Child Abuse Act (RA 7610)
Definition of Child Abuse
Maltreatment, whether habitual or not, of the child which
includes:
 Psychological or physical abuse, neglect, cruelty,
sexual abuse and emotional maltreatment
 Act, deeds, or words which debase, degrade or demean
the intrinsic worth and dignity of the child as a human
being
 Unreasonable deprivation of basic needs
 Failure to immediately give medical treatment to an
injured child resulting in serious impairment of his or
her growth and development, permanent incapacity or
death.

Who may file a complaint
• Offended party
• Parents or guardians
• Ascendant or collateral relative within the 3rd
degree (i.e., auntie, uncle)
• Officer, social worker or representative of a
licensed child-caring institution
• Officer or social worker of DSWD
• Barangay chairman
• At least three concerned, responsible citizens
where the violation occurred.
Juvenile Justice Welfare Act
(RA 9344, as amended by )
 Introduces the principle of restorative justice
and term “child in conflict with the law”
 Raises the age of criminal liability to 15 years
 Promotes intervention and diversion
 Disallows detention of children with adults
 Detention is a last resort
 Decriminalizes certain offenses when
committed by minors
 Prohibits death penalty

“Child at Risk" refers to a child who is vulnerable to and at the risk of
committing criminal offenses because of personal, family and social
circumstances, such as, but not limited to, the following:
1. being abused by any person through sexual, physical, psychological,
mental, economic or any other means and the parents or guardian
refuse, are unwilling, or unable to provide protection for the child;
2. being exploited including sexually or economically;
3. being abandoned or neglected, and after diligent search and inquiry, the
parent or guardian cannot be found;
4. coming from a dysfunctional or broken family or without a parent or
guardian;
5. being out of school;
6. being a street child;
7. being a member of a gang;
8. living in a community with a high level of criminality or drug abuse;
and
9. living in situations of armed conflict.

Refer to a severe and repeated use by a person of a
written, verbal, or a physical act directed against
another person that has the effect of placing the latter in
reasonable fear of physical or emotional harm, or
damage to his/her property.

Where do bullying takes place?
1. School grounds
2. Property immediately adjacent to school grounds
3. At school-sponsored or school-related activities,
functions or programs whether on or of school
grounds
4. School bus stops or school buses or other vehicles
owned , leased or used by a school
5. It may also occur at unrelated locations, functions
or programs
6. In the cyberspace, through the use of technology
or an electronic device or other forms of media

Written reprimand, community service, suspension,

In addition to the disciplinary sanction, the bully shall
also be required to undergo an intervention program
which shall be administered or supervised by the
school’s Child Protection Committee. The parents of the
bully shall be encouraged to join the intervention
program.

FALSE ACCUSATIONS
If the student, after an investigation, is found to have
knowingly made a false accusation of bullying, the
said student shall be subjected to disciplinary actions
or to appropriate interventions in accordance with the
existing rules and regulations of the Department or the
private school.
A Pledge Against Bullying

Stand up for someone who is being bullied when it is safe to do so
Report right away when it is not safe to stand up for someone being bullied

Encourage someone who is a victim of bullying to seek adult’s help
Learn how to prevent bullying and share it with my friends.
Use social media to spread goodwill and not as a tool to hurt and harm others
Cooperate with teachers and school staff on programs addressing problems of bullying.
I believe everyone deserves to feel safe at school, to be who they are, to be treated with respect
and kindness, to feel included and valued, and be given opportunity to grow and become a better
person. For this reason, I will stand up for the weak, the out-numbered, the disabled, and the
vulnerable, and commit not to engage in any form of bullying wherever I may be.
