law is wider than e.g. UK.

Allegations:
1. $100m raised from various donors of which $40m unaccounted for.
2. Overcharging by Trump Hotel DC for inauguration-related events.
3. Use of surplus to pay Jared Kushner’s legal bills.

8. The Trump Foundation (Charity)
Allegations of misuse of charity funds (paying personal legal fees from
charity funds &c).

Foundation wound up by NY courts December 2018. Bans for family


from acting on boards of NY charities.

9. Obstruction of Justice
NB history – articles of impeachment against Nixon & Clinton both contained
allegations of obstruction – attempts to cover up other wrongdoing.
A Attempting to obstruct investigation of Flynn (briefly National Security
Adviser, 2017) by pressurising and then sacking James Comey (Director of the
FBI).
B Obstructing investigation of Trump self/family/compadres by
sacking/pressurising those involved (or not involved – Sessions) in the Russia
investigation with a view to securing its end.
C Obstruction of justice by promising/delivering pardons to people who kept
schtum.
D Judicial and prosecutorial appointments
Sacking of Comey [Director, FBI] (2017)
FBI was investigating Russian interference in election, and Flynn’s part
therein.
Trump wanted the investigation stopped. He fired Comey, expecting
that the A-G (Sessions) would end the enquiry. Instead Sessions
recused himself and his deputy set up a Special Counsel investigation.
Redolent of Nixon’s “night of the long knives” (the beginning of his
end).
Mueller - Outcome
Many individual prosecutions
(i) Clear evidence of Russian interference in 2016 US Presidential Election
(ii) Significant damning evidence of obstruction of justice (by Trump)

Report makes no recommendation to indict the President (because of an


existing, but questionable DoJ policy that a sitting President cannot be
indicted). No recommendation to impeach (because, said Mueller, that was
a decision for the House). A-G Barr puts out statement saying DoJ will take
no further action. House Democrats decided not to impeach.
9. First Impeachment Feb 2020 - the phone
call with Zelensky
Soliciting action against Biden and his son.
‘I would like you to do us a favour though … Because our country has
been through a lot and Ukraine knows a lot about it. I would like you to
find out what happened with this whole situation with Ukraine, they
say Crowdstrike …. The other thing, there's a lot of talk about Biden's
son, that Biden stopped the prosecution, and a lot of people want to
find out about that, so whatever you can do with the Attorney General
would be great. Biden went around bragging that he stopped the
prosecution so if you can look into it … it sounds horrible to me... ‘.
Impeachment (House of Representatives v
Trump, Feb 2020)
Allegations
Trump made delivery of military aid to Ukraine conditional upon Ukraine
mounting an anti-corruption investigation of the business activities in Ukraine of
Joe (the favourite to contest the 2020 election with him) and Hunter Biden (Joe’s
son).

… but no criminal offence formally necessary for ‘high crimes and
misdemeanours’ anyway.

And they shall make a List of all the Persons voted for, and of the Number of Votes for each; which List
they shall sign and certify, and transmit sealed to the Seat of the Government of the United States,

and House of Representatives, open all the Certificates, and the Votes shall then be counted.

1. Before: was Trump involved in the planning? What did he know,
when did he know it? Immediately after these events little was
known.
2. Trump’s speech in the Ellipse: to his knowledge, some present were
armed
3. During: there is no offence like ‘misconduct in public office’, but
what greater dereliction could there be?
The Second Impeachment
Single Article: ‘incitement of insurrection’ against the U.S. government and
‘lawless action at the Capitol’.
‘ … prior to the joint session of Congress held on January 6, 2021, to count the votes of the electoral college, President Trump
repeatedly issued false statements asserting that the presidential election results were fraudulent and should not be accepted by
the American people or certified by state or federal officials;
shortly before the joint session commenced, President Trump reiterated false claims to a crowd near the White House and willfully
made statements to the crowd that encouraged and foreseeably resulted in lawless action at the Capitol;
members of the crowd, incited by President Trump, unlawfully breached and vandalized the Capitol and engaged in other violent,
destructive, and seditious acts, including the killing of a law enforcement officer;
President Trump's conduct on January 6, 2021, followed his prior efforts to subvert and obstruct the certification of the presidential
election, which included a threatening phone call to the Secretary of State of Georgia on January 2, 2021;
President Trump gravely endangered the security of the United States and its institutions of government, threatened the integrity
of the democratic system, interfered with the peaceful transition of power, and imperiled a coequal branch of government; and
by such conduct, President Trump warrants impeachment and trial, removal from office, and disqualification to hold US office.
Result: to convict: 56 to acquit: 44 (acquitted).

49 democrats plus 7 Republicans (Richard Burr (NC), Bill Cassidy (LA),
Susan Collins (ME), Lisa Murkowski, (AK), Mitt Romney, (UT) Ben Sasse,
(NE) Pat Toomey (PA)) = 56 voted to convict, thus falling 11 short of the
2/3 required to convict.
Fourteenth Amendment
Section 3.
No person shall be a Senator or Representative in Congress, or elector of President and Vice-
President, or hold any office, civil or military, under the United States, or under any State, who,
having previously taken an oath, as a member of Congress, or as an officer of the United States, or as
a member of any State legislature, or as an executive or judicial officer of any State, to support the
Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or
given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House,
remove such disability.
Section 4.
The validity of the public debt of the United States, authorized by law, including debts incurred for
payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be
questioned. But neither the United States nor any State shall assume or pay any debt or obligation
incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or
emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.
Section 5.
The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

produces a report which could serve as an indictment.

Power to grant Reprieves and Pardons for Offences against the United
States, except in Cases of Impeachment.
