4.0 Introduction
★ The aim of this report is to explain the conceptual meaning
of al-Mal (Property) and alMilkiyyah (Ownership) by
definition and its eligibility.

★ Discussing and differentiate types of al-Mal (Property) and


al-Milkiyyah (Ownership) and explaining haq Shuf’ah based
on Syariah law.
4.1 Definition of Al-Mal (Property) and Al-Milkiyyah
(Ownership)

★ Al-Mal (Property) in the Arabic language mean “things that is


owned by someone that may acquire and possess”.

★ Al-Milkiyyah (Ownership) refers to the legal relationship


between a human being and property that renders the property
specifically attached to him.
4.2 Al-quran and Al Mal
★ Al Quran and Al Mal has been mentioned in the Al-Quran many times for
example in Surah An-Nisa :

“ Do not entrust your properties - which Allah has made a means of support
for you - to the weak of understanding, but maintain and clothe them out of
it, and say to them a kind word of admonition” (Surah an-Nisa, 4:5 )
★ Allah warns us in the verse above not to provide money to
people whose thinking is not totally wise.
★ In another verse, Al-Quran explains how to gain income to
meet our daily needs in the correct way, as our Prophet did, and
how we are banned from doing so in a haram way.
★ Indeed, once we have amassed wealth, the Quran instructs us
on how to manage it fairly.
4.3 Al-quran and Al Milkiyyah
★ It is incumbent upon those with property to contribute to social welfare
through the redistribution of wealth and to contribute to economic
stability through contributions to the state.

★ “O you who believe, do not consume one another’s wealth wrongfully;


rather, let there be trade by mutual consent” [4: 29]
★ “And in their wealth and possessions are rights of the needy”
[51: 19].
★ The absolute ownership of all things belongs to Allah, and
mankind is entrusted to act upon property in accordance to
what has been ordained.
4.4 Types of Al-Mal (Property) and Al-Milkiyyah (Ownership)
★ Property is a term describing anything that a person or a business has legal
title over, affording owners certain enforceable rights over said items.
★ Ownership is the state or fact of exclusive rights and control over property,
which may be any asset, including an object, land or real estate, intellectual
property, or until the nineteenth century, human beings.

4.5 Hak Shuf’ah
★ Syuf'ah is linguistically taken from the word shaf ', which means partner.
★ According to the fuqaha ’, syuf’ah is the right of a partner to take the
share of his other friends in exchange for property or payment.
★ The person who asks for syuf'ah is called syafii'.
★ Then syafii ’took part of his friend who had sold with the payment
prescribed in the contract.
★ Some say that it is called syuf’ah because its owner combines something
sold to him, which was previously separate.
4.6 Conclusion
★ According to the Islamic faith, the absolute ownership of all things
belongs to Allah, and mankind is entrusted to act upon property in
accordance to what has been ordained.
★ Clearly defined property rights are fundamental to Islam, as the
protection of property is one of the objectives of the Syariah.
★ However, Islam also requires the circulation of wealth in an economy to
promote and ensure social benefits.
