Introduction

Welcome to this self-learning MIL Module 8: Legal, Ethical, and


Societal Issues in Media and Information Literacy. In accomplishing this
learning material, you have to take first the pre-test, and you are tasked to
study the learning activities and perform the various practice tasks. After
doing so, you may take the post- test to determine the knowledge and skills
you gained from this lesson. To enhance your competence, you have also to
accomplish your assignment found in this module. Thank you and Good luck!

Copyright is grounded in Republic Act No. 8293 or The Intellectual


Property Code of the Philippines of 1997. It declares that “the State recognizes
that an effective intellectual and industrial property system is vital to the
development of domestic and creative activity, facilities transfer of technology,
attracts foreign investments, and ensures market access for our products. It
shall protect and secure the exclusive rights of scientist, inventors, artist, and
other gifted citizens to their intellectual property and creations, particularly
when beneficial to the people, for such periods as provided in this Act.”

In particular, Section 172.2 of the Act states that “works are protected
by the sole fact of their creation, irrespective of their mode or form of
expression, as well as of their content, quality and purpose.”

In that context, the following article from the website the Concordia
University Nebraska Library may be applicable.

Copyright law grants protection to original works of authorship fixed in


a tangible means of expression. That includes just about anything that is
written, recorded, built or crafted, whether published or unpublished. It even
includes websites and the images on them!

If you want to use, sample or make a copy of all part of a work created
by someone else, you need to first determine how copyright law applies to
your situation.

This under the lens of RA 10175: Cybercrime Law

What is RA 10175 or Cybercrime Law? RA 10175 punishes content-related


offences such as cybersex, child pornography and libel which maybe committed through
a computer system.

Individuals found guilty of cybersex face a jail term of prison mayor (6 years and
one day to 12 years) or a fine of at least P200,000 but not exceeding P1 million.

Child pornography via computer carries a penalty one degree higher than that
provided by RA 9775, or the Anti-Child Pornography Act of 2009. Under RA 9775, those
who produce, disseminate or publish child pornography will be fined from P50,000 to P5
million, and slapped a maximum jail term of reclusion Perpetua, or 20 to 40 years.

Persons found guilty of unsolicited communication face arrest (imprisonment for 1


month and 1 day to 6 months) or a fine of at least P50,000 but not more than P250,000,
or both.

❖ Copyright - a legal device that gives the creator of a literary, artistic, musical, or other
creative work the sole right to publish and sell that work. Copyright owners have the
right to control the reproduction of their work, including the right to receive payment
for that reproduction. An author may grant or sell those rights to others, including
publishers or recording companies. Violation of a copyright is called infringement.

❖ Plagiarism - an act or instance of using or closely imitating the language and thoughts
of another author without authorization; the representation of that author's work as
one's own, as by not crediting the original author.

❖ Digital divide - an economic inequality between groups in terms of access to, use of,
or knowledge of ICT. The divide within countries (such as the digital divide in the
United States) can refer to inequalities between individuals, households, businesses,
and geographic areas at different socioeconomic (and other demographic) levels. The
Global digital divide designates countries as the units of analysis and examines the
divide between developing and developed countries on an international scale.

processes.

❖ Cyber Bullying - bullying that takes place online, or using electronic technology such
as cell phones, computers, and tablets over communication tools including social
media sites, text messages, chat, and websites. Examples of cyber bullying: text
messages or emails composed to insult or demean; rumors or false statements spread
by email or posted on social networking sites; and humiliating photos, videos,
websites, or fake profiles deliberately shared across social media.

❖ Fair Use Guidelines - In its most general sense, a fair use is any copying of copyrighted
material done for a limited and “transformative” purpose, such as to comment upon,
criticize, or parody a copyrighted work. Such uses can be done without permission
from the copyright owner. In other words, fair use is a defense against a claim of
copyright infringement. If your use qualifies as a fair use, then it would not be
considered an infringement.
