Continuous Hearing

• Acting upon a Public Interest Litigation filed by Uma


Tamang of Maiti Nepal, Sunita Danuwar of Shakti
Samuha and Sushma Gautam of Forum for Women, Law
and Development, in September 2012, A division bench
of Justices Kalyan Shrestha and Baidhyanath Upadhayay
ordered the government and authorities concerned to
make special provisions to promptly hear and clear cases
of ‘serious nature’ such as rape, hostage taking and
human trafficking.
• the Supreme Court has directed authorities to
make arrangements for continuous hearing on
serious criminal cases in district courts.
• The court issued a mandamus order in the name
of the Registrar of the Supreme Court to make
arrangements for continuous hearing and
demand budget for it from the government. It
directed the government to provide funds for
continuous hearing as per Rule 23(C) (1) of the
District Court 1996. “Continuous hearing will
help deliver speedy justice to the victims and
bring the culprits to book,” the order stated.
• Though there is a legal provision that calls for
“continuous hearing” on certain cases, The
bench also ordered the apex court registrar to
form a mechanism in different courts to help
facilitate dialogue among different stakeholders
in a case, including attorneys of the plaintiff and
government attorneys.
Introduction
• The provision in relation to continuous hearing
is one of the fundamental provisions available
within the existing law ensure speedy and
effective justice.
• However, this provisions is often ignored due to
lack of clear conceptual understanding among
the judges and court officials, lack of shared
understanding and coordination among the
justice sector actors, procedural complications,
and need of reform in other relevant legislations.
• The division bench further directed the
Monitoring Division of the Supreme Court to
keep track of developments in such cases, while
also ordering the Ministry of Home Affairs,
Nepal Police Headquarters and the OAG to make
necessary arrangements to produce witnesses as
required by the courts to ensure continuous
hearing. The court said rape, domestic violence,
trafficking in women, abduction and hostage-
taking, arson, cheating and drug peddling .

• Continuous hearing allows to continue the
hearing process of serious cases without having
to wait for another date months away.
• The ultimate goal of this provision is speedy
justice delivery to provide immediate relief to
the victims of serious crimes such as rape,
violence, and children abuse etc.

• ३६. मुामा लगातार कारबाह र सुनुवाई गरनेः
• (१) यस नयमावलमा अय जुनसुकै कु रा लेिखएको भए तापन अनुसूची -१० मा उलेख
भएका मुाको हकमा तउर परेपछ वा पन अवध समा भएपछ लगातार कारबाह र सुनुवाई गर
कनारा गरनेछ । तर लगातार कारबाह र सुनुवाई नहुने मुासँग लगाउमा रहेको भए यतो मुामा
लगातार कारबाह र सुनुवाई गरने छैन ।
• (२) उपनयम (१) बमोिजम लगातार कारबाह र सुनुवाई हुने मुाको पेशी तोदा इजलासको
आदेश अनुसार गनु पनछ ।
• (३) उपनयम (१) बमोिजमका मुाहमा अदालतले तोके को दनमा पले आना साी माण पेश
गनु पनछ ।
• (४) उपनयम (२) र (३) को काय सप भएपछ थप माण परण गन आवयक नभए
अदालतले तकालै नणय गन सनेछ ।
