INTRODUCTION:
If you try to search “plagiarism cases” in a search engine, it would give you results
arranged according to how scandalous the cases were. In the Philippines alone,
approximately 400,000 Google search results about plagiarism cases would come up.
This is an alarming issue that we face worldwide. From photographs, videos, and
research papers, to song compositions and medleys, everything has been plagiarized in
some way. Hence, unintentional plagiarism is still a bad practice in some way. Also, laws
about copyrights must be respected. So we will be discussing and helping you to
understand Copyright Law.
What is Copyright Law?

Copyright Law, which were designed to protect the intellectual property of creators,
have served us well for many years. Works are protected by the sole fact of their
creation, irrespective of their mode or form of expression, as well as of their content,
quality and purpose. (Section 2 The Philippine copyright law officially known as the
Republic Act No. 8293)
COPYRIGHT BASICS:
1. Copyright Ownership
Copyright is a legal protection granted to the creators of the original works,
such as literature, music, art, and software. The copyright owner is typically the
person that created the work.

2. Duration of Copyright Protection:

The duration of copyright protection varies depending on the type of work


and the laws of the country.
3. Rights of copyright holders:
Copyright holders have exclusive rights to their works, including the
rights to:

 Reproduce the work.


 Distribute copies of the work.
 Create derivative works (e.g., adaptations or translations).
 Publicly perform or display the work.
 License or sell these rights to others.
PUBLIC DOMAIN:
The term “public domain” refers to creative materials that are not protected by
intellectual property laws such as copyright, trademark, or patent laws. The public
owns these works, not an individual author or artist. Anyone can use a public domain
work without obtaining permission, but no one can ever own it.
FAIR USE:
The fair use of a copyrighted work for criticism, comment, news, reporting,
teaching including multiple copies for classroom use, scholarship, research and
similar purposes is not an infringement of copyright. Therefore, fair use permits
a party to use a copyrighted work without the copyright owner’s permission.
COPYRIGHT REGISTRATION:
 Registering copyright provides public evidence of ownership, statutory
damages, and attorney’s fees advantages.

 To Register, complete and application, pay the fee, and submit a copy of
the work to your country’s copyright office or authority.
COPYRIGHT INFRINGEMENT:
Occurs when someone uses, reproduces, distributes, or creates
derivative works from a copyrighted work without the permission of
the copyright holder. This unauthorized use violates the exclusive
rights granted to the copyright owner
PUNISHABLE BY THE LAW:
-It is punishable by the following:

1. Imprisonment of between 1 to 3 years and a fine of between 50,000 to 150,000


pesos for the first offense.
2. Imprisonment of 3 years and 1 day to six years and plus a fine of
between 150,000 to 500,000 pesos for the second offense.
3. Imprisonment of 6 years and 1 day to 9 years plus a fine ranging from 500,000 to
1,500,000 pesos for the third and subsequent offenses.

DIGITAL COPYRIGHT:

Digital Rights Management (DRM): DRM is a set of technologies and


methods used to protect digital content, such as eBooks, music, movies, and
software, from unauthorized copying and distribution. It often involves
encryption, access control, and licensing mechanisms. While DRM is
intended to safeguard content, it can be controversial as it can limit user rights
and interoperability.

STREAMING and PIRACY:
 Impact of Streaming Services on Copyright: Streaming services have
revolutionized content distribution, offering legal access to copyrighted material.
However, they also face copyright challenges, such as licensing complexities,
and have shifted revenue models for creators and copyright holders.

 Strategies to Combat Online Piracy: Strategies to combat online piracy include


legal actions against infringing websites, site blocking, international cooperation,
and issuing takedown notices. Offering affordable legal alternatives,
implementing digital rights management (DRM), and raising public awareness
about the consequences of piracy are also key measures in addressing this issue.

AI- GENERATED CONTENT:


The copyright lies with the user, i.e. the author who used the program to
create his or her work. But when it comes to artificial intelligence that are
capable of generating a work, the user’s contribution to the creative process
may simply be to press a button so the machine can do its thing.

FAIR USE CHALLENGES:
In recent cases, fair use challenges have arisen in the context of user-
generated content on platforms like YouTube. Creators and platforms are
grappling with copyright claims, leading to debates on how to strike a
balance between protecting copyrighted materials and enabling fair use for
transformative content. As content sharing and creation continue to grow
online, navigating this delicate balance remains a pressing issue.
CURRENT ISSUES OF THE COPYRIGHT LAW:
CHALLENGES POSED BY ONLINE PIRACY:

Online piracy involves the unauthorized distribution of copyrighted digital


content, leading to several challenges. It can lead to financial losses for content
creators and distributors. Additionally, piracy can undermine the incentives for
artists and creators to produce new content. Enforcement of copyright laws in
the digital realm can be challenging due to the global nature of the internet and
the anonymity it affords, making it difficult to combat online piracy effectively
CONCLUSION:
Copyright law grants creators exclusive rights to their original works,
such as literary, artistic, and musical creations, and is essential for
protecting intellectual property. It's important to understand concepts like
fair use, which allows limited use of copyrighted materials for purposes
like criticism or education. With the constantly evolving digital landscape,
staying informed about copyright issues is crucial, as technology and legal
interpretations continue to shape the landscape of intellectual property and
creativity
