Trade Name and importance of it Protection
1) What is a trade name (TN)?
It is the name under which an establishment is known and
operated, whether industrial, artisanal or agricultural, or even
establishments providing services (communication, tourism,
hotels, catering, finance and insurance, health centres, leisure,
etc…)

2)What is the function of TN


The essential function of the trade name is to allow the public to
recognize a particular establishment, to differentiate it from other
establishments.

3-Why do we protect a trade name?

The protection makes illegal the use of a name which reproduces


identically a commercial name previously used or registered by
another company, for the same activities or which resembles it to
the point of creating confusion in the minds of consumers.

Registering a business name legally protects the owner and


shields him from inconvenience.

4-How to protect a commercial name?

There are two ways:


Usage- This acquisition is fragile;
- It does not give any guarantee to the user or the holder as to the
subsequent use;
- The sanction is less vigorous in case of violation.

The registration - Is done by filing which grants an exclusive right;


It confers rights on the holder and allows him to benefit from civil
and criminal sanctions in the event of infringement of these
rights.

5-When do we talk about infringement of the rights of a trade
name?

There is an infringement of the rights of a trade name if a risk of


confusion appears.

Thus, the trade name is only protected between competitors.

The protection only concerns companies carrying out the same


activities. The goal here is to prevent the customer in the
presence of two similar names from being led to think that they
are the same company.

6-What are the sanctions related to the violation of a conferred
right?
-Prison sentence from 03 months to 01 year;
-Payment of a fine of 1,000,000 to 6,000,000 CFA francs.
In addition, reparations and other sanctions are provided for by
the Civil Code (payment of damages, publicity of judgment, etc…)
Only trade names registered with AIPO may be subject to criminal
sanctions against anyone who violates the rights attached thereto.
With regard to trade names that have not been registered with
AIPO, the sanctions are less severe and are essentially limited to
the sanctions provided for by the civil code in force in the country.

7-What is the duration of protection?

The term of trade name protection is ten (10) years from the date
of filing of the registration application. After this period,
ownership of the trade name may be retained without time limit
by successive renewals every ten (10) years subject to payment of
taxes related thereto.

8-What is the cost of protection?


Requests for registration of the trade name for renewal and prior
art search are subject to payment of the fees prescribed by the
regulations in force.
The amount is 10,000xaf for natural persons and 20,000xaf for
legal persons and which is valid for 10 years.

9-Where to file your commercial name?
-At AIPO
-To the National Liaison Structure (SNL),
- an AIPO branch present in each Member State.

10-What are the documents to provide?


- The NC501 form duly completed in 02 copies (available on the
OAPI website); www.oapi.Int.
- Proof of payment of the related taxes;
- The power of attorney, if applicable.

they don't give a damn about your action plans.

You have to prove your words with concrete deeds.

Life is not a historical narrative to tell us what you have already done
or what you are going to do, the world around you wants reality.

You have to do something every day towards your dreams if you


want to reach the top.

to know how to identify your real enemy.
Don't always be in contradiction when we tackle your product or
service: "BEING AN ENTREPRENEUR" means "SOLVING PROBLEMS".

If people have a problem with your service or your product, it is


useless to fight them: rather try to become the solution to the
problem, even if the problem comes from you.
Your only objective should be to prevent your customers from going
