• Negotiation are important to any business,


• The report will analyze the challenges that may have faced the negotiation
process between The University of Regina and the University of Regina
Faculty Association
• The paper will also look at implementation strategies and give a bests
action plan
Introduction

• Disputes often arise between different parties as a result of conflicting


views or interests in a particular subject
• Negotiation plays a key role in helping resolve conflict
• Employees in an organization often require negotiations with their
employer
• Conflicts to be resolved fast preventing any disruptions in operation
Negotiations in business
• Organization are designs to make profits
• Employees have demands and expectations form their employer like
benefits, job security and even fair treatment.
• Conflicts must be resolved fast and effectively ensuring that they have
minimal disruptions on operations
• Organizations will use their Human resource departments to negotiate
with employees on their behalf

• The University of Regina administration was involved with negotiations


with its union of staff the University of Regina Faculty Association
• A new collective agreement was to be agreed.
• .Previous negotiations that had occurred presented challenges
• Issues included cost control improvement on management, manage risks
seeking improved relations between management and its staff
Challenges in the negotiation process

Lack of time
• Time play a vital role in ensuring that negotiations occur effectively
• Time allows negotiators discuss on all topics analyze alternatives effectively .
• Time increases the pressure on negotiators to teach an agreement
• The negotiations took long and rushed to the last minute
• The lack of time saw some of the issues postponed for a later discussion just
as in the previous collective agreement
Making last minute changes

• Last minute changes in negotiation has a big impact on the effectiveness


of negotiations .
• Changes are often as a result of new emerging information that was not
available , change in parties or new set objectives
• Last minute changes fail to provide room for the other parties to deliberate

• A change in the agenda of topics discussed affected discussions.


Being rigid in discussions

• Parties engage in a negotiation process with underlying interests and


objectives
• Negotiator will take a strong stand on atopic with very little room of
negotiation
• Rigidity may also be inform of refusing process change .
• The University of Regina was too rigid refusing new agenda and use of
mediation .
Poor planning and organization

• Failure to plan is regarded as planning to fail


• .Planning and organization are vital in effective discussions
• Planning allows discussions carry out smoothly and be prepared for any
emerging issues
• Poor planning in the collective agreement negotiations resulted to time
wastage and not discussing all issues .
Lack of trust

• The success of negotiations is often as a result of trust


• Negotiations parties heavily analyze the credibility of the other party
• Trust in process and other party allows confidence that any agreement
reached will be implemented

• Problem solving
• Parties should engage in negotiations often to resolve an underlying problem
Avoid delays
• Delays in negotiations could hampering negotiation process hence the need
for discussion to occur timely.

Parties should show flexibility on some issues allowing room for negotiation

possible outcomes for the negotiation

stagnation of process and allow a desirable consensus
Building relationships

• A good relationship between parties entering into a negotiation has been


proven to effectively aiding negotiation processes
• Trust is an important aspect of the process .
• A strong relationship increases the confidence of the other party meeting
terms of the agreement mitigating any risks .
• The institution needs to establish a good relationship with this union could
facilitate smooth discussions.
Involving a third party

• A third party is a neutral person that can be agreed by all parties to


facilitate discussions
• Third parties act as mediators
• Mediators facilitate resources and ensure that the process is on track order
to meet the set objectives
• Mediators would have encourage all parties to actively participate in the
discussion allowing the collective agreement reached fast.
