Applicability - Rule 2

• To All Government servants


• Employees of non-statutory
Departmental Canteens

• Railway servants
• Casual/daily rated/part-time employees
• Persons paid from contingency
• Industrial establishment
• Workcharged establishment
• Members of All India Service
• Persons employed on Contract, unless
the contract provides otherwise

General Conditions
• Leave cannot be claimed as of right - Rule 7 (1)
• The leave sanctioning authority may refuse or
revoke leave of any kind but cannot alter the
kind of leave due and applied for. – Rule 7(2)
• Do not deny leave during last ten years of
service
• Leave of any kind may be refused or revoked by
the Leave Sanctioning Authority, if the
exigencies of public service demand (Rule 7)

• Avail leave with prior permission

• Kind of leave applied by the Government


Servant cannot be altered by the Leave
Sanctioning Authority, unless requested by the
Government Servant in writing

• The Government Servant’s claim for leave is


regulated as per rules in force at the time the
leave is applied for and granted (Rule 8)

• The Leave at the credit of a Government servant
who is dismissed or removed from service shall
lapse (Rule 9)

• Different kinds of leave can be availed in


combination (except casual leave) (Rule 11)

• No leave shall be granted for a continuous


period exceeding five years without the sanction
of the President (Rule 12)

• No leave to a government servant under
suspension (Rule 17 & FR 55)

• No leave shall be granted to a government


servant whom a competent punishing authority
has decided to dismiss/remove/compulsorily
retire from service (Rule 17)

• Sanction of leave amounts permission to leave


HQ, but leaving for abroad, separate permission
needed (Rule 17)

Commutation of Leave
(Rule 10)

• Change of the kind of leave already availed into


another kind is called commutation of leave.
• On the request of the employee
• It shall be subject to availability of leave due and
admissible at the time the leave was granted
initially

• Commutation is subject to adjustment of leave salary

• EOL granted on MC or otherwise may be commuted


retrospectively into Leave Not Due, subject to the
conditions prescribed for grant of LND

• Request for commutation should be made within thirty


days of rejoining after the relevant spell of leave

• No commutation after the employee ceases to be in


service (Retired/resigned etc.)

Earned Leave
• Credited in advance on 1st Jan/July – 15 days each
• Non availed portion of JT creditable
• Maximum accumulation permissible 300 days

• While affording credit on the first of Jan/July, if the leave


at credit is 300 or below but above 285, 15 days shall
be shown as separate element

• Encashment of EL during service time for LTC, subject


to conditions
• Maximum EL 180 days at a time
• 300 days leave preparatory to retirement

• For broken six monthly periods, leave will be credited at
two-and-a-half days per completed month

• While affording credit on 1st Jan/1st July, 1/10th of


EOL/Dies-non periods of previous six months, will be
deducted, subject to maximum of 15 days

• While affording credit fractions of a day shall be


rounded off to the nearest day;

• Leave salary: Last Pay Drawn + Allowances

Encashment of EL for
LTC
• 10 days at the time of availing LTC
• Balance at credit should be 30 days
• Total encashment in the entire service is 60
days

Half Pay Leave
• Credited in advance, 1st Jan/July, 10 days each
• Maximum accumulation permissible – no limit
• Can be granted on medical certificate or otherwise
• For broken six monthly periods, leave will be credited at
5/3 days per completed month
• While affording credit on 1st Jan/1st July, 1/18th of Dies-
non periods of previous six months, will be deducted,
subject to maximum of 10 days
• While affording credit fractions of a day is rounded off to
the nearest day

Commuted Leave

• Not exceeding half the amount of HPL at credit


may be granted
• On medical certificate
• Only when the authority is satisfied that the
employee will return for duty
• Twice the amount of leave will be debited
against HPL

Leave Not Due

• Leave which is not due to an employee is


granted
• 360 days during the entire service for permanent
employees, on production of medical certificate
• Limited to HPL he is likely to earn thereafter
• Debited to HPL that he will be earning
subsequently

Extra Ordinary Leave

• Granted on special circumstances, when no


leave is available or when leave is available but
the employee specifically applies for the leave;

• For Non permanent employees, EOL on any one
occasion is granted as per the following
conditions:
• 3 months;
• 6 months, when he has completed one year service
on MC
• 18 months when he has completed one year service
– for treatment of TB/Leprosy/Cancer or mental
illness
• 24 months for studies in public interest – three years
service required

Maternity Leave

• To Female Government servants, with less than


two surviving children
• Maximum 180 days (one spell)
• Leave salary is Last Pay Drawn
• 45 days in the entire career for miscarriage,
induced abortion or production of MC
(irrespective of number of surviving children)

• Can be combined with leave of any kind
• In continuation of Maternity Leave, leave of the
kind due and admissible may be taken without
MC up to a maximum of two years, however
LND/Commuted leave without MC is restricted to
60 days
• Not debited to Leave Account (Separately noted
in red ink in part – IV of the service Book)

Paternity Leave
• Male government servant with less than two
surviving children
• 15 days of leave
• Up to 15 days before or up to six months from
the date of delivery of the child
• Can be combined with any kind of leave
• Not debited to leave account
• If not availed within the specific time, lapses

Adoption
• Less than two children at the time of adoption
• For adoption of a child of less than one year of
age
• 135 days on the lines of Maternity Leave
• Leave salary is Last Pay Drawn
• Can be combined with leave of any kind
• Not debited to Leave Account (Saperately noted
in red ink in part –IV of the Service Book)

Special Disability Leave-
• Disabled by injury intentionally
inflicted or caused in or in
consequence of the due performance
of his official duties
• Maximum 24 months
• May be granted more than once but
maximum granted in consequence of
any one disability not to exceed 24
months
• Count as duty in calculating service
for pension

Hospital Leave

• Group D and C
• Duties involve handling
dangerous machinery,
explosives material,poisonous
drugs etc
• Production of MC from AMA
irrespective whether treatment
is in hospital or not

SEAMEN’S SICK LEAVE
• Warrant officer or petty officer on
government vessel undergoing
medical treatment for sickness or
injury in vessel or hospital

• Leave not exceeding six weeks
• Maximum period not exceeding 3
months to seaman disabled in the
exercise of his duty ( specific
conditions)

• Group C & D employees


attached to survey parties with
field and recess duties in
Survey of India dept and
seasonal staff in P&T dept
whose duties temporarily not

• To gazetted and non gazetted
• Rendered not less than 5 years
regular continuous service
including the period of

Changes in Leave Rules
after 7th pay commission
• EL accumulation retained at 300
days
• EL encashed at the time of LTC shall
not be adjusted at the time of final
settlement
• Encashment of leave (EL+HPL)
together 300 days. For the EL full
pay and for HPL only half pay (no
commutation to have full pay)

women employees for two years
(730 days) in the whole career
