Summary of the

Case Scenario
On November 14, 2022, at around 3:00 o'clock p.m.,
PO2 Labuen and SPO1 De Los Santos, and other
police officers from Tartaria Silang Cavite Police Station
were conducting a checkpoint in NCBN 1 Street Camp
General Mariano N. Castaneda Silang Cavite when
they flagged down a white Yamaha nmax motorcycle
driven by Mohammad Hussein Bazar. Accused was not
wearing helmet and shoe.
PO2 Labuen approached accused and thereupon
noticed that the motorcycle did not have a license
plate. He asked accused to show his driver's license,
but the latter could not present the same. PO2
Labuen then requested accused to show the
registration papers. Bazar opened the motorcycle's
utility box and took out a folder containing the LTO -
issued license plate (EJ 257) as well as the
photocopies of the motorcycle's expired registration
which he handed to SPO1 Delos Santos.
At this instance, (5) plastic sachets containing white
crystalline substance dropped on the groud from the
folder which PO2 Labuen upon noticing the object
suspected to be illegal drugs immedietly confiscated
and arrested Bazar. PO2 Labuen then marked the
confiscated sachets with "MHB-1, " MHB-2, ", MHB-
3,MHB-4, MHB-5 " which stands for the initials of
"Mohammad Hussein Bazar. "
Afterwards, accused, along with the seized items and
the motorcycle, were brought to the police station
where accused was photographed with the seized
plastic sachets; and an Inventory of the Property
Seized/Confiscated was prepared by PO2 Labuen and
signed by Department of Justice representative Jaroe
Lanoza, media representative and Barangay Chairman
Esteban T. Saguibo Jr.
Thereafter, the seized items were brought by PO2
Labuen and SPO1 Delos Santos to the Cavite
Provincial Crime Laboratory Office for forensic
examination. In Chemistry Report No. MB-257-2022
dated November 14, 2022 issued by PMaj Harvey
Dalagan, the test yielded a positive result
for methamphetamine hydrochloride, a prohibited drug

The following are the procedures being observed by
the PNP members in the enforcement of warrantless
arrest under Section 5, Rule 113 and Section 13,
Rule 126 of the Rules of court, in the case of
MUHAMMAD HUSSEIN BAZZAR
1. The apprehending team PO2 JAN MCNEIL K.
LABUEN and PO1 NOWIE A. DELOS SANTOS
immediately arrest MOHAMMAD HUSSEIN
BAZZAR found to be violating in flagrante the
provisions of RA 9165 when he dropped 2 sachets
containing white crystalline substance suspected to
be shabu
2. The dangerous drugs was be immediately
seized and taken into custody of the
apprehending team.
3. The seizing officer conduct the actual physical
inventory, take photographs and properly mark the
items or articles seized or confiscated in the place of
seizure and in the presence of the arrested and
representatives from the Department of Justice,
MEDIA and elected government official.
4. The seizing officer submitted the
seized item to the PNP Crime
Laboratory for examination and
analysis;
5. The arresting officers bring the arrested
suspect to the Silang Municipal Police Station
for proper custody, documentation and proper
disposition.
6. MUHAMMAD HUSSEIN BAZZAR (arrested
suspect) was presented to the PNP Crime
Laboratory for physical, medical examination
and drug testing.
7. PO3 ESTEBAN T. SAGUIBO the assigned
Investigator-On-Case collated the results of the
examinations, prepare the appropriate charges
and refer the case to the prosecutor’s office for
inquest proceedings.
The investigator on case
submit the following:
a. Copy of the Spot Report duly received by PDEA

b. Copy of the Receipt of the Inventory of items seized/


Confiscated duly verified under oath

c. Photograph of the crime scene

d. Copy of the Receipt of Turn-Over of Evidence

e. Copy of the Receipt of Turn-Over of the arrested suspects


f. Copy of the request for and results of the Laboratory, Drug Test
and Physical/Medical examination on the Drugs and the suspect/s

g. Copy of the Booking Sheet and Arrest Report

h. Photographs of the evidence seized and the suspect

i. Copy of the Affidavit of Seizing Officer

j. Affidavit of other witnesses


8. The Investigator-On-Case thereafter
submitted a report to PMAJ HARVEY .
DALAGAN the Chief of Office.
9. The Investigator-On-Case furnished the
PDEA with a complete set of the case folder
and regularly update the same with the status
of the case.
10. The Chief of Office and the Investigator-On-
Case maintained a case monitoring system or
record of the case and ensure the religious
presence of the PNP witnesses during court
proceedings/ trial to insure the conviction of the
accused.
