitution, now both communist and non-communist countries of the world
have provisions for Fundamental Duties.
